HomeMy WebLinkAboutReso 1988-13438 RESOLUTION NO. 13438 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING A LIST OF MEDIATORS FOR MOBILEHOME PARK SPACE RENT MEDIATION PURSUANT TO CITY MUNICIPAL CODE SECTION 9.50 The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City has an existing Municipal Code Section 9.50 addressing Mobilehome Park Space Rent Mediation; and, WHEREAS, the Municipal Code Section calls for the City Council to supply a list of mediators with background in accounting, business ownership and/or economics; and, WHEREAS, the City Council recognizes that there exists a need for such a list due to the fact that two parks may soon be entering the mediation process; and, WHEREAS, a list of mediators for Mobilehome Parks Space Rent disputes is attached hereto and incorporated herein as though fully set forth. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista hereby approves that said list of mediators for Mobilehome Park Space Rent disputes as called for in City of Chula Vista Municipal Code Section 9.50, Mobilehome Park Space Rent Mediation. Verne Decker 7. A.Y. Casillas ATTACHMENT NAME BACKGROUND 1. Pat{y Davis Currently Assistant Branch Manager at Col dwell Banker, Residential Real Estate Services in Chula Vista. She is the Treasurer of the South San Diego Bay Cities Board of Realtors. She has also handled a real estate trust account and a property management trust account. She has been in business for herself as a real estate agent and broker since 1979. She has an A.A. Degree in Real Estate. 2. William Cannon Attorney. He has owned and operated a law office for 15 years. He has taken several accounting courses, and deals with accounting problems as part of his law practice. He is a Superior Court Arbitrator. 3. Lupe Jimenez She is a bilingual elementary school teacher in the Chula Vista Elementary School District. She has taken a number of college level accounting and economic courses. She was involved in starting a new retail business. She was a member of the Grievance Committee with the Teacher's Union which helped resolve contract problems between teachers and administrators. A1 so, she is a member of the County Commission to study San Diego County border -. problems, and a member of the Chula Vista Civil Service Commission. 4. Robert Gordon Attorney. As legal counsel for Fed Mart, he was involved in negotiating various contracts, and in negotiating and preparing leases for retail tenants. He has acted as arbitrator involving various legal disputes. He is a professor at Cabrillo Pacific Law School, National University, and Western Sierra Law School. 5. Frank Scott Former Mayor and Councilman; stock and securities broker; community activist. 6. Verne Decker Systems Engineering Analyst, Project coordinator, conducts employee cost analysis, M.S. in Systems Management. Previously an Assistant Finance Officer and Assistant Contracting Officer in the military. WPC 3376H NAME BACKGROUND 7. A.Y. Casillas Retired aerospace executive; business systems analysis; set-up management information systems; consultant to small businesses including assisting them in setting up a business and setting up an accounting system; Director of National Alliance of Business; as administrator of business systems developing group he mediated conflict between executives. ATTACHMENT January 5, 1988 As you may be aware, the Chula Vista City Council is developing a list of mediators to mediate space rent increase disputes at Mobilehome Parks as called for in City Municipal Code Section 9.50, Mobilehome Park Space Rent Mediation. Your name has been suggested by one of the City Councilmembers as a potential candidate for this list. Mediation is the second part of a two part process outlined in Municipal Code Section 9.50. In the first part of the process, residents circulate a petition requesting negotiation, and must collect signatures from over 50% of the park's spaces affected by the rent increase dispute. An in-park negotiation commission is then formed, consisting of two park owner representatives, two park resident representatives and a neutral fifth member unanimously selected by the other four members from a list created by the Mobilehome Issues Committee. If the negotiation commission is unable to resolve the space rent dispute, then either the residents or park owner can elect to go onto the next step, mediation by a neutral three-member mediation commission. The park owner and park residents each select one mediator, and the two mediators unanimously select a third. All three are chosen from a list of mediators which is created by the city Council. The mediators have the delicate task of collecting and reviewing information concerning the rent increase and proposing a compromise that would be equitable to both the park residents and the park owner. As the disputes to be mediated occur between businesses rightfully seeking fair investment return and operational solvency and homeowners often struggling to sustain residency in a permanent dwelling environment, this process is gravely important. No specific financial compensation is stipulated by the Municipal Code for mediation services; compensation is left to negotiation between the parties. As the homeowners are January 5, 1988 Page Two often of low income and/or fixed income, free services, or compensation for costs incurred only, are encouraged. The Municipal code Section specifies that mediators must have backgrounds in accounting, business ownership and/or economics. Also, experience in mediation or the resolution of conflicts is helpful and should be highlighted in your response. Please take a few moments to fill out the questionnaire and return it in the enclosed envelope on or before January 25, 1988. If you wish to submit any additional information such as a resume, please enclose it with the questionnaire.
