Staff has investigated each of the items and offers the following response. 1. Soil conditions. A soils investigation report was prepared for Dr. Greer by William Krooskos, Civil Engineer, dated August 26, 1876. That report noted that the entire site was underlaid with fill soils to a maximum depth of 12 feet. The report recommends that existing fill soils be excavated to a minimum depth of 4 feet below the proposed finish grade, or to a depth where firm soils are encountered. This excavation is recommended in the location of the proposed office building and for a distance of 5 feet beyond the perimeter of the building. The report indicates that the excavated soil may be reused by spreading it in layers and recompacting in accordance with techniques described in the report. The recompaction of soil on site is considered a normal construction technique, whereas, regrading the site to lower the elevation would require the exporting of soil to another location. In addition, any lowering of the site to coincide with elevations on Halecrest would leave the property below Hale Street, thus necessitating the installation of a protective wall or fence adjacent to the widewalk along Hale Street. BOARD/ COMMISSION RECOMMENDATION On August 23, 1976 the Planning Corrmiission voted 7-0 to recommend that the City Council certify the Negative Declaration and approve the Precise Plan in accordance with Resolution PCM-76-17. The Planning staff met with a representative of the Police Department to discuss the merits of relocating the parking lot and entrance to the building over to the east side of the lot facing onto Halecrest. The Police Department concluded that such a revision would not be necessary since their patrols would approach the site from different directions at various times, and under normal circumstances would enter the parking area to complete their patrol of the area. The Police also noted that any closure of the parking area at night would hamper their ability to properly patrol the area. It was felt that proper security lighting and wire alarm windows would be best to control any congregation of juveniles on site or possible burglaries. Both the Planning and Engineering Departments agree that Hale Street is the preferred location for the driveway. This allows vehicles to enter Halecrest from an intersecting street rather than a driveway. The average speed of traffic on Hale Street is 28 miles per hour vs. 30 miles per hour for Halecrest. Due to a traffic couni;er failure the Engineering Division was unable to get an accurate traffic count. However, it is believed that traffic volumes on both streets are low and about equal. Therefore, in the staff's opinion, this should not be a determining factor as to the location of the driveway. Relocation of the parking area along Halecrest Drive would tend to deemphasize the building and emphasize the parking lot. It is preferable to emphasize the structure when it is possible to do so. PCM-76-17 RESOLUTION OF TI1E CITY PLANNING LOPAIISSION RECOMtdENDING TO THE CITY COUNCIL TtiE APPROVAL OF THE PRECISE PLAN FOR A DENTAL OFFICE DUILDING AT T!!E SOUTIiWEST CORNER OF HALE STREET AND HALECREST DRIVE IN THE C-O-P ZONE WHEREAS, Ordinance No. 1418 adopted by the City Council on September 21, 1972, established the zoning for a 12,800 sq. ft. parcel at the southwestcorner of Hale Street and Halecrest Drive, as C-O-P, and WHEREAS, a precise plan for development of the property with a dental office building was filed by Max Greer, D.D.S. on July 29, 1976, and WHEREAS, the Lity Planning Commission held a public hearing at 7:00 p. m. on Monday, August 23, 1976, in the Council Chamber, City Hall, to consider the precise plan for development as submitted, and WHEREAS, the City Planning Commission found that in accordance the findings in the Negative Declaration on IS-76-49 the prlject would have no significant ad- verse environmental impact, and certified the Negative Declaration. NOW, THEREFORE, BE IT RESOLVED TI1AT THE CITY PLANNING COh1MISSION finds as follows: a. That such plan will not, under the circumstances of the particular case, be detrimental to the health, safety or general welfare of persons residing or working ~in the vicinity, or injurious to property or improvements in the vicinity. The structure will be located 60 feet from the closest residence and will be buffered from it by a retaining wall, parking, and landscaping. b. That such plan satisfies the principle for the application of the "P" Modifica- tion District as set. forth in Section 19.56.041. The building is architecturally treated on all exterior elevations and has setbacks in excess of the code requirements, thereby maintaining compatibility with the adjacent residential uses. c. That any exceptions granted which deviate from the underlying zoning require- ments shall be warranted only when necessary to meet the purpose and application of the °P" Precise Plan Modifying District. The proposed plan meets or exceeds all of the zoning requirements for the C-0 zone. d. That approval of this plan will conform to the general plan and the adopted policies of the city. BE IT FURTHER RESOLVED that the City Planning Commission recommends to the C{ty Louncilthe approval of the precise plan submitted by Max Greer, D.D.S. for construction of a dental office building on the 12,800 sq. ft. parcel located at the southwest corner of Hale Street and Halecrest Drive, subject to the following conditions• 1. The parkways shall be planted with grass and street trees as required by the Department of Public Works. 2. All slopes shall be planted with trees, ornamental shrubs and ground cover with special emphasis on shrubbery. 3. All landscaped areas, including the parkways, shall be irrigated by a permanent irrigation system. 4. The slopes adjacent to the retaining wall shall be planted with ground cover that will cascade over the wall. The wall shall be returned a minimum of 15 feet toward the main building to prevent soil from sloughing onto the parking area. 5. Wheel stops shall be provided and the parking stalls shall be double- striped. 6. The trash enclosure shall be rotated 90° and moved to the edge of the walk adjacent to the parking area with solid gates provided facing the parking area. 7. No freestanding signs shall be allowed. Only non-illuminated wall • mounted signs in accordance with C-0 standards, facing the streets and • parking areas, shall be allowed. 8. Provision shall be made for closing the access to the parking area to vehicular traffic during non-business hours. 9. Security lighting shall be provided for the parking area and grounds.
