RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA, APPROVING AGREEMENT BETWEEN THE CITY OF CHULA
VISTA AND JOSEPH C. PEARSON FOR LEASE OF SENIOR
CITIZENS OFFICE AT 293 MADRONA STREET IN THE CITY OF
CHULA VISTA
AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED that that certain agreement
between THE CITY OF CHULA VISTA, a municipal corporation, and
JOSEPH C. PEARSON, for lease of Senior Citizens Office at 293 Madrona
Street in the City of Chula Vista,
dated the 19 th day of June 1975 a copy of
which is attached hereto and incorporated herein, the same as though
fully set forth herein be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula
Vista be, and he is hereby authorized and directed to execute said
agreement for and on behalf of the City of Chula Vista.

First and last months rent due on commencement of this lease in the
amount of Four Hundred Fifty dollars ($450.00) and Two Hundred Twent-
Five ($225,00) due on the 1st of each month thereafter.

California, or at such other place as may be designated by the lessor.
IN ADDITION THERETO IT IS HEREBY AGREED AS FOLLOWS, TO WIT:
First: That the lessee shall pay the lessor said rent in the manner hereinbefore specified, and shall not let or
underlet the whole or any part of said premises, nor sell or assign this lease, either voluntarily or by operation of law,
nor allow said property to be occupied by anyone contrary to the terms hereof, without.the written consent of the lessor;
Second: Thal should said rent be not paid when due or should the lessee default in any of the covenants or
conditions contained herein, the lessor, or his representative or agent, may re-enter said premises and remove all
persons therefrom;
Third: That the lessee shall occupy said demised premises and shall keels the same in good condition, including
such improvements as may be made thereon hereafter, the usuol wear and tear and damage by the elements excepted,
and shall not make any alterations thereon without the written consent of the lessor and shall not commit or suffer to be
committed any waste upon said premises;
Fourth: That said premises shall not be used by the lessee, nor anyone else, during the term hereof or any exten-
sion thereof, for the sale of any intoxicating liquors, nor for any illegal or immoral purpose, and that possession of sold
premises by the lessee or his successors or assigns shall not be construed as conveying any title thereto or ownership
(hereof;
Fifth: That all Governmental laws and ordinances shall be complied with by the lessee;

Sixth: That the lessee waives all rights under Section 1942 0l the Civil Code of California and releases the lessor
Irom any and all 'damages which may be sustained by the lessee or any other party during the time he may be in
possession of said premises;
Seventh: Thal should the occupancy of said premises, by the lessee, cause the present fire andliobility insurance
rates applicable thereto to be increased, the lessee shall pay the difference upon the arnounf of fire and liability insur-
ance now being carried by the lessor and said difference shall be in addition fo the amount of rental specified herein
and shall be paid to the lessor upon demand;
Eighth: That should the lessor be compelled fo commence or sustain an action of law to collect said rent or parts
thereof or to dispossess the lessee or to recover possession of said premises, the lessee shall pay all costs in connection
therewith including a reasonable fee for the attorney of the lessor;
Ninth: That the waiver, by the lessor, of any covenant or condition herein contained shall not vitiate the same or
any other covenant or condition contained herein and Thal the terms and conditions contained herein shall apply to and
bind the heirs, successors and assigns of the respective parties hereto;
Tenth: Thal should the lessee occupy said premises after the expiration date of Ihis lease, with the consent of the
lessor, expressed or implied such possession shall be construed to be a tenancy from month to month and said lessee

may remain in possession thereof;
Eleventh: That said premises shall not be used by the lessee during the term of this lease for other than

Twelfth: That of the expiration of said term or the sooner determination thereof, the lessee shall peacefully quit
and surrender possession of said premises in as good condition as reasonable use and wear thereof will permit;
Thirteenth: That- ^II words used herein in the singular number shall include the plural and the present tense shall
include the future and the masculine gender shall include the feminine and neuter.
Fourteenth: Lessee agrees to pay Gas & Electric.
Fifteenth: Lessor agrees to pay water bills.
Sixteenth: Lessor acknowledses receipt of an additional sum of One
Hundred Dollars ($100.00) to be held as a security deposit.
Seventeenth.: Lessee understands that this is a sub-lease. Lessee
has received a copy of the master lease and agrees to
operate by the terms of it.
IN WITNESS WHEREOF, the lessor and the lessee have executed this indenture as of the day and year first
above written.
