HomeMy WebLinkAboutReso 1975-7709RESOLUTION N0. 7709 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ELECTING TO PROCEED UNDER THE PROVISIONS OF THE STREET VACATION ACT OF 1941, DECLARING TAE INTENTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA TO VACATE PUBLIC ALLEYS SOUTH OF "G" STREET, WEST OF FOURTH AVENUE, AP1D FIXING A TIME AP1D PLACE FOR PUBLIC HEARING THEREON The City Council of the City of Chula Vista does hereby resolve as follows: G7ffEREAS, the City Council o£ the City of Chula Vista has determined that the public interest and convenience of said City requires the vacation of the public alleys south of "G" Street, west of Fourth Avenue, NOW, THEREFORE, BE IT RESOLVED that it is the intention of the City Council to order the vacation of the public alleys south of "G" Street, west of Fourth Avenue, more particularly described in Exhibit "B" attached hereto and by this reference made apart hereof, the same as though fully set forth herein. BE IT FURTHER RESOLVED that the City Council hereby elects to proceed in making said vacation under the provisions of the Street Vacation Act of 1941, and hereby fixes Tuesday, the 13th day of Pfay, 1975, at 7:30 p.ra., in the Council Chambers of City Hall, 276 Fourth Avenue, Chula Vista, California as the time and place for hearing all persons interested in or objecting to the proposed vacation. BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be, and she is hereby directed to cause a copy of this resolution to be published once in the Chula Vista Star News, a newspaper of general circulation, and to cause notices of the passage of this resolution to be posted in the manner and form required by law. m Presented by Approved as to form by ~;. Reserving therefrom the following easements: To: San Diego Gas & Electric Company Reserving and excepting from vacation and abandonment, easements and rights to San Diego Gas & Electric Company, a corporation, pursuant to any existing franchise or renewals thereof, or. otherwise, at any time, or from time to time, to construct, maintain, operate, replace, remove, renew or enlarge lines of pipe, conduits, cables, wires, poles or other structures, equipment and fixtures for the operation of gas pipe lines, and for the transportation or distribution of gas and/or electrical energy for incidental purposes thereof, including ingress and egress, to protect the property from all hazards in, upon, over and across the following described lands: That certain 25.00 foot alley, lying adjacent to, contiguous with and Westerly of the Westerly line of Lots 93 through ^7 of Kuebler Terrace No. 6, according to Map thereof No. 2857, filed March 26, 1952 at File No. 37353, in the office of the County Recorder of the County of San Diego, State of California.
