HomeMy WebLinkAboutAgenda Statement 1976/08/17 Item 09CITY OF CHULA VISTA COUNCIL AGENDA STATEMENT ITEM NO 9 FOR MEETING OF: 8/17/76 ITEM TITLE: Resolution#8293: Approving an Agreement between the City and State for the Construction of Brisbane Street as Part of the State Route 5~1 Freeway Construction SUBMITTED BY Director of Public Works/City Engineer j,~ ITEM EXPLANATION: The State has prepared an agreement for the construction of Brisbane Street between Fourth Avenue and Trousdale Drive. TYiis construction is on the alignment proposed by the City of Chula Vista. The agreement basically calls for the following: 1. The City to acquire tY:e necessary right of way for the construction of Brisbane Street on the new alignment and transfer said right of way to the State. 2. The City agrees to accept relinquishment and full control and main- tenance of Brisbane Street upon receipt of notice of completion of the project from the State. 3. City agrees to bear the additional cost for increased quantities or additional work items above the aggregate cost for work items specified in the agreement. No additional cost is anticipated. 4. The State agrees to prepare the plans, specifications and estimates at no cost to the City. 5. State agrees to construct the project in conjunction with the State's freeway contract for Route 54. The State agrees to furnish the City with a set of as-built plans and to relinquish the project in its entirety to the City. Staff has reviewed the proposed agreement and finds it to be satisfactory. The present status of the right of way to be acquired is as follows (Refer to Exhibit A): 1. Parcel #1 - The parcel has been condemned by the City. However, an agreement has been reached with the property owner for acquisition of the property and actions are now underway to finalize the acquisition. 2. Parcel #2 - Acquired by City. 3. Cole, Director of Public Works Dear Mr, Thompson: Enclosed are four copies of a proposed amendment to the agreement covering participation by the City and State in the acquisition of right of way for the purpose of con- structing the connecting roadways between the Interstate Route 5 Interchange and Tidelands Avenue, As discussed in our letter to you of August 8, 1973, and later in this office with Mr. Cole, the estimated acqui- sition cost to the City has increased from $100,000.00 to $200,000,00. The terms of the original agreement are not changed in any way by the amendment, except for the increased estimate of cost. If the Amendment meets with your approval, please have it executed and return the original and two copies with a copy of the authorizing resolution attached to each. After the Amendment has been executed by the State, a duplicate original and as many conformed copies as you request, will be furnished for your files. All other provisions and conditions of said agreement shall remain in full force and effect.
