RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING THE TENTATIVE MAP OF A SUBDIVISION
TO BE KNOWN AS CHULA VISTA TRACT 75-2
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the Planning Commission of the City of Chula Vista
has heretofore approved that certain tentative map of a subdivision
to be known as Chula Vista Tract 75-2 and has recommended that the
Cit_v Council approve said tentative map subject to the conditions as
recommended in their Resolution No. PCS-75-2, approved on the 25th
day of June, 1975, a copy of which is attached hereto and by this
reference made a part hereof, the same as though fully set forth
herein, and
64HEREAS, the City Council has set the 22nd day of Jul_v,
1975, as the time for a public hearing to consider said tentative
map and notice of said hearing, with its purpose, was given b_y the
publication in a newspaper of general circulation in the City at
least 10 days prior to the date of said hearing.
NOW, THEREFORE, BE IT RESOLVED by the City Council of. the
City of Chula Vista that said Council does hereby approve said ten-
tative subdivision map in accordance with the recommendations of the
Planning Commission of the City of Chula Vista.

SUBDIVISION MAP KNOWN AS PALOMAR GARDEN ESTATES
WHEREAS, Saburo Muraoka submitted a tentative subdivision map to
subdivide 2.5 acres into 24 individual lots developed with 24 attached units
in 8 single story and 4 two-story structures, to be known as Palomar Garden
Estates, and
WHEREAS, Section 66473.5 of the Government Code provides that approval
of a subdivision map shall be based upon findings of consistency between the
subdivision map and the adopted General Plan of the local jurisdiction, and
WHEREAS, the Planning Commission set the time and place far a public
hearing to consider said tentative map, and notice of said hearing, with its
purpose, was given by the publication in a newspaper of general circulation
in the City at least 70 days prior to the date of said hearing, and
WHEREAS, a hearing was held at said time and place, namely 7:00 p.m.,
June 25, 1975 in the Council Chamber, City Hall, before the Planning Commission
.and said hearing was thereafter closed, and
WHEREAS, the Planning Commission certified on May 28, 1975 that Initial
Study IS-74-27 adequately discussed the environmental impact of the rezoning
and development of the subject property and was prepared in accordance with
CEQA 7970, as amended, and the findings therein were considered in reviewing
the proposed tentative map.
NOW THEREFORE BE IT RESOLVED AS FOLLOWS:
1. from facts presented to the Planning Commission, the Commission finds
that the subdivision map known as Palomar Garden Estates is consistent with the
General Plan for the City of Chula Vista as follows:
a. Land Use Element - The proposed density of 9.6 units per acre for
Palomar Garden Estates is consistent with the General Plan designation for this
land at "Medium Density Residential, 4-12 DU/Acre."
b. Circulation Element - The major streets shown on the General Plan
are in place, and with the improvements which will be carried out with this
subdivision of Palomar Garden Estates, will be improved to their ultimate widths.
c. Conservation Element - The project is not shown as an area of con-
cern on the Conservation Element map nor is it discussed under the policies of
the Element. The project location in an already developed area of Chula Vista

minimizes its impact on the natural resources protected by the Conservation
Element.
d. Open Space Element - The only open space near the project is
Castle Park Junior High School. The construction of this project will not impair
the long term existence of that .school site. Internally, the project fulfills the
Open Space policies regarding private open space (Policy #8) by providing adequate
yard areas. The project site is flat, it lies within a developed area and
contains no hillside areas to be preserved.
e. Parks and Recreation Element - There are no parks proposed within
the subdivision due to its small size; however, upon payment of the park in-lieu
fees, the subdivider will have complied with Ordinance No. 1492, which implements
the Parks and Recreation Element. These funds will be used to acquire and improve
park lands within Park Service District 6.05.
f. Seismic Safety Element - The nearest earthquake fault is the Sweet-
water Branch of the La Nacion Fault system and is 2,000± feet to the east. Con-
struction on this site, therefore, should require no extraordinary measures to
make the site and buildings safe from seismic hazards, as required in Policies
No. 6 and 7 of the Seismic Safety Element.
g. Noise Element - The potential noise impact of Palomar Street
traffic on this subdivision will be mitigated by the construction of a 6 foot
solid wall near the northerly property line. A 3 foot high wall will also be
constructed along Second Avenue to mitigate the minor impact from traffic noise
on that street.
h. Safety Element. Required public services, particularly fire and
police services, are established in this area and capable of serving the emergency
requirements of this project. The Emergency Center at Chula Vista High School
and the new Coamunity Hospital are close enough for timely service to the residents
of this project.
i. Scenic Highway Element - No scenic routes are planned on any of the
streets abutting this project. The nearest Scenic Route is Orange Avenue at I-805.
j. Bicycle Routes Element - No bicycle routes are planned on either
Palomar or Second Avenue. .The nearest planned routes are on Hilltop Drive (City
route) and on Naples Street and Third Avenue (County routes).

