RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA ADOPTING NEGATIVE DECLARATION
IS-88-39, APPROVING AMENDMENT #5 TO THE CERTIFIED
CHULA VISTA LOCAL COASTAL PROGRAM AND AUTHORIZING
SUBMITTAL OF SAID AMENDMENT TO THE CALIFORNIA
COASTAL COMMISSION
The City Council of the City of Chula Vista does hereby resolve as
follows:
WHEREAS, the Planning Commission on January 13, 1988, authorized
staff to proceed with a report and recommendation on a proposal by National
Avenue Associates to allow new car dealerships and accessory uses on the
property identified as the Inland Parcel in the Bayfront Specific Plan; and,
WHEREAS, notice regarding the availability of the proposed LCP
Amendment #5 for public review and the Planning Commission and City Council
public hearings was issued on February 19, 1988, pursuant to Section 13515 of
the California Administrative Code; and,
WHEREAS, the property appears to be generally well suited to
accommodate new car dealerships because there is frontage on Broadway, a good
relationship to the freeway and National City Mile of Cars, and little
potential for conflict with surrounding uses; and,
WHEREAS, requiring that a Conditional Use Permit be obtained for new
car sales and accessory uses will ensure that potential environmental impacts
are reviewed on a case-by-case basis; and,
WHEREAS, in accordance with the California Environmental Quality Act,
environmental review has been completed for Amendment #5 to the Local Coastal
Program (LCP) and Negative Declaration IS-88-39 has been issued; and,
WHEREAS, on March 9, 1988, the Planning Commission of the City of
Chula Vista conducted a public hearing to consider Amendment #5, and
recommended that the City Council find that the proposed LCP amendment will
have no significant environmental impacts, adopt Negative Declaration IS-88-39
and approve LCP Amendment #5; and,
WHEREAS, the City Council public hearing originally scheduled for
March 22, 1988, was continued at that meeting until April 5, 1988; and,
WHEREAS, the City Council of the City of Chula Vista conducted a
public hearing on April 5, 1988, and considered Negative Declaration IS-88-39
and Amendment #5 to the certified Chula Vista LCP; and,
WHEREAS, the City of Chula Vista intends to carry out the certified
Chula Vista LCP in a manner consistent with the California Coastal Act.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Chula Yista hereby:
1. Adopts Negative Declaration IS-88-39 and finds that proposed
Amendment #5 to the certified Chula Vista LCP will have no
significant impacts on the environment.
2. Approves Amendment #5 to the certified Chula Vista LCP as
presented in Attachment A to this resolution and finds, based on
the analysis in Attachment B, that LCP Amendment #5 is
consistent with the relevant policies in Chapter 3 of the
Coastal Act.
3. Authorizes submittal of said Amendment #5 to the California
Coastal Commission as an amendment that will take effect
automatically upon Commission approval or on May 6, 1988,
whichever date is later.

The following text is an analysis of the consistency of LCP Amendment #5
with the applicable sections of Chapter 3 of the Coastal Act. LCP Amendment
#5 is an amendment of the Bayfront Specific Plan to allow new automobile
sales and accessory uses by Conditional Use Permit on the Inland Parcel.
The Inland Parcel is zoned for Industrial: General use and is within the
appeal jurisdiction on the City of Chula Vista's Post Certification Permit
and Appeal Jurisdiction map.
Coastal Act
Section Consistenc~ Analysis
Section 30212: At this time, development on the Inland Parcel is not
being proposed. LCP Amendment #5 is a modification to
the allowable uses on the site, but will not impact the
public access provisions that may be required when new
development is proposed.
Section 30213: The proposed amendment, which would allow automobile sales
and accessory uses by Conditional Use Permit within the
Inland Parcel, will not impact the ability to provide
lower cost visitor and recreational facilities because
the zoning on the site is Industrial: General and does
not include visitor serving facilities.
Section 30222: LCP Amendment #5 proposes to allow automobile sales and
accessory uses by Conditional Use Permit in an area zoned
Industrial: General. This proposed land use change will
not reduce the amount of private land suitable for visitor-
serving commercial recreational facilities or public
opportunities for coastal recreation.
Section 30231: The proposed amendment involves only an addition of
conditionally permitted land uses and will not adversely
impact biological productivity and the quality of coastal
waters, streams, wetlands, estuaries, and lakes.
Section 30250(a): The inland parcel is contiguous with existing development
on Broadway, C Street, and Fourth Avenue. So, new auto-
mobile sales or accessory uses within the inland parcel
would be consistent with the requirement that new develop-
ment should be contiguous with existing development.

