HomeMy WebLinkAboutReso 1975-7706RESOLUTION N0. 7706 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA DETERMINING THE AMOUNT OF MONEY C7HICH SHOULD BE ASSESSED AGAINST CERTAIN PARCELS OF PROPERTY PRIOR TO MAKING SE47ER CONNECTION BECAUSE OF BENEFIT RECEIVED BY SAID PARCELS BY THE CONSTRUCTION OF A SEWER INSTALLA- TIO4I ALONG BAY BOULEVAP,D FROPd "G" STREET TO "F" STREET The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City of Chula Vista has constructed or caused to be constructed certain sewer installation pursuant to the terms and conditions of that certain agreement hereto approved by Resolution Ido. 7433, and WHEREAS, the City Engineer on March 11, 1975 did accept said construction as having met the specifications and requirements of the City of Chula Vista, and L•diIEREAS, the City Engineer has filed his recommendations to the City Council, in writing with the City Clerk, setting forth therein the parcels which he has determined have benefited from the construction of said sewer facility, and has set forth his recorimen- dations as to the proportion of benefit received, which sum of money should be paid to the City of Chula Vista prior to any sewer connec- tion being made to any sewer facility of the City, to serve said parcel, and WHEREAS, the Director of Public Works has prepared a recommendation regarding the method for the repayment of the costs to the sewer facilities in Bay Boulevard from "G" Street to "F" Street and said recommendation is marked as Exhibit "A", and attached hereto and incorporated herein by reference as if set forth in full. IdOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that the recommendations of the Director of Public Works as shown on Exhibit "A", attached hereto, be, and the same are hereby adopted by the City Council and said amounts will be assessed against parcels connecting to the sewer facility des- cribed therein. BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be, and she is hereby directed to record this reso- lution in the office of the San Diego County Recorder. Robens, Director of Public LFOrks of the City of Chula Vista, hereby present my recommendation to the City Council regarding repayment of con- struction costs for the sewer main in Bay Boulevard from "G" Street to "F" Street Section 26, Article N of the City Code provides that the Director of Public Works shall determine a proper sewer charge against those properties not con- tributing toward the construction cost of the sewer facility installed. The City Council may, by resolution, adopt the recommendations of the Director of Public !Forks. Interest Charge: To the above initial cost per 'property, there is to be added simple interest of 78 per annum to a maximum of 10 years, to be charged at time of payment of the assessment and prior to being served by the subject sewer.
