RESOLUTION OF TFIE CITY COUNCIL OF THE CITY OF CHULA
VISTA ORDERING THE DEFERRAL OF UNDERGROUNDING RE-
QUIREMENTS, NORTHY,TEST QUADRANT I-805 FREEWAY AND
BONITA ROAD
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the City Council of the City of Chula Vista has
heretofore on August 12, 1975 held a public hearing as provided in
Section 15.32.010 of the Chula Vista Municipal Code to consider
the deferral of undergrounding requirements at the northwest quad-
rant of I-805 Freeway and Bonita Road, and
WHEREAS, after hearing all testimony, it has been determined
that because of the extraordinary conditions existing at said location,
a deferral of undergrounding requirements would be justified, based
upon the following reasons:
1. The undergrounding of this line is not considered prac-
tical because while there are three poles onsite now, two would be
needed to bring the wires down - one on each end of the segment placed
underground.
2. The portion undergrounded would achieve insignificant
results since the line runs north and overhead across the freeway and
south and overhead across Bonita Road.
3. The cost of placing the line under the freeway would be
prohibitive.
4. This line was recently placed overhead (1973) as part
of the utility relocation for the freeway.
5. Undergrounding would place an unnecessary hardship on
the owners of the property.
6. A variance or deferral to underground these overhead
facilities would not be detrimental to the health, safety or general
welfare of the neighborhood.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista that the requirement for undergrounding utilities
as contained in Section 15.32.010 of the Chula Vista Municipal Code
be and the same is hereby deferred for Parcel Map 6-75 for the north-
o~est quadrant of I-805 Freeway and Bonita Road based upon the fact
that the above stated reasons indicate:
1. That extraordinary conditions exist to the extent that
enforcement of this section of the Municipal Code would result in
unnecessary hardship to the subdivider or the utility company.
2. That subject deferral will not, under the circumstances
of the particular case, be detrimental to the health, safety or general
welfare of the neighborhood.
BE IT FURTHER RESOLVED that the condition of said deferral
is that the subdivider and developer of said property, Commercial Ven-
tures, Inc., and their successors in interest agree that they hereby
waive all right to protest against the formation of an underground
utility district at some future date.
