HomeMy WebLinkAboutReso 1976-8268Revised 8/3/76 RESOLUTIONI N0, 8268 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AMENDING RESOLUTION N0. 8115 IMPOSING A LIMITED MORATORIUM UPON THE ISSUANCE OF BUILDIAIG PERP4ITS WITHIN A PORTION OF THE CITY OF CHULA VISTA The City Council of the City of. Chula Vista does hereby resolve as follows: WHEREAS, the City Council has heretofore imposed a limited moratorium upon the issuance of building permits upon certain pro- perties within the proposed Town Centre Redevelopment Project Area in order to complete the preparation of the redevelopment plan and design manual for said area, and WHEREAS, at the time of. the adoption of said moratorium, no specific plans or projects, which would appear highly desirable in carrying out the purpose of the redevelopment area, were known to the City Council, and [~?HEREAS, in the absence of such plans or projects, the Council exempted that certain project previously approved by City Council Resolution No. 7947 and indicated that building permits could issue for said project, and [aHEREAS, the Redevelopment Agency of the City of Chula Vista will consider, at its meeting of Thursday, August 5, 1976, a negotiation agreement for the redevelopment of a significant portion of land including that area wherein the project has been approved by Council Resolution No. 7947, and [^IHEREAS, it is, therefore, now necessary both in the interests of the fulfillment of the redevelopment plan and the pro- tection of the property owner to eliminate the exemption of said property from the moratorium and deny the issuance of a building permit to and until midnight August 5, 1976. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of_ Chula Vista that Section 3 of Resolution No. 8115, which reads as follows: "Section 3. Building permits may be issued for that certain project approved by Planning Commission Reso- lutions Nos. PCM 75-22 and PCM 76-16(A) and City Council Resolution No. 7947. This section shall not be construed to waive, modify or alter any applicable ordinance, rule, regulation or policy of the City." be, and the same is hereby rescinded and the moratorium established by Resolution No. 8115 be, and the same is made applicable to said property.
