ITEM TITLE: Resolution 8448: Intention to Vacate Public Right of Way at the
Northeast Corner of Bonita Road and Willow Street

ITEM EXPLANATION:
Foodmaker, Inc. has requested the vacation of a portion of the public
right of way at the northeast corner of Bonita Road and Willow Street
which is adjacent to their new site for a Jack-in-the-Box fast food restau-
rant.
The Engineering Division has reviewed Foodmaker's request and feels that
it is appropriate to consider vacating this portion of the public right
of way because:
1. The right of way is in excess of what is required to provide for
the construction of full ultimate street improvements at this location in
accordance with approved plans on file in the office of the City Engineer.
A separate right turn lane at the northeast corner will be constructed.
2. That the public interest would be served by vacating this portion
of the public right of way since the new intersection is better suited
for existing and future traffic movements.
3. Public utilities have been notified and have no objection to
the street vacation provided easements are retained for their facilities.

STAFF RECOMMENDATION:
City Council set the date of January 11, 1977 at 7:00 p.m. in the City
Council Chambers to conduct public hearing on the vacation of a portion
of public right of way at the northeast corner of Bonita Road and Willow
Street.
BOARD/COMMISSION RECOMMENDATION
Planning Commission, on November 22, 1976, recommended approval of
Foodmaker, Inc. request to vacate a portion of the public right of way
in the northeast corner of Bonita~Rl~B~ ~® 611i~18w Street.

the portion of public right of way to be vacated. Upon vacation of the
right of way, the property will revert to and become the property of Food-
maker, Inc.
The State of California Streets and Highways Code requires that a public
hearing be held prior to the vacation of any dedicated street.
A transparency is available for Council viewing.

Subject: Request for vacation of public right-of-way at the
northeast corner of Willow Street and Bonita Road
At the meeting of November 22, 1976 the City Planning Commission
considered a request submitted by Foodmaker, Inc. for the
vacation of a portion of the public right-of-way at the north-
east corner of Bonita Road and Willow Street.
Based on the finding that the existing right-of-way is in
excess of what is required to provide for the construction of
full and ultimate street improvements at this location in
accordance with plans on file in the office of the City Engineer,
and that the public interest would be served by vacating this
portion of the public right-of-way, the Planning Commission
recommends that the area delineated on the attached plat be
vacated and allowed to revert to and become the property of
Foodmaker, Inc.
