[4ab ] CHULA VISTA CITY COUNCIL MEETING OF: Mdy 20, 1975 Public hearing - Consideration of amendment to General Plan for approxi- mately 2.36 acres located at the northeast corner of Third Avenue and ITEM TITLE: E Street; from Thoroughfare Commercial to Retail Commercial, GPA-75-1 Resolution - Amending the General Plan for approximately 2.36 acres located at th° northeast corner of Third A~~en~!e and E Street from Thoroughfare Commercial to Retail Commercial INITIATED BY: Director of Planning BACKGROUND: The properties in question were the subject of two recent rezonings from C-T and C-0 to C-C and C-C-P. In both cases the Council found that the C-C zone afforded greater protection to neighboring residential land uses while, at the same time, permitting a full range of retail commercial activities suitable for location on "E" Street. It is now appropriate to amend the General Plan to reflect Council's decision for this area. For Council's information, a copy of the April 16, 1975 staff report to the Planning Commission is attached. PROPOSAL This item involves a change in the General Plan designation for approximately 2.36 acres located at the northeast corner of Third Avenue and "E" Street from Thoroughfare Commercial to Retail Commercial. B. BACKGROUND The properties in question were the subject of two recent rezonings: (1) PCZ-74-L (November, 1974) rezoning the easterly .36 acres from C-0 to C-C-P and, (2) PCZ-74-IV (January, 1975) rezoning the westerly 2 acres firom C-T to C-C, In both cases, the Council found that the C-C zone was moi,e appropriate than either the C-T or C-0 zones in protecting neighboring residential land uses vahile, at the same time, permitting a full range of retail commercial activities on E Street. C. EP;I~IRONMENTAL REI,~IE,-J The subject properties were evaluated for environmental impact in conjunction with the aforementioned rezoning. The Environmental Review: Coordinator Eras found that PCZ-74-L is categorically exempt from any environment-~1 review renuirements as a Class 5 exemption. An Initial Study (IS-74-53) of possible adverse environmental impacts of PCZ-74-N WdS conducted by the Environmental Review Committee on November 27,,1974. The ERC concluded that there would be no significant effects and made a Negative Declaration. No appeal of the Negative Declaration was made and it became final on December 12, 1974. D. The subject properties are currently zoned C-C and the "Retail Connner- cial" General Plan designation more closely conforms to this zoning than does the existing "Thor°oughf are Commercial"designation. 4. Retail Commercial uses in this location vrill afford greater protection for surrounding neighborhood residential land uses while, at the same time, permitting a full range of retail commercial activities suitable for location on "E" Street. E. RECOMMENDATION 1. Find that in accordance o-rith the attached Negative Declaration and the findings therein that GPA-75-1 will not have any passible significant impact on the environment and certify that the fegative Declaration has been pre- pared in accordance with tfre California Environmental Quality Act of 1970 as amended. 2. GPA-75-1 ~ LP~(i~D~~ RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL A REVISION OF THE GENERAL PLAN FOR 2.36 ACRES LOCATED AT THE NORTHEAST CORNER OF THIRD r9VENUE AND "E" STREET WHEREAS, the City of Chula Vista has an adopted General Plan, and WHEREAS, State law requires that zone designations of property conform to the General Plan, and WHEREAS, the City Planning Commission determined the necessity of considering a revision to the General Plan for approximately 2.36 acres located at the northeast corner of Third Avenue and E Street from Thoroughfare Commercial to Retail Commercial, and tdHEREAS, the Planning Commission set the time and place for a hearing to consider said amendment to the General Plan, and notice of said hearing, together with its purpose, was given by the publication in a newspaper of general circula- tion in the City at least ten days prior to the date of said hearing, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m., April 16, 1975, Council Chamber, City Hall, before the Planning Commission, and said hearing was thereafter closed, and WHEREAS, the Planning Commission found that in accordance with the attached Negative Declaration and the findings therein, the proposed revision from Thoroughfare Commercial to Retail Commercial would not have any possible significant impact on the environment, and the Commission certified that the Negative Declara- tion was prepared in accordance with CEQA 1970, as amended. NOW THEREFORE BE IT RESOLVED AS FOLLOWS: 1. From facts presented to the Commission, the Commission finds that public necessity, convenience, general welfare and good planning practice require a revision to the General Plan for 2.36 acres located at the northeast corner of Third Avenue and E Street from Thoroughfare Commercial to Retail Commercial. 2. The findings of fact in support of said determination are as follows: a. Retail Commercial uses in this location will afford greater protection for surrounding neighborhood residential land uses, while at the same time, permitting a full range of retail commercial activities suitable for location on E Street. b. The subject properties are currently zoned C-C which more closely conforms to the Retail Commercial designation than to the Thoroughfare Commercial designation. 3. The Planning Conunission recommends to the City Council that said revision to the General Plan be adopted. 4.