A. Project Setting
In a letter dated December 9, 1987, National Avenue Associates requested
that the City of Chul a Vista Planning Commission consider an amendment to
the Chula Vista Bayfront Specific Plan. The letter proposed an amendment
which would add the following permitted uses in the Industrial:General
zone within the inland parcel: Automotive Sales, Rental and Delivery
Commercial Activities as defined in Section 19.82.21; Automotive Servicing
Commercial Activities as defined in Section 19.82.22; and Automotive
Repair and Cleaning Commercial Activities as defined in Section 19.82.23.
Following staff review of the proposed amendment, it was determined that
allowing the proposed additional uses by Conditional Use Permit would be a
preferred approach because it provides the opportunity to review specific
proposals on a case-by-case basis. In addition, two similar categories,
Boat Sales or Rental Commercial Activities as defined in Section 19.82.25
and Boat Servicing Commercial Activities as defined in Section 19.82.26,
are also included for consideration in the proposed LCP amendment.
B. Project Description
The proposed project entails the addition of the following language in the
Chula Vista Bayfront Specific Plan:

All lands within the inland parcel designated on Map l, Land Use Controls,
for Industrial: General Use, shall be permitted to accommodate the
following use classltlcat~ons pursuant to the Conditional Use Procedure at
Chapter 19.14:

The inland parcel is located east of Broadway and north of "C" Street.
Its precise configuration and location are shown on the grey area
indicated in Figure 1.
Amendment of the Bayfront Specific Plan as outline~ above would allow the
automotive and boat sales and related uses specified above within the
inland parcel by Conditional Use Permit. The Conditional Use Permit
approval would be according to the normal City procedures which are
detailed in Chapter 19.14.
C. Compatibility with Zoning and Plans
The proposed Specific P1 an Amendment would not change the existing
Specific Plan (zoning) or Land Use Plan designation for the inland
parcel. Both designations would remain Industrial: General, but specified
additional automotive and boat related uses would be allowed by ,'
Conditional Use Permit. The Conditional Use Permit process provides the
opportunity to review proposed projects on a case-by-case basis to ensure
that conditionally permitted uses would be compatible with adjacent land
uses. Automotive related uses appear to be a logical use at this location
because they would result in a southerly extension of the National City
car dealerships. Several of the uses that are permitted under the
Industrial: General land use category currently permit the sale of
automobile parts and accessories. The major new use that would be
permitted by Conditional Use Permit is the sale of motor vehicles and
boats. ~,
D. Identification of Environmental Effects
The potential environmental effect of allowing automobile and boat sales
and related uses within the inland parcel is that these uses may be
incompatible with the General and Limited Industrial Uses on adjacent
parcels.
E. Findings of Insignificant Impact
Based on the following circumstances, the potential environmental effects
were found to be less than significant:
- Each application for automobile'and boat sales or related uses will
require separate review under the Conditional Use Permit process.
This case-by-case review will enable City staff to identify any
potential land use conflicts resulting from incompatible adjacent
land uses. At that time, appropriate mitigation measures, if any,
can be required prior to issuance of a Conditional Use Permit.
- The project does not have a potential to degrade the quality of the
environment or curtail the diversity of the environment because the
proposed project is an amendment to the Bayfront Specific Plan which
would allow selected automotive and boat sales and related uses by
Conditional Use Permit. The specific uses proposed by an applicant
will be reviewed on a case-by-case basis to ensure that environmental
quality will not be degraded and that environmental diversity will
not be curtailed.

~ - The project does not have the potential to achieve short-term to the
disadvantage of long-term environmental goals. Because the proposed
project is a plan amendment that would allow additional land uses by
Conditional Use Permit, no such conflicts between the realization of
short-term vs. long-term environmental goals are anticipated.
The project does not have impacts which are individually limited, but
cumulatively considerable because allowing automotive and boat sales
~and related uses by CUP, only within the inland parcel would
minimize the potential for cumulative impacts. In addition, the
case-by-case review required by the CUP process would facilitate the
identification of any adverse cumulative impacts.
The project does not have environmental effects which will cause
substantial adverse effects on human beings, either directly or
indirectly because the proposed specific plan amendment will only-
allow additional, related land uses within the inland parcel by
Conditional Use Permit. It is unlikely that the proposed related
land uses will cause substantial adverse effects on human beings, but
each CUP application will be reviewed separately for potential
adverse effects on human beings.

