RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA URGING THE LEAGUE OF CALIFORNIA CITIES TO
SPONSOR AND SUPPORT LEGISLATION BANNING THE SALE
OF PULL-TOP CANS OR NONRETURNABLE BEVERAGE CONTAINERS
OF ANY KIND
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the City of Chula Vista several years ago took
the initiative in encouraging the elimination of nonreturnable
beverage containers through a program of education and active sup-
port of affected members of the local business community, and
WHEREAS, it was recognized when this program was undertaken
that it could not in fact be effective in a single isolated area, but
would require regional or statewide legislation, and
WHEREAS, the experience of those states who simply increased
deposit requirements to encourage the use of returnable containers has
been of little more effect than the educational process instituted by
Chula Vista, and
WHEREAS, it is now totally apparent that the continued use
of nonreturnable containers as well as the use of pull-top cans cre-
ates a growing litter problem which impinges upon the rights and
liberties of all of our citizens as well ad compounding the fully
acknowledged energy and resource problems created thereby, and
WHEREAS, the simplistic approach of all of the beverage
industry and their distributors by resorting to the nonreturnable
containers can simply no longer be tolerated in a rational society
that wishes to preserve the rights of all of its citizens to be free
from the growing problems of litter as well as preserving the rights
of future generations to the enjoyment of energy and resources avail-
able in this country.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Chula Vista does hereby urge the League of California Cities
to endorse and support the strongest possible legislation totally
banning all nonreturnable beverage containers of any kind throughout
the State of California as well as the sale of any cans having pull-
top openers thereon.
BE IT FURTHER RESOLVED that the City Council urges that
such legislation contain no exceptions and that all containers in-
cluding cans, regardless of the type of materials contained therein,
be subjected to a significant deposit to stimulate return, and that
all distributors be required to clearly encourage return and be re-
quired to accept return of all such containers.
BE IT FURTHER RESOLVED that the City Clerk of the City of
Chula Vista be, and she is hereby directed to forward a certified
copy of this resolution to the League of California Cities, Senator
Mills and Assemblyman Wadie Deddeh and to all members of the San
Diego County Legislative Delegation.
