RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA FIPdDING THAT THE INSTALLATION OF LANDSCAPING
ALONG "H" STREET FROM I-5 FREE[VAY TO BROADWAY IN
THE CITY OF CHULA VISTA BE, AND THE SAP~IE IS HEREBY
EXCEPTED FROM TIIE REQUIREI~NTS OF SECTION 1109 OF
THE CHARTER OF THE CITY OF CHULA VISTA AND THAT
COMPETITIVE BIDDING FOR THE ACQUISITION OF PIATERIALS
AND EQUIPMENT AND SERVICES FOR THE COMPLETION OF
SAID PROJECT IS IMPRACTICAL AND THAT SAID WORK MAY
BE PERFORMED bIORE ECONOPdICALLY BY CITY [dORK FORCES
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, in the 1972-73 budget, the City Council approved
the expenditure of funds for the landscaping of "H" Street from
I-5 Freeway to Broadway and the concept of the project at that
time included the construction of a center island median with
landscaping, and
WHEREAS, subsequently a report was made to the City Man-
ager and accepted by the City Council, recommending against the
installation of median islands on "E", "H", and "L" Streets due
to their negative impact on traffic flow and on adjacent busi-
nesses, and
[WHEREAS, the City Council directed the staff to develop
an appropriate concept for landscaping on "E", "H" and "L" Streets
and staff has now completed a conceptual plan £or "H" Street from
I-5 Freeway to Broadway, and
WHEREAS, said plan, which was prepared by the Landscape
Planner, calls for the non-uniform planting of Mexican Fan Paims
in and behind the sidewalk, and
[dHEREAS, the Landscape Planner has prepared cost esti-
mates for the work, both under contract and using City forces,
and through contract labor the estimated cost is $47,500, while
the estimated cost using City forces is $20,600, and
WHEREAS, it is recommended that said project be accom-
plished by City work forces as clearly being more economical
and susceptible to greater control in the performance of the
work by City work forces, and
G7HEREAS, the City Manager having reviewed the recommen-
dations of the several departments involved and the project to
be accomplished in accordance with said recommendations has here-
tofore recommended to the City Council in accordance with Section
1109 of the City Charter, that said work can be performed better
and more economically by the City with its own employees.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Chula Vista that the concept of landscaping along "H"
Street from I-5 Freeway to Broadway, as outlined in the report
by the Director of Public Works be, and the same is hereby approved.

BE IT FURTHER RESOLVED by the City Council of the City
of Chula Vista that based upon the facts set forth hereinabove
and the recommendation of the City Manager of the City of Chula
Vista that the requirements in Section 1109 of the City Charter
be, and the same are hereby waived and the project as indicated
hereinabove be accomplished by the appropriate City forces and
that competitive bidding requirements be waived for the acquisi-
tion of necessary materials and equipment which may be purchased
in the open market.
BE IT FURTHER RESOLVED that the sum of $20,600 be, and
the same is hereby authorized to be expended from Gas Tax Account
P~Io. 28-6100-168 for the purchase of materials and rental of equip-
ment to install the landscaping on "II" Street from I-5 Freeway
to Broadway.
BE IT FURTHER RESOLVED that said resolution may be adopted
by the affirmative vote of at least four members of the City Coun-
cil of the City of Chula Vista.
