item Title: RESOLUTION Amending Resolution No. 7634 Determining and Declaring
the Public Necessity of Acquiring Certain Right of Way for Public Street
Purposes for an Unnamed Off site Access Road, and Authorizing the Commencement
of Condemnation Proceedings to Acquire Said Right of Way

Background:
Council, by prior action, has authorized the prosecution of an action in
eminent domain by a private counsel to acquire, on behalf of the City, a
right-of-way to the Windsor Views Subdivision. At the time of Council's
Resolution of Intention to condemn certain property owned by Otay Land
Company for public right-of-way and street purposes, a certain alignment
and configuration of the public right-of-way had been determined and
planned by the Engineering Department. Since that time, the Engineering
Department, in consort with the developer, Mr. Dale Horton, have arrived
at a slightly different configuration for the proposed street which will
first serve the needs of the City of Chula Vista and, secondly, provide
access to Mr. Norton's development, Windsor Views.
The amendment to the Resolution of Intention shows the new alignment
and area to be acquired through eminent domain as a public right-of-way.
