HomeMy WebLinkAboutReso 1975-7838RESOLUTION NO. 7838 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING PRECISE PLAN FOR THAT CERTAIN RESI- DENTIAL DEVELOPDIENT IN THE R-2-T-P ZONE ENCOMPASSING 2.5 ACRES AT THE SOUTHEAST CORNER OF PALOMAR STREET AND SECOPdD AVENUE IN THE CITY OF CHULA VISTA The City Council of the City of Chula Vista does hereby resolve as follows: L+THEREAS, the City Council has heretofore approved the zoning of certain property for residential development into the R-2-T-P zone of approximately 2.5 acres at the 8oty,heast corner of Palomar Street and Second Avenue in the City of Chula Vista, and l°7F3EREAS, in accordance with the requirements of said zone, the property owner has submitted a precise plan, which plan was considered by the City Planning Commission and has been recom- mended for approval by the City Council, subject to the development guidelines as contained in Resolution Pdo. PCA1-75-7. NOLd, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that the precise plan for residential dev- elopment at the southeast corner of Palomar Street and Second Ave- nue be, and the same is hereby approved in accordance with Planning Commission Resolution No. PCM-75-7, which is attached hereto as Exhibit "A" and incorporated herein by reference as if set forth in full. PCM-75-7 RESOLUTION OF 711E CITY PLr^,f1fJING COMMISSION RECOMMEfJDING TO THE CITY COUNCIL THE APPROVAL OF THE PRECISE Pt.AN FOR RESIDENTIAL DEVELOPMENT OF 2.5 ACRES AT THE SOUTHEAST CORNER OF PALOMAR STREET AND SECOND AVENUE WHEREAS, application PCZ-75-D for a change of zone from R-1 to R-2-T-P for 2.5 acres of property located at the southeast corner of Palomar Street and Second Avenue was recommended by the City Planning Commission for adoption, and WHEREAS, Saburo Muraoka submitted a Precise Plan for development of subject property with 24 duplex units in 12 buildings, and WHEREAS, the City Planning Commission, at a regular meeting held at 7:00 p.m.; Wednesday, May 28, 1975, in the Council Chamber, City Hall, 276 Fourth Avenue, considered the Precise Plan for development as submitted by Saburo Muraoka. NOW THEREFORE BE IT RESOLVED AS FOLLOWS: The City Planning Commission finds the Precise Plan, marked Exhibit "A", for development of 24 duplexes on 2.5 acres of property at the southeast corner of Palomar Street and Second Avenue conforms to the General Plan and ordinances of the City of Chula Vista, and recommends approval subject to the following development guidelines: 1. Should the tentative map depart substantially from the layout approved herein, a review of the Precise Plan shall be conducted by the Planning Commission. 2. A homeowners association shall be established to maintain the courts and landscaped areas in the public right of way. 3. Garage conversions shall be prohibited in the CC&R's. 4. Private courts shall be constructed of P.C.C. 5. Landscaping: a. A landscape and irrigation plan shall be submitted concurrent with the application fora building permit. The plan shall include the areas between the walls and fences and the sidewalks in Palomar Street and Second Avenue. Approved street trees, 15 gal. minimum size, together with appropriate shrubs and ground cover shall be utilized in the plan. b. An apps°oved 15 gal. tree shall be planted in the front yard of each lot. c. The chainlink fence between the drainage channel and Second Avenue shall be planted ~~rith an ivy or other climbing vine plant. 6. Walls and Ponces: a. The t4J0 lots adjacent to Palomar shall he Screened w"Ith a 6 ft, high wa17 located 5 feet from the sidewalk, constructed of masonry or other material which provides proper sound attenuation both inside and oul;side the units. b. The 3 ft. high masonry wall shown on Exhibit "A" is approved. c. Prior to the issuance of any building penn~its, the applicant shall submit a design and material list for the construction of interior fencing or walls. Specific location of interior yard fencing shall be limited to the locations established on the approved site plan and the Precise Plan. 7. Architecture: a.
