HomeMy WebLinkAbout2011/09/20 Item 04 " CITY COUNCIL AGENDA STATEMENT ~~ CITY OF (HUlA VISTA 09/20/20 II Item+- ITEM TITLE: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AMENDING THE FISCAL YEAR 2012 POLICE DEPARTMENT BUDGET BY APPROPRIATING $80,818 FOR THE REGIONAL COMPUTER FORENSICS LABORATORY CHIEF OF POLICE CITY MANAGER: SUBMITTED BY: REVIEWED BY: 4/5THS VOTE: YES X NO SUMMARY The San Diego Regional Computer Forensics Laboratory (RCFL) has requested that the City of Chula Vista act as the fiscal agent for hiring hourly employees to work in the RCFL to conduct forensic criminal investigations of computer equipment that may hold evidence of criminal activity. ENVIRONMENTAL REVIEW This proposed activity has been reviewed for compliance with the California Environmental Quality Act (CEQA) and it has been determined that the activity is not a "Project" as defmed under Section 15378 of the State CEQA Guidelines because it will not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is necessary. RECOMMENDATION Council adopt the resolution. BOARDS/COMMISSION RECOMMENDATION Not Applicable. DISCUSSION The San Diego Regional Computer Forensics Laboratory (RCFL) is a one-stop, full service forensics laboratory and training center devoted entirely to the examination of digital evidence in support of criminal investigations. Its mission is to provide computer-related 4-1 9/20/2011ltemL Page 2 of2 assistance to law enforcement agencies within San Diego and Imperial counties. Its facility has the distinction of being the fIrst established FBI-sponsored RCFL in the country. Law enforcement agencies participate in the RCFL either by assigning full-time staff to the task force or by paying for forensic services on an as-needed basis. The funds collected by the RCFL for as-needed services will now pay for additional needed staff time and equipment/supplies required for these forensic examinations. Due to the increasing demand ofRCFL services, the RCFL Director has asked the Police Department to hire part-time hourly positions (RCFL Network Engineer) to help conduct forensic examinations of computers or other devices that may hold electronic evidence. These hourly positions will augment the staff of existing forensic examiners and will work approximately 20 hours per week. These positions will be fully reimbursed by RCFL and the City will receive a 4% administrative fee for acting as the fIscal agent. DECISION MAKER CONFLICT Staff has reviewed the decision contemplated by this action and has determined that it is not site specifIc and consequently the 500 foot rule found in California Code of Regulations section 1 8704.2(a)(1) is not applicable to this decision. CURRENT YEAR FISCAL IMPACT Approval of this resolution will result in the appropriation of $80,818 to the personnel services category of the Police Department fIscal year 2011/2012 budget. These personnel costs are fully reimbursed by the Regional Computer Forensics Lab, and the City receives a 4% administrative fee for acting as the fIscal intermediary for RCFL. Because of the 4% administrative fee, there is a positive impact of$3,233 to the General Fund. ONGOING FISCAL IMPACT There will be a positive net impact to the General Fund. Because of the 4% administrative fee, there is a positive impact of $3,233 to the General Fund in each succeeding year. ATTACHMENTS None. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AMENDING FISCAL YEAR 2012 POLICE DEPARTMENT BUDGET BY APPROPRIATING $80,818 FOR THE REGIONAL COMPUTER FORENSICS LAB ORA TOR Y WHEREAS, the San Diego Regional Computer Forensic Laboratory (RCFL) is a law one-stop, full service forensics laboratory and training center devoted entirely to the examination of digital evidence in support of criminal investigations; and WHEREAS, these computer forensic examinations are critical III recovenng digital evidence from computers and other electronic devices; and WHEREAS, the RCFL has requested that the City of Chula Vista Police Department act as the fiscal agent to hire hourly CBAG RCFL Network Engineers to assist with these forensic examinations; and WHEREAS, the RCFL will pay the full cost of these hourly positions, plus a 4% administrative fee, resulting in a positive impact to the General Fund. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby amend the Fiscal Year 2012 Police Department Budget by appropriating $80,818 to the personnel services category of the Police Department budget for the Regional Computer Forensics Laboratory.
