S. Construction Company to construct a storm drain in 5th Avenue between "J" and "K" Streets. All work has been performed in an acceptable manner in accordance with the contract documents dated June 3, 1976. R. S. Construction Company was to complete the contract work within 60 days, with the original contract completion date being August 25, 1976. When the contractor began work, he encountered unstable trench conditions which led to problems in finding an acceptable solution for supporting the trench walls. The contractor's progress was delayed for a period of about 2 weeks until, through trial and error procedures, he obtained an excavation shield which solved the problems encountered with the existing trench conditions. The shield was needed to comply with OSHA requirements and to protect the contractor's workmen within the trench. The Engineering staff therefore finds it reasonable to adjust the starting date for the contract to July 6, 1976, making the contract completion date September 7, 1976. The contractor completed the work on September 21, 1976, which was 2 weeks beyond the contract completion date. For the 14 days beyond the contract completion date, the Director of Public Works has imposed the liquidated damage clause of Section 3-04 of the contract documents. This clause provides far payment to the City of $50 per day for each and every day's delay in the time prescribed to complete the work. The penalty of $50 per day is to cower inspection costs beyond the contract completion date. S. Construction Company by letter on September 27, 1976 that he was imposing the $50 per day penalty for the 14-day period beyond the contract completion date of September 7, 1976.. R. S. Construction is to pay the City the sum of $700 before the end of the 35-day lien period or this amount will be deducted from the contractor's final 10~ retention payment. A final inspection was made on September 21, 1976 and all work was found to be in accordance with the contract plans and specifications. The Director of Public Works requests the City Council accept the public improvements. FINANCIAL STATEMENT: Contract amount, including Change Orders 1 and 2 $74,579.95 Final construction cost $74,641.50 Liquidated damages to be paid by R. S. Construction Co. 700.00 Total cost of project $73,941.50
