ITEM TITLE_ RESOLUTION - Approving agreement for appraisal services with Gerald S.
Kibbey, M.A.I., and Associates, in connection with the South Bay
Court Site

ITEM EXPLANATION
In order to properly negotiate for the purchase of the Third Avenue and H Street site
(Carlstrom property), the services of an independent fee appraiser must be obtained.
Four proposals for services were solicited; fees ranged from $4,500 to $8,000. A
60-day time frame was quoted for preparation of all submittals.
The appraisal is to be conducted in accordance with San Diego County requirements so
as to enable the County to utilize the appraisal at the appropriate time. Services
for court appearance, if required, are also quoted and were generally the same. The
firm recommended is well versed in the Chula Vista area and highly respected in his
profession. He was chosen after consultation with County officials and has been an
expert witness for the City and the County of San Diego on various occasions.
Financial Statement
Funds are available from the special appropriation transferred from the general fund;
said work is in accordance with City Council Resolution No. 7768 authorizing acquisition
of said property for the Court facility.

It is recommended that an agreement between Gerald S. Kibbey, M.A.I., and Associates
and the City of Chula Vista for appraisal services of the Carlstrom property at
Third Avenue and H Street in the amount of $5,000 be approved.

Dear Mr. Desrochers:
In accordance with your request, I am submitting herewith a
proposal to appraise the market value of approximately 12
acres of land bound by "H" Street, Third Avenue, "I" Street
and Garrett Avenue, in the City of Chula Vista. The site is
presently improved with a Ranch D4art furniture storage and
sales Facility and a free standing Thirfty drug store.
It is my understanding that the City of Chula Vista, in con-
junction with the County of San Diego, intends to acquire
the subject property for public use. The public agencies
are endowed with the power of eminent domain and therefore
would be negotiating under the threat of condemnation.
The public agencies have therefore requested an appraisal of
the fair market value of the subject property_ After having
conducted a preliminary inspection of the subject property,
and considering my present commitments, I feel that I will be
able to prepare an appraisal of the subject property within a
period of 60 days from your authorization to proceed, for a
fee of $4,500. The appraisal will be of the larger parcel
and will assume single ownership in fee, subject to the exist-
ing leases, if any, on the previously mentioned two structures.
In the event any additional conferences or court testimony are
required, an additional fee of $200 per day will be charged
with a minimum one half day fee. Three copies of a narrative
report will be delivered within 60 days of your authorization
to proceed.
If the above proposal meets with your approval, I would like
to explore the matter further and expedite a formal contract.

proposal for an appraisal of the following described property.
Assessor's Parcel No.'s 573-030-20, 21, 18 (12), 16, 19,
24, 23, 30, 31, 22, 29, 32, 33, 11, 27, and 26; also
Assessor's Parcel No.'s 573-100-01, 02, 03, 04, O5, 06,
28, 26, 29, 30, 27, 90, 10, 22, 21, 19, 17 and 16.
The appraisal would be a full narrative and meet the standards
of the County of San Diego review.
Appraisal Fee: $5,000.00
Delivery Date: 60 days from contract
In addition to the above fee, should there be pre-trial conferences
or court testimony my fees will be at the rate of $200 per day.

Re: Appraisal of South Bay Court Site
Southwest corner of Third Avenue and H Street
Dear Mr. Desrochers:
You have asked me to quote my fee for an appraisal of the above-captioned
property.
I shall complete and deliver to you two copies of a report 60 days from date of
authorization for a fee of $6,485, due upon delivery thereof. The appraisal is
to be made to San Diego County format and policies. Physically, this real estate
consists of approximately 12 acres, improved with a Th~•ifty Drug Store and the
Ranch Mart Furniture Store, the balance being vacant commercial and R-3 zoned
land. The Litigation Guarantee will be furnished by you.
The appraisal is to be made in conformity with and subject to the requirements of
the Code of Ethics and Standards of Professional Conduct of the American Institute
of Real Estate Appraisers of the National Association of Realtors.
I shall be further compensated on a per diem basis at a rate of $185 per day or
fraction for any time in court if I am called upon to appear and testify. Pre-trial
conference and preparation time will be reimbursed at the rate of $185 per usual
business day or $25 per hour. for partial days. Should I be called upon for deposi-
tion by opposing litigants or should I be subpoenaed rather than being called by you,
it is understood that you will compensate me for my time in accordance with the
above schedule; however, I shall consult with you or with your counsel before
responding to any such subpoena or call for a deposition.

My fee is $300, 00 per day for court testimony, pretrial conferences,
or preparation of any additional studies or exhibits requested by your
attorney, The daily fee is $150, 00 for court testimony which occupies one half
day or less,
It is my understanding that you will give me an answer on this proposal
on or before July 15th, 1975,
