(Sab] CHULA VISTA CITY COUNCIL MEETING OF: June 3, 1975 Public Hearing - Consideration of the Deferral of Underground Requirements - Pacific Telephone & Telegraph ITEM TITLE: Company Site on Telegraph Canyon Road Resolution - Ordering the Deferral of Underground Requirements - Pacific Telephone & Telegraph Company Site at Telegraph Canyon Road '~/ INITIATED BY: Director of Public Works/City Engineer ~ IKV BACKGROUND: ~ `,\\J City Council, by Resolution #7729 on May 13, 1975, established June 3, 1975 as the date for a public hearing for the purpose of determining whether to defer the undergrounding of utilities along Telegraph Canyon Road fronting the new Pacific Telephone & Telegraph Company site. In accordance with Article I, Chapter 34 of the City Code, the Engineering Division is requiring as a condition of approval of tentative Parcel Map 14-74 that the overhead utilities adjacent to the southerly boundary be undergrounded. The tentative parcel map is dividing 1 parcel of land owned by E1 Rancho del Rey into 3 parcels. PT&T Co. is purchasing parcel 1 and 2 for their proposed electronic switching station on Telegraph Canyon Road. The southerly boundary of the tentative parcel map has approxi- mately 1520" of frontage along Telegraph Canyon Road. There is an existing 12 KVA overhead transmission line along 1360' of this frontage. At the present time there are no plans for development on parcel 3. Parcel 3 is the remaining portion of the original lot after the cut for the PT&T site. Approximately 920 lineal feet of overhead utilities lie adjacent to this parcel. The PT&T site (parcels 1 and 2) has 440 lineal feet of overhead utilities adjacent to its frontage along Telegraph Canyon Road. PT&T has requested that the requirement to underground overhead utilities adjacent to their site be waived. The cost of undergrounding these facilities has been estimated at $60,000 by SDG&E Company. This cost places additional financial burden upon the project. Department Head Recommendation: City Council defer the requirement of undergrounding existing electrical transmission lines along Telegraph Canyon Road adjacent to parcel 3 of tentative parcel map 14-74 and, the PT&T site. The resolution shall in- clude the requirement that PT&T shall enter into an agreement with the City stipulating that PT&T Company will underground the over- head utilities upon notice by the City. City Manager Recommendation: Concur Agenda Item No, Sab Supplemental page 2 The Planning Commission, at their meeting of April 23, 1975, granted a deferral to PT&T which deferred the construction of ultimate improvements on Telegraph Canyon Road adjacent to their site. Justifi- cation for the deferral was that the proposed alignment and grade of the ultimate improvements would not match the existing 42' travelway of Telegraph Canyon Road and that to construct the ultimate improvements would be premature and create a hazardous condition. The Engineering Division has developed an alignment and typical section for Telegraph Canyon Road within 126' of right of way. The exact location for underground utilities within this ultimate right of way has not been determined; however, the logical location for the utilities would be within the area outside of the travelway which is being reserved for sidewalk or bikeway and landscaping. To require the undergrounding of the utilities at this time would place the utilities within the 8' shoulder of the existing westbound lane of Telegraph Canyon Road. Utility companies prefer to place their underground facilities such as manholes and vaults outside of the travelway for reasons of safety when- ever they have to work on their facilities. There is approximately 2600 lineal feet of overhead utilities along Telegraph Canyon Road from Otay Lakes Road to several hundred feet west of the PT&T site. There are no overhead facilities from this last point westerly to 800' west of Brandywine Avenue, near the new Chula Vista Community Hospital. Telegraph Canyon Road is included in the scenic highway element of the Chula Vista General Plan. The City Council has in the past encouraged the undergrounding of all utilities for recent developments adjacent to Telegraph Canyon Road: 1. The City Council denied the Chula Vista Community Hospital's request to waive the requirement to underground the extension of electrical facilities along Telegraph Canyon Road west of Brandywine Avenue. 2. The developer of E1 Rancho del Rey Subdivision undergrounded overhead facilities crossing Telegraph Canyon Rd. adjacent to his subdivision boundary east and west of Buena Vista Way. be required to 3. The developer of Windsor Views Subdivision will/underground the extension of utilities along Telegraph Canyon Road to serve his development which lies approximately 1000' east of Brandywine Avenue. Section 34.104 of the City Code provides that the Council may defer the requirement of undergrounding existing utilities in a subdivision if the Council finds from the evidence presented at the public hearing that all of the following facts exist: 1. That extraordinary conditions exist to the extent that enforcement of this subsection would result in unnecessary hardship to the subdivider or the utility company. ~ ~ ~4~ Agenda Item No. Sab Supplemental page 3 2. That subject deferral will not, under the circumstances of the particular case, be detrimental to the health, safety or general welfare of the neighborhood. The Engineering staff recommends that: 1. The existing overhead utilities adjacent to parcel 3 not be undergrounded since there are no current plans for the development of this parcel. The undergrounding of these overhead utilities should occur at the time the owner applies for a building permit or submits a subdivision map to the City for this parcel. Undergrounding the utilities adjacent to parcel 3 would result in an unnecessary hardship to the owner of this parcel at the present time and a deferral to underground these overhead facilities would not be detrimental to the health, safety or general welfare of the neighborhood. 2. The overhead utilities adjacent to the PT&T site (parcels 1 and 2 of tentative parcel map 14-74) not be undergrounded for the following reasons: a. The undergrounding of utilities adjacent to the PT&T site would not substantially improve the appearance of the area although Telegraph Canyon Road is designated as a scenic highway. Undergrounding of approximately 440' of overhead utilities adjacent to the site would still leave a remaining balance of some 2160 lineal feet of overhead utilities from Otay Lakes Road westerly and there would still be several hundred feet of overhead utilities west of the PT&T site. Granting a deferral will not be detrimental to the health, safety or general welfare of the neighborhood. b. The undergrounding of the overhead utilities should occur with the realignment and construction of Telegraph Canyon Road to ultimate standards. c. The construction of the underground utilities would have to occur within the existing westbound lane of Telegraph Canyon Road which would create a hazardous situation to utility companies when they had to maintain their facilities. d. The $60,000 cost of undergrounding utilities would add additional financial burden to the project which PT&T considers as an unnecessary hardship at this time. PT&T will be undergrounding their facilities into the electronic switching station. As a condition of granting the deferral, PT&T Company will enter into an agreement whereby the City can require them to underground the existing overhead utilities upon notice by the City.
