RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING TENTATIVE SUBDIVISION MAP OF ZENITH IV,
AND CERTIFYING THE NEGATIVE DECLARATION
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the Planning Commission of the City of Chula
Vista has heretofore approved that certain tentative map of a sub-
division to be known as Zenith IV and has recommended that the
City Council approve said tentative map subject to the conditions
specified in Planning Commission Resolution PCS-76-5, approved the
28th day of June, 1976, a copy of which is attached hereto and by
this reference made a part hereof, the same as though fully set
forth herein, and
WHEREAS, a notice of the proposed negative declaration on
the tentative subdivision map of Zenith IV was given in accordance
with the Environmental Review Policy, and
WHEREAS, the Environmental Review Committee found that
said tentative subdivision map would have no possible significant
impact on the environment and forwarded the attached Negative Decla-
ration, IS-75-15, to the City Council of the City of Chula Vista
for their consideration, and
WHEREAS, said Negative Declaration has been available to
agencies having jurisdiction by law, all responsible agencies, and
to the public for an adequate period of time for their review and
comment, and
WHEREAS, the information contained in said negative declar-
ation has been considered by the City Council of the City of Chula
Vista prior to its action on the discretionary item before the City
Council.
NOW, THEREFORE, the City Council of the City of Chula Vista
finds as follows:
1. That the City Council of the City of Chula Vista adopts
as its record of this finding of no possible significant impact the
Council agenda statement on this agenda item and all of the attach-
ments thereto.
2. That the City Council of the City of Chula Vista finds
in accordance with the recommendation of the Environmental Review
Committee and the attached Negative Declaration that the approval of
the tentative subdivision map of Zenith IV will not have any possible
significant impact on the environment, and the attached Negative
Declaration, incorporated herein by reference as if set forth fully,
has been prepared in accordance with the California Environmental
Quality Act of 1970, as amended.
3. That the Environmental Review Coordinator is hereby
authorized and directed to file said Negative Declaration with the
County Clerk of the County of San Diego subsequent to the prepara-
tion of a notice of determination on this project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista that said Council does hereby approve said ten-
tative subdivision map in accordance with the recommendations and
findings of the Planning Commission of the City of Chula Vista.

RESOLUTION OF THE CITY PLANNING COMMISSION
RECOMMENDING TO THE CITY COUNCIL THE APPROVAL OF
THE TENTATIVE SUBDIVISION MAP KNOWN AS ZENITH IV
WHEREAS, Robinhood Homes submitted a tentative subdivision map to subdivide
3.8 acres into 72 single family residential lots and one open space lot, for a
total of 13 lots, the proposed subdivision being located at the southwest quadrant
of East Palomar Street and Oleander Avenue, and
WHEREAS, Section 66473.5 of the Government Code provides that approval of
a subdivision map shall be based upon findings of consistence between the subdi-
vision map and the adopted General Plan of the local jurisdiction, and
WHEREAS, the Planning Commission set the time and place for a public hearing
to consider said tentative map, and notice of said hearing, with its purpose,
was given by the publication in a newspaper of general circulation in the City
at least 70 days prior to the date of said hearing, and
WHEREAS, a hearing was held at said time and place, namely 7:00 p.m., June
28, 1976 in the Council Chamber, City Hall, before the Planning Commission and
said hearing was thereafter closed, and
WHEREAS, the Commission found that in accordance with the Negative Declara-
tion on IS-75-15 znd the findings stated therein, this project will have no sig-
nificant adverse environmental impacts.
NOW THEREFORE BE IT RESOLVED AS FOLLOWS:
1. From facts presented to the Planning Commission, the Commission finds
that the subdivision map known as Zenith IV is consistent with the
General Plan for the City of Chula Vista as follows:
a. Land Use Element - The General Plan was amended on May 20, 7975
designating this area for development as medium density residen-
tial use (4-12 DU/Ac.). Therefore, the proposed development is in
conformance with the General Plan.
b. Circulation - The proposed project will complete the extension of
East Palomar Street and Oleander Avenue in the alignment indicated
on the General Plan.
c. Housing Element - The proposed project will provide additional
decent housing and also provide residents of Chula Vista a choice
in living accommodations in a stable residential neighborhood.
d. Conservation, Open Space, and Parks and Recreation Elements -
The City Council has amended the General Plan deleting this area
from designated open space.
e. Seismic Safety - The closest geological hazard to the proposed
project is an inferred fault some 1400 feet to the west and the
La Nacion earthquake fault some 2000 feet to the east (see IS-75-15).
f. Safety Element - The proposed project will extend needed public
improvements providing the necessary linkage with developments north,
south and west of the subject site, and provide fire hydrants in
conformance with City standards.
g. Noise Element - The proposed project will not result in the
- generation of any noise pollution, nor will it be subject to
any unacceptable levels of noise because of the distance from
I-805 and the installation of barriers in the Zenith II subdivi-
sion (see IS-75-15).
h. Bicycle Routes Element - The proposed project is not required to
provide a bicycle route nor will it result in the interference
of continuity of any proposed route.
i. Public Building Element - The proposed project will not result in
the relocation of any existing or proposed public facilities.
2. The Planning Commission recommends to the City Council that Tentative
Map PCS-76-5 for Zenith IV be approved, subject to the following con-
ditions:
a. Prior to Council consideration of the tentative map, the subdivider
shall submit letters to the City with copies to the school dis-
tracts, indicating that the district requirements to insure ade-
quote school facilities will be complied with by the subdivider
prior to the issuance of any building permits.
b. Concurrent with or prior to submission of the final map, the
subdivider shall petition the City to form an Open Space Main-
tenance District over the slopes adjacent to East Palomar Street
on Lots 7, 8, 10 and 71. The assessments to fund the maintenance of
these areas shall be spread over all 104 lots of Zenith II, III
and IV subdivisions.
c. Lot 13 shall be deeded to the City of Chula Vista for park purposes.
d. Landscaping and irrigation - The areas to be landscaped can be
divided into .three categories:
(1) The area between the required building wall and the sidewalk
adjacent to East Palomar Street will be included in the Open
.Space haintenance District and, therefore, landscaping shall
be coordinated and consistent with other landscaped areas in

