HomeMy WebLinkAboutReso 1975-7713RESOLUTION kIO. 7713 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING PFECISE PLAtT FOR THE MEX IPISUR AGENCY FND CHULA VISTA TOURIST INFORSIATION CF,NTER AT THE PdORTH""WEST QUADRANT OF I-805 ALdD BODTITA ROAD The City Council of the City of Chula Vista does hereby resolve as follows: ?dHEREAS, the City Council has heretofore on July 18, 1972 by Ordinance No. 1395 approved a chance of zone frorn C-C-D-F to C-V-P-F for approximately 3-1/2 acres located at the northwest quadrant of I-805 and Bonita P.oad, and WHEREAS, said ordinance requires the approve of a Precise Plans prior to the development of any portion of that property, and TidHEREAS, Creaser-Price Insurance Agency, Inc. subriitted a Precise Plan for the development of approximately one acre corn prising the easterly end of the 3-1/2 acre parcel, and LTHEREAS, the Planning Commission at their meeting of April 9, 1975 considered the Precise Plan for development as sub- mitted by Creaser-Price Insurance Agency, Inc., and WHEREAS, tk-ie Planning Comrission finds the Precise Plan for the L1ex Insur P.gency and Chula Vista Tourist Information Center conforms to the General Plan and ordinances of the City of Chula Vista and recommends the approval of the Precise Plan subject to the conditions contained in Planning Commission Resolution No. PCM-75-2. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that the Precise Plan for the b4ex Insur Agency and Chula Vista Tourist Information Center at the nortvaest quadrant of I-805 and Bonita Road be, and the same is hereby approved in accordance with Planning Commission Resolution I7o. PCD1-75-2, which is attached hereto as Exhibit "A" and incorporated herein by refer- ence as if set forth in full, with the follovaing exception noted: Condition No. 3 of Exhibit "A" regarding signs shall be modified to provide: The sign approved for the project shall be a joint usage sign located at the northwest quadrant of the area under C-V-P zoning owned by P1r. O'P7ea1. Said sign shall provide for identification of Mex-Insur facility of letters not less than 30 in height. The height of the overall structure shall be deter- rcined and approved by the Flanning staff. In the event the adjacent owners of the property subject to C-V-P zoning are unable to enter into an agreement providing for the usage of the property on the north- westerly portion of said area, the Mex-Insur facility should be allowed (1) a free standing sign as indi- cated in Planning Conu^ission Resolution No. PCM-75-2, Section 3C. NOW THEREFORE BE IT RESOLVED AS FOLLOWS: The City Planning Commission finds the Precise Plan for the Mex Incur Agency and Chula Vista ~rourist Information Center at the north~•rest quadrant of I-805 and Bonita Road conforms to the Genes°al Plan and ordinances of the City of Chula Vista, and recommend to the City Council the approval of the Precise Plan subject to the following conditions: 1. The site plan for development, including architectural elevations, location of signs, and landscaped and parking areas, shall conform to Exhibits "A" and "B", attached. 2. Grading of the site shall conform to conditional use permit PC.C-75-2. 3. .Signs shall include the following: a. Wall mounted signs as shown on Exhibit "B". b. Ground monument sign as shown on Exhibit "C", including: 1) "Mex Incur" copy of 2'8" x 14'. (Logo shall not include "Mex Incur" at the top.) 2) "Tourist Information" copy of 1' x 12' 3) Slump block monument base to match the building materials. c. Freestanding sign as shown on Exhibit "D", including 40 ft. height, 192 sq. ft. area, and 48" high leiaers. 4. Complete landscaping and irrigation plans shall be submitted with the site plan and shall be coordinated with the frontage to be landscaped b.y Cal Trans. Cal Trans plans for plant; materials, by type and location, shall be shown on the plans. 5. Building architecture shall be approved 'in conjunction with approval of the detailed building plans. 6. The applicant shall prepare improvement plans, obtain necessary permits, and construct public street improvements consisting of curb and gutter, sidewalk, driveway approaches, pavement, drainage facilities and ornamental street lights. All work is to conform to the City of Chula Vista standards. All plans for public improvements shall be submitted for approval by the City Engineer. 7. The applicant shall underground all onsite utilities, with the exception of the 12 KV distribution line, for which a waiver may be requested by separate action. 8. Parking on Bonita Road shall be prohibited in front of the subject property. 9. The easterly driveway as shown on Exhibit "A" shall be designated for "Inge°ess only." The westerly driveway of this property shall be designated for "Egress only" until such time as the adjoining development to the west completes the necessary access to allow traffic to exit opposite Bonita Glen Drive; at such time of completion, this driveway will be designated for "Ingress only." 10. As shown on Exhibit "A" the applicant shall grant an easement, 24 feet wide, for access purposes, extending from Bonita Road to the north side of the east-west access which abuts the westerly property line of this parcel. PCC-75- 2 RESOLUTION OF THE CITY PLANNING COMMISSION GRANTING A CONDITIONAL USE PERMIT WHEREAS, a duly verified application fora conditional use permit was filed with the Planning Department on January 22, 1975 by Creaser-Price Insurance Agency, Inc., and WHEREAS, said application requested that the applicant be granted a conditional use permit to construct an insurance office and tourist information center on property located at the northwest quadrant of I-805 and Bonita Road, more particularly described in the application, and which is zoned C-V-F-P, and WHEREAS, the Planning Commission