RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA AMENDING RULE IX, SECTION 3, OF THE CIVIL
SERVICE RULES RELATING TO SICKNESS AND DEATH LEAVE
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the City Council has heretofore entered into
certain Memoranda of Understanding with various employee groups
in the City of Chula Vista resulting in modifications to Rule IX,
Section 3, of the Civil Service Rules of the City of Chula Vista
relating to sickness and death leave, and
WHEREAS, it is now necessary to amend said rule to con-
form with the terms and provisions of said E4emoranda of Under-
standing.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Chula Vista that Rule IX, Section 3, of the Civil
Service Rules of the City of Chula Vista be, and the same is
hereby amended as shown in Exhibit "A", attached hereto and
incorporated herein by reference as if set forth in full.

in the manner set forth in subsection (b), provided that such L'VNIDIT
employee shall have worked at least 180 days in the preceding ~,/~
year before he shall become eligible for such vacation. To A
receive vacation for intermittent service, the employee must L
work for the City during the year in which vacation is due, and
while so working must submit the proper request for vacation to
the department or departments in which it was earned. Accumulative
vacation privileges shall not be allowed for intermittent service.
SECTION 3. SICKNESS AND DEATH LEAVE
The objective of this section is to provide orderly methods of furthering
the health and safety of City government employees and aiding employees to
do better work. Sick leave, under this rule, is not a right which an
employee can use at his discretion, but a privilege which can be allowed
only in case of necessity and actual sickness or injury or serious illness
of immediate family members which compel an employee to be absent from work.
(a) Computation of Sick Leave: Sick leave with pay is cumulative at
the rate of 3.68 (fire suppression personnel 5.52) working hours
for each biweekly pay period of service, twelve days annually,
beginning at the time of full-time probationary employment. A
person who has held a position with temporary or interim status
and is appointed to a position with probationary status, without
a break in service, may have such time credlted to sick leave
upon the recommendation of the department head and Director of
Personnel and the approval of the City Manager.
(1) Unused sick leave may be accumulated in an unlimited amount.
(2) The smallest unit of time chargeable for sick leave benefits
is one hour.
(3) Absence for illness may not be charged to sick leave not
already accumulated.
(4) Sick leave reimbursement:
a. Employees using four (4) days of sick leave, or less,
during the fiscal year, shall have the option of convert-
ing twenty-flue percent (25%) of their remaining yearly
sick leave to pay. If the pay option is not selected,
all remaining yearly sick leave shall be carried over
and accumulated.
b. Pay shall be computed based on the following schedule and
all computations shall be rounded to the nearest whole hour:

(Example: Employee has 11 days, 5 hours remaining yearly
sick leave; therefore, 93 hours x .25 ~ 23.25 hours ~ 23
hours of pay).
c. If the pay option is selected, the paid sick leave hours
shall be subtracted from the employees accumulated
yearly sick leave balance. The remaining sick leave
hours shall be carried over and accumulated. (Example:
Employee uses 4 days sick leave. He then elects to
receive pay for 25% of remaining days, or 2 days. The
2 days are subtracted from his remaining yearly sick
leave and the other 6 days are added to the employee's
accumulated sick leave balance).
d. Payment will be made during the month of July of each
year. Pay will be computed based on the employees salary
step on June 30.
e. Payment will be made to an employee hired during the
fiscal year provided he is on the payroll June 30.
Permanent employees who retire during the fiscal year
will be compensated under this plan based on their
formal retirement date. Payment will not be made to an
employee who terminates during the fiscal year. How-
ever, in the event of the death of an individual while
employed by the City, 50% of the employee's unused
accumulated sick leave will be paid to his beneficiary.
f. Classifications eligible to participate in this program
include all those within the classified service except:

Service.
pl. Employees in the classification of Battalion Chief on a 60-hour
workweek using 48 hours of sick leave, or less, during the
fiscal year, shall have the option of converting, twenty-five
percent (25%) of their remaining yearly sick leave to pay.
If the pay option is not selected, all remaining yearly sick
leave shall be carried over and accumulated.
Said employees on a 40-hour workweek will be subject to
the same sick leave reimbursement plan as provided for
miscellaneous employees.

Pay shall be computed based on the following schedule and all computations

This benefit becomes effective July 1, 1973; however, payment made for the
period from July 1, 1973 to June 30, 1974, during July 1974, will be computed
at one-half ('~) the normal entitlement, or 12.5%. Thereafter, such benefit
will be on a basis equal to the 25% factor utilized regarding regular miscel-
laneous employees.

(b) Request for Sick Leave: In order to be allowed sick leave with
pay, an employee should notify his supervisor not later than
four (4) hours after the time set for beginning hie daily duitea.
A doctor's certificate or a personal affidavit showing the
nature of and cause of sickness or injury must be furnished
to the employee's immediate supervisor, for file in the
employee's personnel jacket, upon return from an absence
necessitating the use of more than four (4) working days
of sick leave. A doctor's certificate or personal affidavit
must also be presented by the employee before returning to
work to his immediate supervisor in all cases when the
employee has been exposed to a contagious disease and for
all office visits for medical or dental treatment.
