It was reported that about 1.4 million customers were without electrical power. As a result, the City activated its emergency operations center and took action in response to the emergency. The County of San Diego declared a state of emergency, which included the City of Chula Vista and other cities within the County. The Emergency Services Director (City Manager) for the City of Chula Vista similarly declared a local state of emergency. This resolution seeks to ratify the Emergency Services Director's Declazation of Local Emergency and set September 15, 2011 at 2:00 pm as the end date for Declaration of the Local Emergency, unless additional action is taken by City Council or the Director of Emergency Services. ENVIRONMENTAL REVIEW 17-1 September 13, 2011, Item ~7 Page 2 of 3 The subject of the proposed resolution, is not a "project" within the meaning of CEQA (Pub. Resources Code §21000, et. seq.) as set forth in the State CEQA Guidelines section 15060(c)(3). RECOMMENDATION It is recommended that City Council approve the resolution. BOARDS/COMMISSION RECOMMENDATION Not applicable. DISCUSSION On September 8, 2011, the Southern California region, including the County of San Diego and the City of Chula Vista, experienced an unprecedented electrical power outage. It was reported that about 1.4 million customers were without electrical power. It was further reported that it could take several days to restore electrical power to all electrical power customers. As a result, the City activated its emergency operations center ("EOC") and took action in response to the emergency. Many City employees participated in the response to the local emergency and they should be highly commended for performing in an exemplazy manner. On September 9, 2011, pursuant to Government Code section 8630 and Chula Vista Municipal Code ("CVMC") section 2.14.080(A), the Emergency Services Director (City Manager) for the City of Chula Vista declared a local state of emergency as a result of the aforementioned regional power outage. San Diego County had also previously declared a state of emergency. Government Code section 8630 permits an official designated by a local agency to declaze a local emergency. Government Code section 8630 also provides that a declaration of a local emergency made by such designated local official shall not remain in effect for more than seven days, unless ratified by City Council. CVMC section 2.14.080(A) provides that the City's Director of Emergency Services may declare a local emergency when City Council is not in session. The City Manager, pursuant to CVMC section 2.14.070, functions as the director of emergency services. CVMC section 2.13.080(A) also requires that City Council ratify a declaration of a local emergency if it was declared by the Director of Emergency Services at the "next regularly scheduled council meeting held after the date of the proclamation." This resolution carries out the requirement of Section 2.14.080(A), that City Council ratify the Declaration of Local Emergency made by the Director of Emergency Services, and sets the end date of the local emergency as September 15, 2011 at 2:00 pm (which is seven days from the effective date of the Declaration of Local Emergency). DECISION MAKER CONFLICT The proposed action is not site specific, and, as a result, no conflicts have been identified. 17-2 September 13, 2011, Item Page 3 of 3 CURRENT YEAR FISCAL IMPACT The City during the local emergency called in additional staff to assist, including, but not limited to, Police, Fire, IT, HR, Finance, and Public Works personnel. As such, additional personnel expenses were incurred. A declaration of a local emergency and similar declarations by other government entities may assist (and may be required for federal assistance if available) in receiving aid from other local, state, or federal agencies. However, the expenditures from the City's response to the local emergency and any aid that may be received have not yet been determined. That conditions of extreme peril to the safety of persons and property have arisen within the City of Chula Vista caused by the September 8, 2011 Southern California regional electrical power outage, which included the County of San Diego and the City of Chula Vista; and 2. That these conditions are likely to be beyond the normal control of the services, personnel, equipment, and facilities of the City of Chula Vista; and 3. That the City, as a result of those conditions, activated its Emergency Operations Center; and 4. That City staff has taken and continues to take appropriate action(s) to meet those conditions; and WHEREAS, County of San Diego faced with the same conditions, has also declared a state of emergency, which included the City of Chula Vista and other cities within the County; and WHEREAS, City Council for the City of Chula Vista is not in session; and NOW, THEREFORE, based on the facts and circumstances set forth above, the Director of City of Emergency Services of the City of Chula Vista hereby declares: A local emergency is hereby declared, effective September 8, 2011. The aforementioned local emergency shall expire seven days from its effective date, unless otherwise lawfully extended, or terminated earlier by the Director of Emergency Services. The Declaration of Local Emergency issued by the Director of Emergency Services is hereby ratified. 2. The aforementioned Declaration of Local Emergency shall expire on September 15, 2011 at 2:00 pm, unless otherwise lawfully extended, or terminated earlier by the Director of Emergency Services.
