ITEM TITLE Resolution 8463: Approving Encroachment Permit for Standlee's
Party Cakes at 275 Third Avenue

ITEM EXPLANATION
Standlee's Party Cakes, which is located within the Town Centre Redevelopment
project, is proposing to remodel their store front with a brick veneer and
a tiled arch entry. The tiled arch entry as proposed will encroach into the
public right of way 18". The brick veneer, which is to be added to the
store front, will encroach 5".
The face of the building presently lies along the property line. Since the
addition of any fascia upon the front of the building will encroach into
the public right of way, the Chula Vista Municipal Code requires that the
property owner obtain an encroachment permit, which must be approved by the
City Council.
This is the first request for an encroachment permit into the public right
of way in the Town Centre area. Since many buildings are adjacent to the
public right of way, it can be expected that many more such requests will
be submitted. At the present time the Design Review Board has not been
formally established; therefore the review for this encroachment permit has
been accomplished at the staff level. Also, the Town Centre Design Planual
is silent in regard to encroachments. Therefore, staff was not guided by
any adopted or reviewed criterion concerning encroachments into the public
right of way.

In a joint meeting between Redevelopment, Planning and Engineering, it was
decided that the paramount factor for consideration of encroachments into
the right of way in the Town Centre area be safety and the maintenance of
adequate sidewalk space for pedestrians. Applying these criterion to the
instant case, it was decided to recommend approval for this encroachment.
It is staff's judgment that the 18" encroachment will not create a safety
problem and it was determined that the clear space between the encroachment
and the nearest sidewalk obstruction (in this case a fire hydrant) will be
9-1/2 feet. This distance will be adequate for two sets of two persons to
pass each other on the sidewalk.
The staff is presently working on the development of criteria for en-
croachments and will provide recommendations to the Design Review Board
and the Redevelopment Agency in the near future.
A transparency is available for Council viewing.
COUNCIL ACTION
Staff instructed to incorporate measures in the Design Manual for the
Town Centre Redevelopment Project to accommodate matters similar to this
in the future, and that future requests for encroachments of this sort
be referred to the Town Centre Project Area Committee prior to being
forwarded on to the Council.
