RESOLUTION OF THE CITY COiTtdCIL OF THE CITY OF CHULA
VISTA APPROVING PRECISE PLAN FOR DEVELOPMENT OF PALO
DEL AMO APP.RTMENT COT~PLEX AETWEEPI FIRST AVENUE AND
TOBIAS DRIVE, NORTH OF SDG&E EASEMENT, ASdD CERTIFYING
THE D]EGATIVE DECLARATIOP]
The City Council of the City of Chula Vista does hereby
resolve as follows:
VdHERF.AS, the City Council of the City of Chula Vista has
heretofore received the recommendation of the Planning Commission,
as contained in Resolution PIo. PCM-76-14, adopted on the 9th day
of F.ugust, 1976, setting forth the precise plan for the development
of the Palo Del Amo apartment complex between First Avenue and
Tobias Drive, north of SDG&E easement, and
WHEREAS, the City Council of the City of Chula Vista has
heretofore held a public hearing to consider said precise plan on
August 24, 1976 and. has taken testimony and heard evidence thereon,
and
WHEREAS, a notice of the proposed negative declaration on
said precise plan <<ras given in accordance with the Environmental
Review Policy, and
WHEREAS, the Environmental Review Committee found that
said precise plan would have no possible significant impact on
the environment and forwarded the attached L]eaative Declaration,
IS-76-45, to the City Council of the City of Chula Vista for their
consideration, and
6^?HEREAS, said Negative Declaration has been available to
agencies having jurisdiction by law, all responsible agencies, and
to the public for an adequate period of time for their review and
comment, and
WHEREAS, the information contained in said negative declar-
ation has been considered by the City Council of the City of Chula
Vista prior to its action on the discretionary item before the City
Council.
P]OW, THEREFORE, the City Council of the City of_ Chula Vista
finds as follows:
1. That the City Council of the City of Chula Vista adopts
as its record of this finding of no possible significant impact the
Council agenda statement on this agenda item and all of the attach-
ments thereto.
2. That the City Council of the City of Chula Vista finds
in accordance with the recommendation of the Environmental Review
Committee and the attached tegative Declaration that said precise
plan will not have any possible significant impact on the environment,
and the attached Negative Declaration, incorporated herein by refer-
ence as if set_ forth fully, has been prepared in accordance with
the California Environmental quality Act of 1974, as amended.
3. That the Environmental Review Coordinator is hereby
authorized and directed to file said Negative Declaration with the
County Clerk of the County of San Diego subsequent to the prepara-
tion of a notice of determination on this project,

PdOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby adopt the precise plan for the
development of Palo Del Amo apartment complex between First Avenue
and Tobias Drive, north of SDG&E easement as contained in Resolution
No. PCM-76-14 of the Chula Vista Planning Commission,
RE IT FURTHER RESOLVED that no certificates of occupancy
shall be granted until such time as additional sewer facilities
have been completed and adequate sewer capacity to serve said units
has been clearly demonstrated and authorized by the City of Chula
Vista.

F. Findings
1. The project will nut have any significant adverse affect
on human beings, it the project is delayed (or its occu-
` pance) w~til adequate sewer capacity is avail abl c. ,
2. The project will not increase pollutants to a significant
level nor will it result in any impact with tie potential
ko degrade the quality of the environment. There arc no
significant natural resources which mould be directly or
indirectly affected by the project.
3. The project is in conformance with the General Plan and
_ does not achieve short term goals to the disadvantage of
long term goals.

1. The elementary and junior high schools are currently over-
• populated in the subject area and will continue to be so

' 3. The proposed two-story structures (18 feet in height) wi 1.1

tions, as stated in Title 19 of the Municipal Code, should

RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO
THE CITY COUNCIL THE APPROVAL OF THE PRECISE PLAN FOR THE
PALO DEL AMO AI'ARTl4ENT COMPLEY. BFTwEFN FIRST AVENUE ANU
TOBIAS STREET, NORTH OF SDGJSE EASEMENT
WHEREAS, a precise plan for the development of 3.32 acres located between
First Avenue a Tobias Drive, adjacent to the San Diego Gas & Electric Company
~,".. ~ mitted by Norman Starr on July 16, 1976, and
` ~ the City Planning Commission held a public hearing at 7:00 p.m.

-° _ on Monday, August 9, 1976 in the Council Chamber, City Hall to consider the
precise plan for development as submitted, and
WHEREAS, the City Planning Commission found that in accordance with the
findings stated in the draft Negative Declaration on IS-76-45, the proposed
development would have no significant environmental effects.
NOW THEREEORE BE TT RESOLVED THAT THE CITY PLANNING COMMISSION finds as
follows:
a. That such plan will not, under the circumstances of the particular case,
be detrimental to the Health, safety or general welfare of persons residing or
working in the vicinity, or injurious to propert}~ or improvements in the vicinity.
The proposed plan concentrates the buildings away from the adjacent uses
and the recreational uses will be required to be screened by buildings or
moved to a location away from the adjacent uses.
b. That such plan satisfies the principle for the application of tfie "P" Modifying
District as set forth in Section 19.56.041.
The proposed development satisfies the principles as set forth by the Code
and the guidelines proposed for the rezoning of the property.
c. That any exceptions granted which deviate from the underlying zoning require-
ments shall be warranted only when necessary to meet the purpose and application of
the "P" Precise Plan Modifying District.
The proposed development exceeds or meets the requirements of the Code.
d. That approval of this plan will conform to the General Plan and the adopted
policies of the city.
The proposed land use is in conformance with the General Plan designation for
the area and with the adopted policies of the City.
BE IT FURTHER RESOLVED that the City Planning Commission recommends to the
City Council the approval of the Precise Plan for the project known as Palo Del Amo,
subject to the following conditions:
1. The exterior colors of the buildings shall either be left natural or painted
or stained with earthtone colors.
2. The accessary building shall be architecturally compatible with the apart-
ment structures and shall be moved to the north of the pool area. The
building shall maintain a 15 ft. setback from the north property line.
3. Landscaping and irrigation plans in accordance with the Landscape P1anual
of Chula Vista shall be submitted prior to application fora building
permit.
4. An emergency access drive, paved with a hard surface, at a width acceptable
to the Fire Department, shall be provided in the middle of the project or
along the southerly property line. If located in the middle it shall not
be excessively serpentine in design, and 'if located adjacent to the property
/ line the structures shall maintain a minimum setback of 3 feet from the
access drive.
5. The tot lot play area shall be located closer to the center of the complex
to reduce the effect of noise on adjacent residents.
6. The easterly parking area shall contain a minimum of 1G spaces.
7. All signs shall conform to the Municipal Code.
