ITEM TITLE: Resolution ~, Approving a Lien Agreement for Deferral of Sidewalk
Along Toyon Lane

The City Council, on August 10, 1976, by Resolution No. 8314, approved
modifications to the conditions of a variance, PCV-75-13, previously granted
to Mr. Joseph Bush by the Planning Commission for property abutting the
northerly right of way line of Toyon Lane.
The modifications to the variance were:
1. The requirement to install 295' of sidewalk be deferred subject
to the posting of a lien on the property.
2. That the property owners waive their right to protest the formation
of an improvement act district to install the sidewalk.
3. That the width of pavement be reduced from 28' to 22' and that the
northerly side of the street be painted to preclude parking along
that side of the street.
The property owners, Joseph Bush, Irene Bush and Michael Bush have executed
a lien agreement in the amount of $2500 to serve as a performance guarantee
for the installation of the sidewalk, which was deferred by the City Council.
It is therefore appropriate for the City Council to approve the lien
agreement. The lien agreement will be recorded in the office of the County
Recorder. A transparency is available for Council viewing.