The District. The area shall be planted, irrigated and maintained
as follows:
(a) Landscaping - Ground cover required to assist in erasion
control together with street trees and dense shrubbery
planting. All material shall be installed in accordance
with the Ctiy's grading ordinance and Landscape Manual.
(b) Irrigation - The irrigation shall be an automatic system
designed in accordance with the City Landscape hlanua7.
(c) Maintenance - The subdivider shall be responsible for the
maintenance fora period of one year from the date of ac-
ceptance. Work will be inspected at the end of one year by
the City's Landscape Architect to determine whether or not
satisfactory growth has occurred. If accepted, the area
will be turned over to the Open Space Maintenance District;
if not, the period of maintenance by the subdivider may be
extended by the Planning Commission.
(2) The slopes contained on Lot 73 and those located on City park
land (including area east of Oleander) shall be planted, irri-
gated and maintained as follows:
(a) Landscaping - Ground cover to provide for erosion control
together with dense planting of shrubs and trees. All
material to be installed in accordance with the City's grading
ordinance and Landscape Manual.
• (b) Irrigation - The irrigation system shall be designed as a
temporary system to be removed at the end of the designated
maintenance period.
(c) Maintenance - The subdivider shall be responsible for the
maintenance fora period of two (2) years from the date of
acceptance. Work will be inspected periodically. At the
end of two years the City's Landscape Architect will deter-
mine whether or not satisfactory growth has occurred in or-
der to relinquish maintenance to the City. If the project is
accepted the maintenance responsibility for the area will be
assumed by the City; if not, the period of maintenance by the
subdivider may be extended by the Planning Commission.
(3) The remaining manufactured slopes within the development
shall be landscaped and irrigated in accordance with the
City's Landscape Manual. Maintenance shall be guaranteed
for the standard one year period.
e. Fences and walls
(1) Concurrent with the submission of landscaping and irrigation
plans, the subdivider shall submit a design for a 5 foot
high, solid, decorative block wall located adjacent to East
Palomar Street in accordance with the wall design approved
for Zenith II and III. The wall shall be located at the top
of slope or a minimum of 10 feet inside the sidewalk.
(2) A solid fence shall be erected adjacent to the City park
b the south of the subdivisjon and along the north property
line of Lot 13. The fence shall be a minimum of 4 feet and a
a maximum of 6 feet in height. The height of the fence shall
not exceed 3-1/2 feet along the most easterly 15 feet of Lot
13.
f. Fire Protection
(1) Fire Flow
Fire flow shall be 7000 GPM for two hours duration. If
wood shingles are used as roof covering, fire flow shall be
1500 GPM for two hours duration. Fire flow shall be minimum
20 PSI residual pressure measured in the main from which the
flow is taken at the time of measurements.
(2) Fire Hydrants
The number, type and location of fire hydrants shall be de-
termined by the Chula Vista Fire Department.
Three fire hydrants will be required. Type of hydrant shall
be wet barrel with one 2-1/2" and one 4" outlet. Installa-
tion shall be in accordance with standard specifications.
(3) All water supplies for fire protection, including fire hydrants,
shall be provided and maintained, rp for to any combustible
construction being commenced on the site. Sec. 13.301 (d) U.F.C.
(4) Any work being done contrary to the provisions of the Uniform
Fire Code shall be subject to issuance of "Stop Work Order."

