RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA AUTHORIZING THE ISSUANCE OF COASTAL
DEVELOPMENT PERMIT #035 TO SANTA FE LAND IMPROVE-
MENT COMPANY FOR DEMOLITION AND REMOVAL OF FOUR
STORAGE SHEDS FROM THE MIDBAYFRONT SUBJECT TO
THE REQUIREMENTS IN FINDING #1
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the Chula Vista Bayfront Local Coastal Program
(LCP) was certified by the California Coastal Commission; and,
WHEREAS, said 'LCP' includes coastal development permitting
procedures determined by the Coastal Commission to be legally adequate
for issuance of Coastal Development Permits; and,
WHEREAS, the City of Chula Vista has assumed permit
authority over the Chula Vista Coastal Zone; and,
WHEREAS, a public hearing was held on January 12, 1988,
in accordance with said permitting procedures; and,
WHEREAS, the City Council of the City of Chula Vista, as
approving authority, has reviewed the proposal for demolition of the four
huts in the Midbayfront.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista finds, based on the following findings, in
accordance with the Section 13311 of the California Administrative Code,
that the demolition of the four storgage huts in the Midbayfront and
their removal is consistent with the policies of the Chula Vista Bayfront
LCP.
1. Consistent with the grading and drainage requirements
in Section 19.87.07 of the Specific Plan, siltation in wetland areas
resulting from site run-off will be minimized by requiring the applicant
to conduct removal of foundations and any backfilling that may be required
between April 1 and November 1. In addition, the area beneath the
foundation will be required to be planted within 60 days of initial dis-
turbance and prior to November 1. Finally, the planting shall be done
under the supervision of a licensed landscape architect and will provide
seeding, mulching, fertilization, and irrigation adequate to provide
90 percent coverage within 90 days (planting will be repeated if adequate
coverage is not established).
2. The huts are located on the portion of the Midbayfront
zoned for office park use. Removal of the huts is consistent with the
planned use of the site.
3. The demolition of the huts would improve the visual
quality of the Midbayfront and thus is consistent with LCP form and
appearance guideline which states: "Improve the visual quality of the
shoreline by promoting public and private uses which provide proper
restoration, landscaping, and maintenance of shoreline areas".
4. The demolition of the huts would also remove a
blighting influence on the area consistent with the form and appearance
guideline which states: "Remove, or mitigate by landscaping, structures
or conditions which have a blighting influence on the area".
BE IT FURTHER RESOLVED that the City Council of the City
of Chula Vista hereby issues Coastal Development Permit #035 for the
demolition and removal of four storage huts in the Midbayfront subject to
the requirements in Finding #1.

Dear Mr. Dimond:
As a follow-up to your letter to Robin Putnam dated December
7, 1987, my staff conducted an inspection of the four huts
located in the Midbayfront to determine whether the
buildings are structurally safe. It is the conclusion of
the inspector that all of the huts except the one located
furthest south requires the replacement of approximately 10
bolts in the center section to make it structurally safe.
Because the bolts were recently removed, I suggest that they
be replaced as soon as possible to ensure that the hut is
structurally safe until the required permits can be
processed.
I understand that you are currently preparing an application
for the Coastal Development Permit required for demolition.
In addition to that permit a demolition permit is required
from the Building and Housing Department prior to removal of
the huts.

Dear Jack:
On December 8, 1987, I received your Coastal Development
Permit application for the demolition of four huts in the
Midbayfront. I found the submittal to be incomplete because
items required in Appendix H of the Chula Vista Bayfront
Specific Plan Coastal Development Permit Procedures Manual
were omitted. I have enclosed a copy of that document for
your use in preparing an amended submittal. In addition, a
copy of the mailing list used by the City to prepare
envelopes pursuant to Appendix H #3 is enclosed to
facilitate your compliance.
Because the initial demolition work was done in violation of
Section 19.92 of the Chula Vista Bayfront Specific Plan, a
completed Coastal Development Permit application must be
filed with the City immediately. That application will be
processed according to the City's established permit
procedures.
In the interim, I have requested that the City's Building
and Housing Department inspect the buildings to determine
whether they are structurally unsafe. If they are
determined to be structurally unsafe, they will be red-
tagged and may legally be removed prior to issuance of the
Coastal Development Permit pursuant to Section 30005(b) of
the Coastal Act.

Dear Robin:
Enclosed please find a completed application for the required
Coastal Development Permit relating to demolition of the four
small quonset huts in the Mid-bayfront.
I might also advise you that the buildings are now structurally
unsafe, due to removal of the majority of the sectional locking
devices. Since the huts have been used as shelter for squatters
and we have no effective way of protecting against unauthorized
use, I would like to propose the following course of action.
Chula Vista would "red-tag" the buildings and we would immediately
disassemble them. At the same time, we would continue to process
the paperwork for final substantiation of the actions.
Since these buildings have no effect on adjoining lands, and their
removal will create absolutely no effect on the environment, I
really feel that the matter is more procedural than substantial.
Please let me know the City's decision as soon as you can.

Dear Jack:
It has come to my attention that persons, with authorization from your
employee, Ron Smith, are demolishing huts in the Midbayfront subarea of
the Chula Vista Bayfront. These huts are assessory structures to the
nursery/warehouse uses.
This demolition work is in violation of Section 19.92 of the Chula Vista
Bayfront Specific Plan which requires that a Coastal Development Permit
be obtained prior to undertaking such work. If all work constituting
"development" as defined in Section 19.92.02 of the Bayfront Specific
Plan and as detailed below is not terminated immediately, the matter
will be referred to the City Attorney for enforcement.
"Development" means, on land, in or under water, the placement or
erection of any solid material or structure; discharge or disposal of
any dredged material or of any gaseous, liquid, solid, or thermal waste;
grading, removing, dredging, mining, or extraction of any materials;
change in the density of intensity of use of land, includint~ but not

limited to, subdivison pursuant to the Subdivision ommencing
with Section 66410 of the Government Code}, and any other division of
land, including lot splits, except where'the land division is brought
about in connection with the purchase of such land by a public agency
for public recreational use; change in the intensity of use of water,
or of access thereto; construction, reconstruction, demolition, or
alteration of the size of any structure, including any facility of any
private, public, or municipal utility; and the removal or harvesting of
major vegetation other than for agricultural purposes, and help harvesting.