RESOLUTION OF THE CITY OF CHULA VISTA PLANNING
COMMISSION RECOMMENDING TO THE CITY COUNCIL THE
ADOPTION OF AN AMENDMENT TO SECTION 19.84.13 OF
THE CHULA VISTA BAYFRONT LCP SPECIFIC PLAN
WNEREAS, the Planning Commission, on January 13, 1988, authorized
staff to proceed with a report and recommendation on a proposal by National
Avenue Associates to allow new car dealerships and accessory uses on the
property identified as the Inland Parcel in the Bayfront Specific Plan, and
WHEPEAS, the Inland Parcel is located on Broadway, between "C" Street
and State Route 54, and is zoned I-L and designated for General Industrial
development in the Bayfront Specific Plan which does not presently allow for
new car dealerships and accessory uses, and
WHEPEAS, the Planning Commission has amended the Land Use Chart to
allow new car dealerships and accessory uses by conditional use permit in the
I-L zone pursuant to Pesolution PCM-88-16A, and
WHEREAS, the property appears generally well suited to accommodate
new car dealerships in that there is substantial vacant acreage, frontage on
Broadway, a good relationship to the freeway and the National City Mile of
Cars, and little potential for conflict with surrounding uses, and
WNEPEAS, the Planning Commission set the time and place for a hearing
on said amendment and notice of said hearing, together with its purpose, was
given by its publication in a newspaper of general circulation in the city at
least ten days prior to the hearing, and
WHEREAS, the hearing was held at the time and place as advertised,
namely 7:00 p.m., March 9, 1988, in the Council Chambers, 276 Fourth Avenue,
before the Planning Commission and said hearing was thereafter closed, and
WHEREAS, the Commission found that the project would have no
significant environmental impacts and adopted the Negative Declaration issued
on IS-88-39.
NOW, THEREFORE, BF IT RESOLVED THAT FROM THF FACTS PRFS~NT~D AT THE
NEAPING, THE PLAN~I~IG COMMISSION recommends the adoption of amendments to
Title 19 of the Hunicipal Code as listed in Exhibit A attached hereto and made
a part hereof
That a copy of this resolution be transmitted to the City Council.

In a letter dated December 9, 1987, National Avenue Associates, one of the
property owners within the inland parcel, requested that the Planning
Commission consider an amendment to the Chula Vista Bayfront Specific Plan
which would allow automobile sales on the property zoned for Industrial
General use. Following staff review of the proposed amendment, it was
determined that allowing automobile sales and additional related uses by
Conditional Use Permit would be a preferred approach because it provides the
opportunity to review specific proposals on a case-by-case basis. In
addition, two similar categories, Boat Sales or Rental Commercial Activities
and Boat Servicing Commercial Activities are also included for consideration
in the proposed Local Coastal Program (LCP) amendment.
The six-week local review period for this amendment began on February 21, 1988
and will end at the close of this public hearing. Environmental review has
been completed and Negative Declaration IS-88-39 has been issued and is
attached as Exhibit A. If the proposed amendment is approved by the City
Council, it will be forwarded to the California Coastal Commission for review
and action.
RECOMMENDATION: That the City Council conduct a public hearing for
consideration of Amendment #5 to the certified Chula Vista LCP and:
1. Adopt the attached resolution which finds that proposed LCP Amendment
#5 will have no significant environmental impacts and adopt Negative
Declaration IS-88-39; and,
2. Approve Amendment #5 to the certified Chula Vista LCP and authorize
submittal of said amendment to the California Coastal Commission; and,
3. Adopt an ordinance amending the Chula Vista Bayfront Specific Plan in
accordance with LCP Amendment #5.

BOARDS/COMMISSIONS RECOMMENDATION: On March 9, 1988, the Planning
Commission conducted a public hearing and adopted a motion recommending that
the City Council adopt the proposed amendment in accordance with Resolution
PCM-BB-16B which is attached as Exhibit B.
DISCUSSION:
On January 13, 1988, the Planning Commission authorized staff to proceed with
a report and recommendation on the request by National Avenue Associates to
allow new car dealerships and accessory uses on the property banded by
Broadway, Fifth Avenue, "C" Street, and future eastbound State Route 54.
The property includes just over 35 acres. Approximately five acres, along the
C Street frontage between Broadway and Fifth Avenue, are developed with light
industrial and heavy commercial uses. The remaining 30 acres are vacant. The
portion of the property roughly west of an imaginary line halfway between
Broadway and Fifth Avenue is within the Coastal Zone and is zoned Industrial:
General; the portion of the property roughly east of an imaginary line halfway
between Broadway and Fifth Avenue is zoned I-L, Limited Industrial.
The property appears to be well suited to accommodate new car dealerships.
There is a substantial amount of undeveloped acreage with frontage on Broadway
with good visual access from the freeway. In addition, new car sales in this
area would be a logical extension of the National City Mile of Cars to the
north. The potential for land use conflicts does not appear to be significant
because the surrounding areas are zoned and developed with light industrial
and heavy commercial uses. Further, the Planning Commission has approved
staff's clarification of the land use chart by inserting language expressly
allowing new car dealerships and accessory uses by conditional use permit in
the I-L zone, which includes the portion of the property roughly east of Fifth
Avenue (that is not within the Coastal Zone) by Conditional Use Permit.
The proposed LCP Amendment, attached as Exhibit C, would allow new automobile
and boat sales and accessory uses listed in the amendment by Conditional Use
Permit within the Coastal Zone. This amendment would be consistent with the
amendment of the Land Use Chart by the Planning Commission because it would
allow new car and boat sales and related uses on the adjacent property roughly
west of an imaginary line halfway between Broadway and Fifth Avenue. The
properties east and west of the Coastal Zone boundary are under the same
ownerships.
