Resolution - Waiving Section 1109 of the City Charter
Requiring Formal Bid Requirements and Authorizing
City Forces to Install Landscaping Along "H"
Street from I-5 Freeway to Bro way

In the 1972-73 Budget, the City Council approved the expenditure of
funds for the landscaping of "H" Street from 2-5 Freeway to Broadway.
The concept of the project at that time included the construction of
a center island median with landscaping.
Subsequently a report was made to the City Manager and accepted by the
City Council recommending against the installation of median islands
on "E", "H", and "L" Streets due to their negative impact on traffic
flow and on adjacent businesses. The City Council subsequently
directed the staff to develop an appropriate concept for landscaping
on "E", "H" and "L" Streets. Staff has completed a conceptual plan
for "H" Street from 2-5 Freeway to Broadway. The plan, which was
prepared by the Landscape Planner, calls for the non-uniform planting
of Mexican Fan Palms in and behind the sidewalk. See attached plat
for location of the proposed work.
The Landscape Planner has prepared cost estimates for the work, both
under contract and using City forces. The estimated cost under contract
is $47,500, while the estimated cost using City Forces is $20,600.
Therefore, a direct outlay savings of $26,900 can be made through use of
City forces.
A project of this size would normally be beyond the capability of the
City staff. However, the staff has been temporarily bolstered through
the CETA program. Therefore it is proposed that the City purchase

Financial Statement:
The unencumbered amount of $20,645 is available in Gas Tax Account
No. 28-6100-168.

Recommends that the City Council:
1. Approve the concept of landscaping as outlined in the report
by the Director of Public Works.
2. Authroize the expenditure of $20,600 for the purchase of
materials and rental of equipment to install the landscaping
on "H" Street from I-5 Freeway to Broadway.

plant and other materials and install landscaping along "H" Street
between I-5 Freeway and Broadway. Public Works personnel will be
used to perform the work.
Section 1109 of the City Charter requires that projects involving an
expenditure of $5,000 or more be done by contract awarded on the
basis of formal competitive bid. The Charter further provides that
City Council may except projects from sudh requirements when
recommended by the City Manager because the work may be performed
better or more economically by the City with its employees.
The necessary conditions are met in this instance to justify formal
waiver of bidding requirements and authorization to utilize City
forces.
The Director of Public Works will make an oral presentation at the
Council meeting. Displays will be available at the meeting
depicting the proposed landscaping scheme.
