HomeMy WebLinkAboutReso 1975-7864Form No. 3~2 Rev. 3/7A RESOLUTION N0. 7864 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF' CHULA VISTA, APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND STEVE HAhSEY ASSOCIATES TO PERFORM LANDSCAPE SERVICES RELATIVE TO THE MUELLER SCHOOL SITE AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED that that certain agreement between THE CITY OF CHULA VISTA, a municipal corporation, and STEVE HALSEY ASSOCIATES, to perform landscape services relative to the Mueller School site, dated the 15th day of July 1975 a copy of which is attached hereto and incorporated herein, the same as though fully set forth herein be, and the same is hereby approved, BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreeme~lt~or and on behalf of the City of Chula Vista. Desrochers Community Development Director, City of Chula Vista, 276 Fourth Ave. , Chula Vista, CA 92010 Dear Mr. Desrochers, At your request, I am submitting for your approval, this Proposal/ Agreement to perform Landscape Architectural consulting services for the following project: By and between: OWNER hereinafter referred to as City. City of Chula Vista, 276 Fourth Ave. , Chula Vista, CA 92010 and: LANDSCAPE ARCHITECT Steve Halsey Associates, 11722 Sorrento Valley Road, Suite I, San Diego, California 92121 ARTICLE 1: PROJECT I. That the City hereby employ the Landscape Architect to render professional services for the landscape architectural planning and design of a neighborhood park on the Mueller School site, located on Oaklawn Ave. , and "I" Street in the City of Chula Vista, hereinafter referred to as the "Project". 2. The use planned for this Project is to develop a neighborhood park facility of approximately five (5) acres. The project will in- clude grading, contouring, planting of trees, turf, shrubs and ground covers; irrigation systems and appropriate facilities as required and defined in the final approved design development plan. Because of lack of funds, the total site will not be developed. The amount of the site to be constructed will be approximately two and one half acres. ..~ ~± h ~l Recozrmendations for incremental construction and phasing will also be studied. ARTICLE 2 : SERVICES The professional services of the Landscape Architect shall be as follows: 1, Research, Schematic and Preliminary Design: These services shall include research of existing and anticipated site conditions, soil, climatic,and relationships with adjacent areas. A Preliminary Design Plan will be developed showing all design elements, construction items, general landscape plan and preliminary cost estimate based on current unit prices. 2. Presentations: Will be made to the following committees and groups as necessary. a. Park and Recreation Commission b. School Park Committee and/or Board of Education c. Residential Park Committee d. City Council 3. The City shall review and make any recommendations at this stage. After review and necessary adjustment, the City shall approve the preliminary design plan and budget. 4. Construction Documents Phase: The Landscape Architect shall prepare working drawings after final design development plan has been reviewed and approved by the City. a. Site Plan and Landscape Construction Plan: This drawing will show dimensioned layouts of landscape site improvements for construction purposes, including details and sections of landscape features .as required to install work. b, Gradina and Drainaae Plan: Based on topographic survey and information provided by the City. Proposed and existing contours, elevation, drainage devices and flow lines. c. Li~htin~ Plan: Will lay out underground wiring. Light standards, fixtures, special lighting effects, control equipment, installations, details, and circuits diagrams as required for lighting and power supply for specialized landscape equipment. d. Irrigation Plan: The irrigation plan will show a diagramatic layout of the irrigation system, including irrigation heads, valves, backflow and control equipment locations, piping acid sizing and all necessary details. 2 ~~~a e. Planting Plan: The planting plan will show and identify types, location, quantities and sizes of all plant materials and related materials to be used, and neces- sary details. The plans will also specify, when neces- sary, where specimen trees are available for this project. f. Specifications: Specifications will identify types and qualities of materials to be used and will set forth methods of construction and/or installation. 5. Cost Estimates: The Cost Estimates will consist of quantitative and cost analysis of the project work, based on approximate present day labor and material costs for the preliminary plan and final drawings. 6. Required Supervision: The Landscape Architect shall respond to inspection requested by the City within 48 hours. Additional inspections as authorized by the City shall be billed under separate billing as an extra, based on time and materials. 7. Inspections: It is recommended that a minimum of five (5) inspections be performed on the proposed project. a. Pre-construction meeting with the contractor and Landscape Architect. b. Prior to finish grading. c. Prior to filling irrigation trenching and testing. d. Prior to placement and planting of plant material. e. Final inspection after completion of maintenance period. 8. Landscape Architect shall provide technical advice for the project and any other related work to a project officer employed by and responsible to the City. 9. Project Documents Phase: Landscape Architect shall furnish City with the following as a reimbursable printing expense: a. Five sets of Preliminary design development plan. b. Five sets of approved final plot plan. c. Twenty-five (25) sets of construction documents. d. Five sets of bidding documents. e. After the City's final approval, tracings of construction drawings and master copies of specifications will be submitted. 3 7~ 6 ~ ARTICLE 3: EXCLUSION TO SCOPE OF WORK Fees for the following items shall be adjusted by mutual consent: 1. Changes in the scope of the project, in size or design concept. 2. Additional bi.d documents and information 3. Cost of permits. 4. Cost of printing and other reproductions. 