One additional condition was very briefly touched upon at the Council
meeting and has later been developed through discussions with the Public
Works Department and the developer, i.e., the method for securing neces-
sary off-site dedication and improvement of Telegraph Canyon Road and
the drainage facility. It is requested that the Council carefully review
the rather lengthy set of terms and conditions which are included in the
total resolution because of the totally new approach being undertaken.
Insofar as we are aware, no cities have attempted to establish areas of
benefit for streets although it has long seemed a perfectly reasonable
thing to do. Essentially, the condition states that the City, in the
event an assessment district has not been formed at the time of the
final map approval, which frankly seems highly unlikely, that the develo-
per and the City will share the costs as set forth in the condition to
insure the full improvement of Telegraph Canyon Road and the drainage
channel which will include dedication requirements as well as the possi-

bility of a need for condemnation of certain property for such
purpose. When such an area of benefit has been established, the
City and the developer will then be authorized for reimbursement
by those persons using the public improvements and benefiting
thereby. The approach, as I have indicated, is innovative and
will require a substantial amount of work to put together such an
area of benefit and establish procedures for future reimbursement.
Both the Public Works Director and the City Attorney, however, feel
very strongly that the mutual interests of the City and developer
require that the improvements be installed at the present time and
we are further aware that the possibility of being unable to obtain
said improvements, from smaller developments in the future, is a very
real one.
