RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA ESTABLISHING A PERMANENT RATE SCHEDULE FOR
POLICE REQUESTED TOWING SERVICES AS CONTAINED IN
RESOLUTION N0. 7837, APPROVED ON JULY 29, 1975
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the City Council of the City of Chula Vista has
heretofore adopted Resolution No. 7837 on July 29, 1975 for a period
of one year, which resolution contained a rate schedule for police
requested towing services, and
WHEREAS, in accordance with the provisions of said reso-
lution, the Council has reviewed the previous rate schedule.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista that the rates scheduled for police requested
towing services as contained in Resolution No. 7837, adopted on
July 29, 1975, be made permanent as set forth in Exhibit "A",
attached hereto and made a part hereof by reference as if set forth
in full, until such time as amended by the City Council.

GENERAL PROVISIONS
1. The above rates are for towing passenger vehicles, 1/2 and 3/4 ton trucks, empty.
A vehicle shall be considered empty if the load does not exceed fifty percent of
capacity.
2. Towing loaded trucks or campers having a rated load capacity of 1/2 ton to one ton
shall pay one and one-half times the basic rate. A vehicle shall be considered
loaded if the load exceeds fifty percent of capacity.
3. Vehicles having a rated load capacity of one ton or more shall, when towed by a
tow truck having a rated load capacity of 1 1/2 tons or less, pay one and one-half
times the basic rate set forth in (towing-accident) and (towing non-accident) above.
4. When the Contractor is not equipped with a heavy duty tow truck, the Police Depart-
ment may dispatch any tow truck available.

5. Each tow service shall keep a record of the vehicle and licei„a r,wnbers; date and
time it was towed and location from which it was towed; the charges against the
vehicle and the disposition. These records will be retained fora period of at
least two years.
6. The owners of tow car companies participating in towing assignments by the Police
Department, shall be responsible for the acts of their employees while on duty.
Towing companies shall be responsible for damage to vehicles while in their pos-
session. No items or articles shall be removed from stored vehicles without
notification to the Police Department and specific authorization therefor.
7. Storage rates shall be based upon full twenty-four (24) hour increments regardless
of the actual duration that a vehicle is impounded, e.g., if a car is towed in at
5:00 p.m. and redeemed in less than 24 hours, one day's storage will be charged.
8. The "three mile minimum" distance, being the rate base for towing services, shall
be measured from the location of the pick up to the location of storage.
9. It will be the responsibility of tow operators to sweep up at the scene without
any extra charge. Extra charges at the scene will only take place when the tow
operator has been there in excess of 15 minutes.
10. The following guidelines will prevail when determining night rates for towing or
for the releasing of vehicles and property during non-business hours:
WEEK DAYS AFTER 5:30 P.M. - 7:30 A.M.
SATURDAYS AFTER 12:00 P.M.
