HomeMy WebLinkAboutReso 1975-7773RESOLUTION N0. 7773 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THAT CERTAIN P~fEMORANDUM OF UNDER- STANDING CONCERNING 69AGES AND OTHER TERP15 AND CONDITIONS OF EMPLOYMENT BETWEEN THE CITY OF CHULA VISTA AND THE CHULA VISTA POLICE RELIEF ASSOCIATION FOR FISCAL YEAR 1975-76 The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Management Negotiation Team representing the City Manager of the City of Chula Vista, acting for and on behalf of the City Council of the City of Chula Vista, have heretofore met and conferred with the Chula Vista Police Relief Association, an organization representing sworn members of the Chula Vista Police Department from Peace Officer up through the rank of Police Lieute- nant, in accordance with the provisions of Section 3500 et seq. of the Government Code of the State of California, and WHEREAS, the Memorandum of Understanding jointly prepared by said parties as a result of meeting and conferring has been presented to the City Council and is contained in Exhibit "A", attached hereto and incorporated herein by reference as if set forth in full. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve and accept said Memo- randum of Understanding as contained in Exhibit "A" for fiscal year 1975-76. DATED City Cler MEMORANDUM OF UNDERSTANDING CONCERNING WAGES AND OTHER TERMS AND CONDITIONS OF EMPLOYMENT BETWEEN THE CITY OF CHULA VISTA AND THE CHULA VISTA POLICE RELIEF ASSOCIATION FOR FISCAL YEAR 1975-76 (July 1, 1975 - June 30, 1976) WHEREAS, the representatives of the City Manager of the City of Chula Vista, acting for and on behalf of the City Council of the City of Chula Vista, have heretofore met and conferred with the Chula Vista Police Relief Association, an organization representing sworn members of the Chula Vista Police Depart- ment from Peace Officer up through the rank of Police Lieutenant, in accordance with the provisions of Section 3500 et seq. of the Government Code of the State of California. WHEREAS, as a result of meeting and conferring in good faith with said group, agreement has been reached on the following terms and conditions of employment as applied to those sworn employees who are members of and represented by the Chula Vista Police Relief Association, and said representatives of the City Manager and of the Chula Vista Police Relief Association do now jointly prepare a written Memorandum of Understanding concerning said agreed terms and conditions of employment for presentation to the City Council of the City of Chula Vista for determination, to wit: I. Wages A. Effective July 1, 1975, a seven and one-half percent (7-1/2%) salary increase shall be granted for the classifications of Peace Officer through Lieutenant. B. Effective January 1, 1976, a two and one-half percent (2-1/2%) salary increase shall be granted for the classifications of Peace Officer through Lieutenant. C. The classification of Peace Officer shall be subject to a seven (7) step salary range. The additional two steps shall be added to the lower level of the established range. Step "1" shall be 10;0 less than "A" step and step "2" shall be 5% less than "A" step. The normal hire rate shall be step "1" provided, however, that an exceptionally well qualified candidate may be hired within the established range based upon the recommendation of the appointing authority and the Director of Personnel and the approval of the City Manager. D. Peace Officers will be eligible for advancement within the established salary range as follows: Upon recommendation of the Chief of Police, the Director of Personnel and with the approval of the City Manager, to advance to Step "2" after six months at Step "1", to advance to Step "A" after six months at Step "2", to Step "B" after six months at Step "A", to Step "C" after six months at Step "B", to Step "D" after twelve months at Step "C", and to Step "E" after twelve months at Step "D". !~. -r9Z II. Education Incentive Pay The Education Incentive Program in effect on June 30, 1975, shall con- tinue only for those sworn officers employed on or before June 30, 1975, which is as follows: Base Salary Base Salary Plus 2-1/2% Plus 5% PEACE OFFICER AA BA/BS AGENT AA BA/BS SERGEANT BA/BS -- LIEUTENANT MASTERS -- Those officers employed or reemployed on or after July 1, 1975, shall not be eligible to receive Education Incentive Pay. III. Sick Leave Reimbursement The City of Chula Vista will provide sick leave reimbursement for sworn members of the Police Department for the classifications of Peace Officer through Lieutenant as follows: Twenty-five percent (25%) payment for up to 120 days of unused sick leave will be made upon honorable separation. Accumulation of sick leave subject to pay will commence January 1, 1970. All sick leave accrued prior to January 1, 1970, will remain on the Officers sick leave balance and may be used as necessary. IV. Long Term Disability Insurance The City will pay the entire cost of an improved PORAC Long Term Disability Insurance coverage as follows: Maximum amount of monthly benefits shall increase to $1,000. V. Continuation of Existing Benefits It is further understood and agreed that any other benefits and working conditions and the terms and conditions thereof presently in effect shall remain unchanged (except for amendments to the Civil Service Rules which liberalize employee benefits) unless and until said terms and conditions shall be modified as a result of meeting and conferring in good faith between the City and the Chula Vista Police Relief Association, pursuant to the provisions of Section 3500 of the Government Code of the State of California. 0 ~1~1~1 ~ VI. Savings Clause If any provision of this agreement, or the application of such pro- vision, should be rendered or declared invalid by any court action or by reason of any existing or subsequently enacted legislation, the remaining parts or portions of this agreement shall remain in full force and effect. j~~~%~".'ccG~ Richard D.