set the time and place fora hearing on said application and notice of said hearing was given by the mailing of a letter to property owners within 300 feet of the exterior boundaries of the property at least ten days prior to the hearing, and WHEREAS, the hearing was held at the time and place, namely 7:00 p.m., February 26, March 72, March 26, and April 9, 1975, in the Council Chamber, City Hall, 276 Fourth Avenue, before the Planning Commission and said hearing was thereafter closed. NOW THEREFORE BE IT RESOLVED THAT THE CITY PLANNING COMMISSION finds as follows: a. That the proposed use at the particular location is necessary or desirable to provide a service or facility which will contribute to the general well-being of the neighborhood or the community. The location of a Mexican auto insurance agency and the Chula Vista Visitor Information Center on the new freeway at this important interchange will provide a valuable and convenient service to the general public. The usf>s are suitable for this area and will be an additional asset to this commercial area. The I-805 freeway is eventually expected to carry more traffic than I-5. b. Such use will not, under the circumstances of the particular case, be detri- mental to the health, safety or general welfare of persons residing or working in the vicinity, or injurious to property or improvements in the vicinity. Subject to the required grading to protect against flood hazards, and an approved Precise Plan compatible with the development approved to the west, the insurance/visitor center will complement rather than have a detrimental impact on adjoining prroperties. c. That the proposed use will comply with the regulations and conditions specified in the Code for such use. Subject to the conditions of approval, the proposed development is determined to be in compliance with the Code .requirements for the land uses proposed. d. That the granting of this conditional use will not advei°sely affect the General Plan of the City of Chula Vista or the adopted plan of any govern- mental agency. The basic land uses conform to the Land Use Element of the General Plan, which designates the property as "Visitor Commercial." Subject to the special treatment of architecture, landscaping and signs under the Precise Plan, the plan will also conform to the Scenic Highways Element of the General Plan, which designates Bonita Road as a "Scenic Route" and "Gateway" to both Chula Vista and the Sweetwater Valley. Special treatment of the existing alluvial soils present on the site may be required for the plan to conform to the Seismic Safety Element The other elements of the General Plan are not affected. BE IT FURTHER RESOLVED that the City Planning Commission grants a conditional use permit to Creaser-Price Insurance Agency, Inc. to construct an insurance office and tourist information center in the flood plain on property located at the northwest quadrant of I-805 and Bonita Road. Approval of this conditional use permit is granted subject to the following conditions: 1. Developement of the property shall be in accordance with an approved Precise Plan. 2. The building pad shall be placed at or 1' above the 100 year flood plain, or at elevation 42.2 feet minimum. 3. The applicant shall prepare improvement plans, obtain necessary permits, and construct public street improvements consisting mf curb and gutter, sidewalk, driveway approaches, pavement, drainage facilities and ornamental street lights; all work to conform to the City of Chula Vista standards; and all plans shall be submitted for approval by the City Engineer. 4. The applicant shall provide the City with evidence that the proposed site is a legal lot; if not, the applicant shall comply with City regula- tions and applicable provisions of the State P§ap Act.. 1`his conditional use permit shall become inefi'ective and void if the same is not utilized within one year from the date of this resolution in accordance with Section 33.1310 of the Zoning Ordinance. Consideration of Precise Plan for development of property in C-V-P-F l ------------------ ---- --- zone at northwest quadrant of Bonita Road and 1-II05, Creaser-Price Insurance agency, Inc. A. BACY.GROUND 1. The preceding agenda item considered a request from Creaser-Price Insurance Agency, Inc. for a conditional use permit to construct a 1000 sq. ft. building in the flood plain. This item addresses their request for approval of the Precise Plan unde~• the provisions of the C-V-P-F zoning. 2 Initial Study IS-74-10 which was prepared for the conditional use permit, and the Negative Declaration which was certified by the Planning Commission cover this request. B. ANALYSIS 1. The Precise Plan, enclosed as Exhibit "A" in the Commission packets, conforms to the several guidelines established at-the time of the rezoning of the property, on July 18, 1972 (Ord. #1395). Specifically,-the plan shows coordinated access betr-Teen the subject site and the land uses to the west; in addition, architectural concepts and a sign plan have been submitted as required. 2. Features of the Plan.. The building ~~ill house both the insurance agency (east end) and the Visitors Information Center (west end). Three drive-through lanes are being provided for insurance customers. The west end of the building will feature a courtyard and bulletin boards. The elevations of these features are shown on Exhibit "B" A total of 26 parking stalls are shown on the plan: 19 standard-sized stalls and 6 oversized stalls for motorhoines, cars with trailers, etc. A substantial portion of the landscaped area fronting on Bonita Road is in the State right of way and will be landscaped by Cal Trans. The Cal Trans plan and the landscaping of the applicant's property will be coordinated. 