5. Financial feasibility, or other special studies. 6. Providing planning surveys or site evaluations. 7. Revision previously approved drawings, specifications or other documents to accomplish changes not initiated by the Landscape Architect. 8. Preparing documents for alternate bids requested by the City. 9. Providing consultation concerning replacement of any work damaged by fire or other cause during construction, and furnishing professional services as may be required in connection with the replacement of such work. 10. Providing professional services made necessary by default of the contractor in the performance of the construction cost. 11. Furnishing the City a set of reproducible record prints of drawings showing significant changes made during the construction process, based on marked up prints, drawings, and other data furnished by the contractor to the Landscape Architect. ARTICLE 4: CONTRACT AWARDING: Assistance as may be requested relative to bidding forms, instructions to bidders, interpretation of contract documents, and mediation between contractor and City. .SRTICLE 5: CITY'S RESPONSIBILITIES: 1. The City shall provide information as to the requirements and program of the Project, including budget limitations and scheduling. 2. The City shall provide, or cause to be provided, site information including grades and lines of streets, pavements and adjoining properties; rights of way, restrictions, easements, boundaries and contours of the Project site; locations, dimensions and floor elevations of existing buildings, if any; other improvements and trees, if any; and information as to available service and utility lines, both public and private; all of the above to the extent that they are shown in the City's records. .~~ ~~ ~ 4 3. The City shall provide information for all necessary traffic i and parking research and provide personnel for consultation with the Landscape Architect as required for proper design of access to the site, internal automobile traffic flow and parking arrange- ments. 4. The City shall provide or cause to be provided, material testing required for construction of the project. 5. City shall notify Landscape Architect of administrative procedures required and name representatives authorized to act in its behalf. 6. The City shall furnish information and approvals required as expeditiously as necessary for the orderly progress of the work. ARTICLE 6: LANDSCAPE ARCHITECT'S COMPENSATION: The City shall compensate the Landscape Architect, in accordance with terms and conditions of this Agreement, as follows: 1. For the Landscape Architect's basic services as set forth in Article 2, a total fee of SIX THOUSAND, FIVE HUNDRED DOLLARS ($ 6, 500). 2. If City requires any additional services due to changes in the scope of the project from Landscape Architect, Landscape Architect will be paid a sum of 2. 5 times Landscape Architect's direct personnel expense approved by City. 3. For soil test and analysis, if required, maximum fee of Five Hundred Dollars ($500) will be paid by City. 4. For reimbursable expenses, a maximum fee of Five Hundred Dollars ($500) will be paid by City. ARTICLE 7: PAYMENTS TO THE LANDSCAPE ARCHITECT. 1. Payments to Landscape Architect shall be made monthly in proportion to work accomplished by Landscape Architect and shall not exceed the following percentages: a. Upon submittal of Preliminary Design: 35% b. Upon approval of Final Design: 20% c. Upon: submittal of construction documents: 30% d. Upon approval of construction documents: 10% e. Upon acceptance of project by City: 5°fo 5 ~~76 U 2. Payments for reimbursable expenses as outlined in Article 6, paragraph 3 and paragraph 4 shall be made monthly as they are in- curred. ARTICLE 8: TERMINATION OF AGREEMENT OR ABANDONMENT: 1. If the project is suspended for more than three months or abandoned in whole or in part, the Landscape Architect shall be paid his compensation for services performed prior to receipt of written notice from the City of such suspension or abandonment. Together with reimbursable expenses then due and all terminal expenses resulting from such suspension or abandonment, not to exceed Article 6 and Article 7. This Agreement may be terminated by either party upon seven (7) says written notice should the other party fail substantially to perform in accord- ance with its terms through no fault of the other. 2. In the event that a contract for construction of the Project has not been awarded within 180 days of the receipt by the City of the final approved construction documents, Landscape Architect shall be paid the reasonable value of the work performed but not to exceed the amounts as scheduled in Article 7, paragraph 1. ARTICLE 9: OWNERSHIP OF DOCUMENTS: The tracings of the contract drawings and the contract specification master shall become the property of the City when Landscape Architect has been compensated as set forth herein. ARTICLE 10: SUCCESSORS AND ASSIGNS: 1. The City and the Landscape Architect each binds himself, his partners, successors, assigns and legal representatYves of such other party in respect of all covenants of this Agreement. Neither the City nor the Landscape Architect shall assign, sublet or transfer his interest in this Agreement without the written consent of the other. 2. In the event that suit is brought upon this Agreement to enforce its terms, the prevailing party shall be entitled to a reasonable sum as attorney's fees. ~ ~P ~ ~ s ARTICLE 11' HOURLY RATES AND EXTRA WORK: If the City finds it desirable or necessary to cause the Landscape Architect to perform additional services other than those outlined, payment for such will be based on the following hourly rates. Upon approva.L• Landscape Architect (Principal) $ 25.00 Landscape Architect $ 20.00 Job Captain $ 17. 50 Draftsman $ 12.50 Clerical $ 10.00 ARTICLE 12: EXTENT OF AGREEMEATT: This shall constitute the terms and conditions of this Agreement. Any amendments or changes to these terms and conditions shall be made in wirting by the City or Landscape Architect. Signatures below by Landscape Architect and City of Chula Vista shall constitute acknowledgement and acceptance of this Agreement as of the day and year written below.