g. Engineering
(1) There shall be a minimum 175 foot crest vertical curve and
a 200 foot sag vertical curve on Oriole Court to provide
for safe stopping sight distance. If a street light is
positioned at the sag, a 100 foot vertical. curve will be
acceptable.
(2) Final map and improvement plans for Zenith IV shall not be
approved prior to the approval of the final map and improve-
ment plans for Zenith II and Zenith III.
(3) The developer shall be responsible for the removal and re-
placement of existing improvements on Oleander Avenue as
determined by the City Engineer outside the southerly boundary
line of Zenith IV.
(4) Paved access shall be provided to all sewer and drainage
manholes located outside of dedicated streets. All necessary
easements shall be granted on the final map.
(5) The developer shall be responsible for the construction of
storm drain facilities adjacent to and within his subdivision.
The drainage facilities shall be compatible with future de-
velopment east of Oleander Avenue. The developer shall be
responsible for bearing the entire cost of constructing the
storm drain in Oleander Avenue except for the easterly 35
feet. The City will be responsible for the easterly 35
feet of the storm drain, including permanent headwall and
wingwalls. The City and the developer shall enter into an
agreement prior to or concurrent with approval of the final
map, which provides for the City's participation in the
drainage improvements. The developer will be responsible
for constructing a 6 foot wide concrete lined drainage swale
between the inlet to the storm drain crossing beneath the
I-805 freeway and the storm drain outlet at the southerly
boundary of the subdivision.
(5) The developer shall comply with all sections of the Chula
Vista Municipal Code which apply and are in effect on the
date the City Council approves the tentative map. Prepara-
tion of the map and improvement plans shall be in accordance
with provisions of the Subdivision Manual.
3. That this resolution be transmitted to the City Council, and a copy of
this resolution be transmitted to the applicant.

be impacted by the project. The impacts of the project implementation
trill be fully mitigated by standard development regulations and requirements.
The proposed project conforms to the long range goals of the City
of Chula Vista and therefore trill not achieve short term to the disad-
vantage of long term goals.
There are no impacts on separate resources trhich interact or cumulate
to a siynificant level. The site is generally void of any significant
resource.
Residents of the project will not be subject to any impact from air
quality or noise due to I-205 because of the distance involved and the
installation of barriers in the Zenith II subdivision.

1. Pro.iect Setti
The project site is located at the south o-rest corner of the future
intersection of East Palomar and Oleander, approximately 500' east of I-E05.
The site has an average natural slope of 169' with the highest elevation at
the north west corner and i'alliny to a natural drainaye course a.t the
southeast corner of the site.
The soils report submitted with the application indicates there are no
soil characteristics ~:rhich vrill cause any serious problem in the develop-
ment of the site. There are w~compacted fill materials and alluvial
soils at the extrer.,e southeast corner of the property vrhich can be

nearest geological hazard is the La (lacier fault over '2 mile to the east.
. The location close to I-~05 vrill result in a higher noise level and air
pollution levels than in areas further removed from the freevray.
The biological survey for the Zenith II subdivision indicates there are
no rare or endancered animal or plant species on tide site. There is a

3. Environmental Impact Analysis
3.1 Hydrology
There is no ground grater nor flood plain present. There Drill be no
increase in runoff due to this project.
3.2 Land Form
The land form ~-rill be substantially altered but given the height of the
man-made slope, all impacts due to aesthetic consideration erosion or
siltation can be fully mitigated through standard development regulations.
3.3 Air Quality
Due to the limited VPiT associated Frith this project, there i~rill clearly
no significant ir~,pact. The highest one hour concentration of CO in
Chula Vista has been .19, the Zenith II EIR found that the highest one
hour concentration (under vrorst possible conditions) of CO from the
freearay o-rould be 3.5 ppm. The combination of these factors (22.5 ppm)
~•rould not violate the Federal primary one hour standard of 35 ppm.
3.4 plater Quality
Due to the utilization of the seti•rer system, and the lack of increase in
runoff ~~rill not result in any impact on crater quality.
3.5 hloise
There o-rill be little increase in the a~l6ient noise level and the barrier
to the cons ti°ucted t•rith Unit II of Zenith, there gill be no significant
" impact from I-205.

3.7 Energy
