Fulasz, CMC -~I-r City Clerk c'~a"' `: 276 Fourth Avenue m a w Chula Vista, CA 92010 Dear Ms. Fulasz: This is in response to your letter of December 21, 1976, concerning the City Council's Resolution No. 8443 regarding the selling of in- formation from the Department of Motor Vehicles' records. r., _,' As you may know, the records of the Department of Motor Vehicles, generally, are officially classed as public records and as such are open to public inspection. The only exceptions are records pertaining to the physical or mental condition of drivers. Furthermore, the Vehicle Code provides for the sale of releasable information from these records by the department. The problem of availability of such records has been one of great concern to the Legislature for several years. Repeatedly, prohibit- ing legislation has been introduced but failed to pass. In defense, the legislators are faced with the dilemma between a segment of the population which feels all government records should be open to public inspection and the other segment which wants them confidential. The action which your City Council has taken of protesting this practice to the members of the State Legislature appears to be the most appro- priate way to make your views known. As long as the records of the Department of Motor Vehicles are public records, the department does not have the authority to stop the sale of these records. preciate your concern and hope this explanation is sufficient.
