BACKGROUND 1. The applicant, Ken Green dba Sweetheart Construction Company, has submitted a tentative subdivision map, known as Sweetheart Manor, proposing to subdivide 1.95 acres of undeveloped land, with the exception of one existing residence which will remain, into 13 residential lots, including a lot for the existing residence. The proposed subdivision lies at the northeast corner of the intersection of Tobias Drive and Quintard Street. 2. On August 31, 1976 the City Council approved the rezoning of this site from R-3-G-P to its present zoning of R-1-5-P, single family residential. 3. Environmental Impact Report EIR-76-1A, related to this project, was certified by the Planning Commission on June 28, 1976. This EIR was written to address the develop- ment of the property with a 14 unit apartment. Upon application for the revised tentative subdivision map, which is the subject of this public hearing, the Environmental Review Committee, at its meeting of October 7, 1976, determined that the proposed revised sub- division would not result in any new adverse environmental impacts not already addressed in EIR-76-1A. The Committee did, however, note the need to address the drainage problems related to the site and the adjacent area. BOARD/ COMMISSION RECOMMENDATION On October 25, 1976 the Planning Commission voted 5-0 to recommend to Council the approval of tentative map PCS-76-8 for Sweetheart Manor in accordance with resolution PCS-76-8. Council should note that the Commission's recommendation for approval included approval of the precise plan. No further action on the EIR is required. COUNCIL ACTIONS Resolution modified that the drainage problem be solved at the time of consideration of the final map rather than the tentative map. Land use and zoning: North - R-1 Single family dwellings East - R-1-5-P Single family dwellings South - R-2-T Split duplexes West - R-1-5-P Vacant 2. Proposed Subdivision. As shown on the enclosed tentative map, the 1.95 acre site is proposed to be divided into 13 single family residential lots, including Lot No. 11 which will accommodate an existing single family residence which will remain. The lots meet the standards for the R-1-5-P zoning with a minimum lot size of 5,000 sq. ft. Lots will be graded with pads for houses with slope banks as shown on the map. Access will be from Quintard Street for five lots (Nos. 9 through 13) and from a private street extending east from Tobias Drive for the remaining lots. Utilities. All utilities for the site will be provided as indicated on the drawing and as required by the conditions for approval listed in Resolution PCS-76-8. Drainage. The area of the proposed subdivision and an area of similar size to the west across Tobias Drive are currently in an undeveloped condition, except for the one existing single family residence fronting on Quintard Street. Run-off from this property and adjacent areas has created drainage problems, specifically for property owners to the north of the property west of Tobias Drive. The Public Works Department has recognized this problem and has determined that development of this area must address the problem and offer a viable solution to avoid further hardships for downstream property owners. As a result of discussions of these problems with the developer of the proposed Sweetheart Manor Subdivision, general agreement has been reached which provides that this developer and future developers of the remaining undeveloped land in the contributory area will participate with the City of Chula Vista in a permanent solution to this problem. Condition 5 of the conditions of approval makes such participation by the developer of this proposed subdivision mandatory and, in cooperation with adjacent property owners, is proposed to provide for the installation of a storm system to serve this area, conduct- ing drainage underground to the cul-de-sac of Provence Court to the north of the property and west of Tobias Drive. Sewers. This section of Chula Vista is currently experiencing problems relating to sewer capacity. The Public Works Department anticipates that the City will be correcting the problem within the immediate area through construction of larger lines. There also exists a problem in the County area to the south which is outside the City of Chula Vista's jurisdiction. It is not clear at this time when downstream capacity will be made sufficient to carry sewage resulting from new development. Asa result, any approval of actual construction projects requiring sewer connections must be conditioned upon the verification that capacity for such development is available. In addition to the above considerations, the Commission reviewed specific details relating to creation of and maintenance of a private street, treatment of slope banks, landscaping, fencing, and cooperative arrangements with adjacent property owners on grading.