k. Housing Element - Not yet adopted.
1. Public Buildings Element - Not yet adopted.
2. The Planning Commission recommends to the City Council that Tentative
Map PCS-75-2 for Palomar Garden Estates be approved, subject to the following
conditions:
a. A homeowners association shall be establsihed to maintain the private
drives and landscaped areas between the walls and the street.
b. Garage conversions and parking in the access drive and turn around
areas shall be prohibited in the CC&R's. The documents for both the CC&R's and
homeowners association shall be submitted for City approval prior to approval of the
final map.
c. Private courts shall be constructed of P.C.C.
d. Landscaping:
(1) A landscape and irrigation plan shall be submitted concurrent
with the first application for a building permit. The plan shall include the
areas between the walls and fences and the sidewalks in Palomar Street and Second
Avenue. Approved street trees, 15 gal. minimum size, together with appropriate
shrubs and ground cover shall be utilized in the plan.
(2) An approved 15 gal. tree shall be planted in the front yard of
each lot.
(3) The chainlink fence between the drainage channel and Second
Avenue. shall be planted with an ivy or other climbing vine plant.
e. Walls and Fences:
(1) The two lots adjacent to Palomar shall be screened with a
decorative 6 ft. high masonry wall located 5 feet from the sidewalk.
(2) A 3 ft. high masonry wall shall be constructed along Second
Avenue, as shown on the Precise Plan.
(3) Prior to the issuance of any building permits the applicant shall
submit a design and material list for the construction of interior fencing or
walls. The design of all walls shall be subject to the approrral of the Zoning
Administrator.. Specific location of interior yard fencing shall be limited to the
locations established on the approved site plan and the Precise Plan.
f. Prior to the issuance of building permits, the saebdivider shall
pay the required in-lieu park fees, and shall present letters $rom both school
districts certifying that adequate facilities are available.

- g. Fire protection:
(1) Two fire hydrants shall be required, in locations approved by
the Fire Marshal in conjunction with the improvement plans.
(2) Fire hydrants and water supplies shall be in place prior to the
start of combustible construction.
(3) Fire flow shall be 1,000 gpm, and increased to 1500 gpm if
wood shingles are to be used.
h. All public improvements and private access driveways shall be
subject to detailed approval by the City Engineer and in accordance with the
ordinances, resolution, standard specifications and standard drawings of the City
of Chula Vista. Final map and improvement plans shall. be prepared in accordance
with the subdivision and landscape manuals.
j. The sewer main at Lot 22 shall be jacked under the existing concrete
lined channel. Open excavation and cutting of the concrete lined channel will not
be allowed unless such matters can be resolved to the satisfaction of the Director
of Public Works.
k. The terminus of the sewer main at Lots 4, 10, and 16 shall be as
approved by the Director of Public Works.
1. The sewer repayment connection charge on Second Avenue shall be
paid in accordance with Resolution No. 4362 - $5.9283 per frontage foot plus 4%
per annum beginning January 5, 1967.
m. Fences and/or walls crossing the 12 foot drainage and sewer
easement shall have a gate with a minimum width of 10 feet at each crossing. An
encroachment permit from the Public Works Department is required.
n. A77 utilities services shall be underground. The power transmission
lines along Second Avenue are 69 KVA and 12 KVA. The 12 KVA transmission lines shall
be underground. However, the developer may request a deferral of the undergrounding
requirements of this 12 KVA line.
3. That this resolution be transmitted, along with the tentative map, to
the City Council, and a copy of this resolution be transmitted to the applicant.