3. Sign Program. The Precise Plan shows two signs reading "Mex Insur": one is a monument sign on Bonita Road, and the other a 40' high pole sign oriented to the freeway. The monument sign confor°ms to the signs on the other properties and is acceptable to staff, as shown on Exhibit "C". The pole sign ,'however, is not suitable, in staff's opinion. This freestanding sign would be the only one for this develop- ment since the three adjoining businesses have proposed placement of their signs on the north end of the motel building rather than using freestanding poles. Freestanding signs are generally not suitable for this area, since they would tend to add visual clutter to this otherwise scenic area, which serves as the gateway to the Sm~eetwater Valley as well as Chula Vista. Bath the applicant and the owner of the adjoining property have expressed their willingness to eventually place the "P1ex Insur" sigrG on the end of the motel building; however, there is some uncertainty at this time to ~•;hether ~ 7/.~ City Planning ronnai~sion Agenda Items for (~1eeting~of April 9, 1975 page 6 the structure r-rill be four stories, or less, thereby reducing the height of the signs in proportion to the building heiyht. Even with a reduced building height: it may be feasible to accommodate all of the signs on the end of the motel building. l'he staff is withholding judgment on this idea until a design proposal is submitted. in addition, the applicant desires to start construction immediately, whereas the construction start-time of the adjoining development is presently unknown. The applicant consequently is requesting a 40' high freestanding pole sign, containing 192 sq. ft., located at the southeast corner of his property (Exhibit "D"). The Zoning Ordinance allows for a maximum height of 35' and a maximum area of 150 sy. ft, should a second freestanding sign be allowed. An alternative to the applicant's proposal would be to locate the sign at the northwest corner of the adjoining property to the west--a proposal which is apparently acceptable to the applicant and the adjoining property owner. This solution vrould place the sign about G00 feet closer to the southbound lanes of I-605, tPiereby increasing its visibility, reducing the need for the 40' height, and allowing fora smaller sign. It is staff's opinion that this location offers the best temporary solution in supplying the applicant with freeway identification. The freestanding pole sign would exist only until the motel is built. At that time the "Mex Insur" sign pole would be removed and the sign itself mounted, along with the other signs, on the north end of the motel building. 4. improvements. Concurrent with development of the site, a number of improvements, including those on 6onita Road, 2 driveway entrances, and undergrounding of utilities will be required. These are addressed under conditions of approval. 5. Architectural Theme. The architecture of the building, as shown on Exhibit "B", is of a Spanish desiyn using slumpstone block walls and concrete the roofing. This conforms with the Spanish style architecture previously approved by the Planning Commission for the motel, restaurant and service station to the west. 6. Undergroundir.g Utilities. City ordinance requires onsite utilities to be underground ed. This includes a 12 KV distribution line running along the rear of the property. In this instance, the undergrounding of this line is not considered practical because while there is one pole onsite now, two mould be needed to bring the wires down--one on each end of the segment placed underground. Secondly, the short distance so undergrounded would achieve insignificant results since the line runs overhead to the north and across the freeway. SUGRE has advised that to underground this line under the freeway would be cost prohibitive. Lastly, this line was recently placed overhead (1973) on easements obtained from the present owners. ~ ~i3 City Planning Conmiission Agenda Items for Meeting of Flpril 9, 1975 page 7 C. RECOMME(tl0ATI0P1 Adopt a motion recommending that the City Council approve the Precise Plan PCM-75-2 for the ~~tex Incur Agency/Visitor's Information Center located at the northwest quadrant of I-805 and Bonita Road, subject to the following conditions: 1. The site plan for development, including grading, architectural elevations, location of signs, and landscaped and parking areas, shall conform to conditional use permit PCC-75-2 and to Exhibits "A", "B" and "C". 2. Signs. a. The ground monument sign is approved as follows: 1) The "Mex Incur" copy of 2'8" x 14' is appr be reduced by eliminating the word "Mex Incur" 2) The "Tourist Information" copy of 1' x 12' 3) The base of the sign shall be changed to a base to match the building materials. 4) Exhibit "C" shows the ground monument sign approval. b. This approval is predicated on the applicant procuring the necessary agreement with that property owner. Upon construction of the motel the pole shall be removed and the sign relocated on the end of the motel building. The pole sign may remain in position for a maximum period of five years after which time it shall be removed regardless of whether the motel has been constructed or not. The applicant shall enter into an agreement and post a suitable surety to guarantee performance pursuant to this condition of approval. c. All wall mounted signs are approved as shown on Exhibit "B". 3. Landscaping. Complete landscaping and irrigation plans shall be submitted with the site plan. These plans shall be coordinated with the frontage to be landscaped by Cal Trans, Cal Trans plans for plant materials, by type and location sha11 be shown on the applicant's plans. 7 7/,~ City. The applicant shall underground all onsite utilities, with the exception of the 12 KV distribution line for which a deferral may be requested by separate action. 7.
