HomeMy WebLinkAboutReso 1976-8249RESOLUTION N0. 8249 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA DEEDING CERTAIN PROPERTIES TO SHATTUCK CON- STRUCTION COMPANY The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City of Chula Vista has heretofore acquired through eminent domain land necessary for an extension of East J Street to service South Bay Villas Subdivision, and WHEREAS, said right of way was acquired as an extension of the transportation network in the City of Chula Vista, and WHEREAS, certain remnant parcels were acquired by the City of Chula Vista to minimize the severance damages in the acquisi- tions, and WHEREAS, Shattuck Construction Company, in compliance with the conditions on the tentative subdivision map for South Bay Villas, shall deed to the City the East J Street right of way in accordance with said map. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that those properties set forth on Exhibit A, attached hereto and incorporated herein by reference as if set forth fully, are deeded to Shattuck Construction Company, a California cor- poration, as per the terms of the grant deed set forth as Exhibit A. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby directed to execute said Grant Deed on behalf of the City of Chula Vista. BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be, and she is hereby directed to transmit said attached Exhibit A to Shattuck Construction Company for purposes of acceptance of said grant deed and recordation. Grantor hereby reserves from said grant an easement for street right of way purposes including, but not limited to, emplacement of public improvements, creation of slopes, drainage structures and utilities and all incidental purposes thereto provided that said easement upon the land described below shall terminate upon the recordation of a final subdivision map of that development known as South Bay Villas, Unit No. 2.
