RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA GRANTING APPEAL AND ADOPTING CONDITIONS FOR
THE INSTALLATION OF POOL TABLES IN RESTAURANT AT
937 OTAY LAKES ROAD IN CAN ZONE (PCC-76-8, JACK
BLAKELX)
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the Planning Commission of the City of Chula Vista
has heretofore denied the application of ?4r. Jack Blakely to install
two pool tables in the restaurant at 937 Otay Lakes Road in the C-N
zone, and
WHEREAS, the denial of said application was based upon the
detrimental effect to the surrounding neighborhood, and
WHEREAS, the City Council has heretofore on July 6, 1976
conducted a public hearing on the appeal of said decision of the
Planning Commission, and
WHEREAS, the City Council has determined based upon the
testimony and evidence received at said hearing that subject to
certain conditions as set forth hereinafter, that the installation
of two pool tables in said restaurant at 937 Otay Lakes Road in the
C-N zone would fully meet the findings as required under the condi-
tional use permit procedure.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula vista that the appeal of Jack Blakely be, and the same
is hereby granted and conditional use permit PCC-76-8 be, and the
same is hereby issued subject to the following conditions:
1. The restaurant operation shall be reviewed by the
Planning Commission in one year to determine if the circumstances
and character of the restaurant have changed. The Planning Com-
mission will forward their recommendation to the City Council for
appropriate action.
2. The property owners within 300 feet of the applicant's
shall be notified 10 days prior to review by the Planning Commission.
3. The Planning Department shall periodically review the
operation and report to the Planning Commission any change in charac-
ter of the establishment.
4. The pool table area shall be separated from the main
dining area by a floor to ceiling solid partition. The partition
shall extend from the office to a point 6 feet from the restroom
wall with openings allowed at each end for access.
5. The pool table area shall be acoustically designed to
minimize the impact of the noise generated by the activity of the
main dining area.
