BACKGROUND 1. The applicant requested approval of a precise plan for the development of 60 apartment units on a 4 acre site, currently in the R-1 zone, subject to favorable action by the Council to rezone the property to R-3-P-17. 2. The Environmental Impact Report (EIR-76-6) on this project was adopted by the Planning Commission on November 8, 1976, and forwarded to Council on November 11, 1976. B. ANALYSIS 1. Site characteristics. The project site is a 4 acre parcel of land which is land-locked, lying to the east of Phase I of East Orange Plaza, an existing apartment complex developed and owned by the applicant, and west of an existing neighborhood shopping center. The topography slopes down to the north to a planned unit development and to the south to another vacant parcel bor- dering on East Orange Avenue. The lot has a change of elevation ten feet or more from west to east with a large mound of earth toward the west end. Precise Plan proposal. The applicant proposes to construct 40 two bedroom (947 sq. ft.) and 20 three bedroom (1219 sq. ft.) apartments for a total of 60 dwelling units on the site. The apartments are all two stories and grouped in 7 buildings. Additionally, common facilities are proposed within a center mall which includes a 2-story recreation building and swimming pool. Four carport structures with space for 10 vehicles each are located along the exterior side of the circulation loop surrounding the development. These buildings have been sited to serve as visual and acoustical screening for the living units. 3. Architecture. The applicant proposes use of the same architectural style and character as the adjacent Phase I of East Orange Plaza. Exterior materials will include plaster, wood siding and extensive wood trim. The buildings will be, for the most part, flat roofed with sloping wood shingled roofs for accent over central portions of the building and over porches. The building masses are broken with changes in wall line, fences and architectural projections. A revised grading plan will also result in a change in elevations within the building. 4. Parking. Proposed parking combines 40 covered spaces and 82 open parking stalls clustered along a peripheral drive fora total of 122 spaces. All spaces, with the exception of those adjacent to the shopping center, require backing into the peripheral drive and will necessitate controls to prevent parking which would block these spaces, such as "no parking" signs, curbings painted red, or a combination of these techniques. 5. Landscaping. Final landscaping plans and details will need to be submitted for approval of the City Landscape Architect. Permanent irrigation will be required for planted slopes as well as landscaping within the building complex. In locating trees adjacent to driveway areas, care shall be taken that no trees or tall shrubs will interfere with sight lines for automobile traffic, particularly at major egress-ingress points to the project and at driveway angles. A combination of landscaping and retaining walls to match the building decor will be needed on the east end of the project to screen the easterly facing units from the shopping center activities. RESOLUTION N0. PCP1-76-24 RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL THE APPROVAL OF THE PRECISE PLAN FOR DEVELOPMENT OF EAST ORANGE PLAZA PHASE II WHEREAS, application PCZ-76-M far a change of zone from R-1 to R-3-P-17 - for approximately 4 acres located north of East Orange Avenue, west of Melrose, was submitted by Celia Seligson on September 3, 1976, and WHEREAS, a Precise Plan for the development of 60 apartment units designated as East Orange Plaza Phase II on the subject property was submitted on November I, 1976, and WHEREAS, an Environmental Impact Report (EIR-76-(0) on the project was adopted ty the Planning Commission on November 8, 1976, and WHEREAS, the City Planning Commission, at a duly advertised public hearing held at 7:00 p.m., Monday, November 22, 1976, in the Council Chamber, City Hall, 276'Fourth Avenue, considered the Precise Plan for development as submitted. NOW THEREFORE BE IT RESOLVED THAT THE CITY PLANNING COMMISSION finds as follows: a. That such plan will not, under the circumstances of the particular case, be detrimental to the health, safety and general welfare of persons residing or working in the vicinity, or injurious to the property or improvements in the vicinity. The project is within the density permitted in the zone and is, for the most part, well separated from adjacent uses. The design and type of residential use is compatible with adjacent uses and is an extension of an existing development which will conform to all applicable codes, ordinances and regulations. b. That such plan satisfies the principle for the application of the "P" Modifying District as set forth in Section 19.56.041. The subject property has access problems which make it difficult to develop as well as having problems related to the configuration. Also, the property's location with respect to an existing shopping center has required special solution for access and for screening from commercial uses. c. That any exceptions granted which deviate from the underlying zoning requirements shall be warranted only when necessary to meet the purpose and application of the "P" Precise Plan Modifying District. No major exceptions to the underlying zoning ordinances are contained in this proposal. d. That approval of this plan will conform to the General Plan and the adopted policies of the City. The plan and the land use proposed are compatible with the General Plan. BE IT FURTHER RESOLVED that the City Planning Commission recommends to the Ct ty Council the approval of the Precise Plan for the project known as East Orange Plaza Phase II, subject to the following conditions: 1. Final plans indicating grading, drainage and landscaping shall be submitted for approval prior to issuance of bu i.}d ing permits. A ~~ -~ grading permit will be required. 2. Final plans shall indicate circulation details onsite and within access easements (pavement widths, curbs, medians, etc.) along with sufficient dimensions and details to indicate a development with good traffic flow and adequate access for emergency vehicles. 3. Parking shall be controlled by means of "no parking: signs or other devices acceptable to the Public Works Department so that parking does ... not encroach into required driveways or backup space. 4. Final grading plan shall indicate all required retaining walls, steps and other transitions between various dwelling units and open areas without excessive or hazardous slopes. A decorative retaining wall near the east end of the project shall be coordinated with the landscape plan to screen the easterly facing units. 5. The applicant shall comply with all requirements of the Fire Department, including but not limited to the following: a. A water works plan shall be submitted for review and approval and shall indicate all valves, hydrants, mains, connections, etc. b. Four fire hydrants will be required, in locations designated by the Fire Department. c. Fire hydrants shall be installed and in operable condition, and access drives shall be constructed and maintained in a passable ~ , condition prior to any combustible construction being conmenced on the site in conformance with Section 13.301 (e) of the Uniform Fire Code. 6. A geologist shall be present during grading operations and shall report upon the presence of any earthquake fault traces discovered on the site and upon the stability, both for earthquakes and vertical loading. of the soil on the site which contains material from uncontrolled filling of the site. 7. The location of accessory structures shall be coordinated with the openings between buildings to help attenuate noise levels from offsite sources, particularly from East Orange Avenue. _Z_ 8. Prior to forwarding the Precise Plan proposal to the City Council, the applicant shall submit a revised site plan and/or architectural elevations addressing the following specific concerns: a. A grading plan shall indicate the means proposed to reduce or eliminate abrupt changes in elevation from west to east, such as stepping buildings and reducing slopes facing north and south through creation of a more uniform slope. b. Building A shall be redesigned or the driveway relocated to provide adequate setbacks at either end from the driveway. c. Adequate separation from the easterly property line at Building A shall be provided to permit a combination of earth mounding and low guard wall. d. Adjustments in building location and a mix of units shall be made to maximize additional buildable space gained from a flatter grading of the site. e. Wherever possible, the revised site plan and/or architectural elevations shall incorporate conditions of approval in this resolution.
