BACKGROUND:
Several months ago Council determined that the two city owned properties in the
northwest and southwest corners of the intersection of East Palomar Street (extended)
and Oleander Avenue (extended) were unsuitable for park use because of their small
size, topography and isolation from the existing Greg Rogers Park. The properties
have recently been sold to American Housing Guild, the owner of the property adjacent
on the west. It is appropriate to amend the General Plan to reflect Council's decision
in this area.
For Council's information a copy of the April 16, 1975 staff report to the Planning
Commission is attached.

Financial Statement:
Commission-Board Recommendation: On April 16, 1975 the Pldnning Commission by a 5-0
vote adopted a resolution recommending that the City Council:
1) Find that in accordance with the attached Negative Declaration and the findings
therein that GPA-75-3 will not have any possible significant impact on the environment
and certify that the Negative Declaration has been prepared in accordance with the
California Environmental Quality Act of 1970 as amended.
2) Amend the General Plan to change the designation of 8 acres located in the western
quadrants of the future intersection of East Palomar and Oleander Avenue from Park
and Public Open Space to Medium Density Residential (4-12 DU/Ac.).

A. PROPOSAL
This item involves a change in the Genera': Plan designation for approximately
8 acres of vacant property located at the northwest and southwest corners of
the futur°e intersection of East Palomar Street and Oleander Avenue from Parks
and Public Open Space to Medium Density Residential (4-12 DU/Ac).
B. BACKGROUfJD
1. The above-mentioned property was designated Medium Residential (4-7 DU/Ac)
at tf~e time the General Plan was originally adopted by the City Council on
September 22, 1964.
2. On December 15, 1970, the City Council amended the General Plan in
Resolution 5878 designating the property as "Parks and Public Open Space."
C. ENVIRONMENTAL REVIEbJ
The subject properties were evaluated for environmental impact in conjunction
with the submission of Zenith III and IV tentative mans. Initial Studies
(IS-74-48, Zenith III; IS-75-15, Zenith IV) of possible adverse environmental
impacts of Zenith III and IV were conducted by the Environmental Re vieev Com-
mittee on October 10, 1974 and March 6, 1975 respectively. The ERC concluded
that there vrould be no significant effects and made a PJegative Declaration for
IS-74-48 and recommended a ilegative Declaration for IS-75-15.

South - Parks and Public Open Space

2. Adjacent zoning and land use:
North - R-1 Vacant
South - R-1 Vacant

3. The General Plan currently designates this property as "Parks and
Public Open Space." However, in recent months Council has determined that
the properties in both the northwest and south~aest corners of the inter-
section of Palora~r Street and Oleander Avenue (extended) are not readily

usable for park purposes because of their small size, topographic character
and isolation from Greg Rogers Park by future streets. Accordingly, Council
solicited bids on the properties. American Housing Guild, the ormer of the
property adjacent on the r-;est, ufas the only bidder. American Ilousiny Guild
now owns ti~a northerly 4+ acre property and is now in escrow for the pur-
chase of the southerly 3+ acre property.
E. RECOi''1EP~DATIOfI
1. Find that in accordance with the attached Plegative Declaration and the
findings therein that GPA-75-3 will not have any possible significant impact
on the environment and certify that the Negative Declaration has been pre-
pared in accordance with the California Environmental Quality Act of 1970
as amended.
2. Adopt a motion recommending to the City Council that the Gene.°al Plan
be amended from Parks and Public Open Space to Medium Density Residential
(4-12 DU/Ac) for approximately 8 acres located in the western quadrants of
the future intersection of East Palomar Street and Oleander Avenue as shown
on GPA-75-3, Exhibit A.

RESOLUTION OF 7HE CITY PLANNING COMMISSION RECOMMENDING TO THE ~ ~~~
CITY COUNCIL A REVISION OF THE GENERAL PLAN FOR APPROXIMATELY
8 ACRES LOCATED AT THE NORTHWEST AND SOUTHWEST CORNERS OF THE
FUTURE INTERSECTION OF EAST PALOMAR STREET AND OLEANDER AVENUES
WHEREAS, the City of Chula Vista has an adopted General Plan, and
WHEREAS, State law requires that zone designations of property conform to
the General Plan, and
WHEREAS, the City Planning Commission determined the hecessity of
considering a revision to the General Plan for approximately 8 acres located
at the northwest and southwest corners of the future intersection of East
Palomar Street and Oleander Avenues from Parks and Public Open Space to Medium
Density Residential, and
WHEREAS, the Planning Commission set the time and place for a hearing to
consider said revision to the General Plan, and notice of said hearing, together
with its purpose, was given by the publication in a newspaper of general circula-
tion in the City at least ten days prior to the date of said hearing, and
WHEREAS, a hearing was held at said time and place, namely 7:00 p.m.,
April 16, 1975, Council Chamber, City Hall, before the Planning Commission, and
said hearing was thereafter closed, and
WHEREAS, the Planning Commission found that in accordance with Negative
Declarations issued on October 10, 1974 and March 6, 1975, development of the
property for medium density residential use would not have any possible significant
impact on the environment, and the Commission certified that the Negative Declara-
tions were prepared in accordance with CEQA 1970, as amended.
NOW THEREFORE BE IT RESOLVED AS FOLLOWS:
1. From facts presented to the Commission, the Commission finds that
public necessity, convenience, general Welfare and good planning practice require
a revision to the General Plan for approximately 8 acres located at the northwest
and southwest corners of the future intersection of East Palomar and Oleander
Avenues from Parks and Public Open Space to Medium Density Residential.
2. The findings of fact in support of said determination are as follows:
a. In recent months the City Council has determined that these
properties are not readily usable for park purposes because of their
small size, topographic character and isolatiern from Greg Rogers Park
by future streets.
3. The Planning Commission recommends to the City Council that said
revision to the General Plan be adopted.
4. That this resolution be transmitted to the Caty Council.

this 16th day of April, 1975, by the following vote, to-wit:
