ITEM TITLE: Resolution No. Supporting the separation of Fiscal Officers
and City Clerks into two departments of the League of California
Cities

ITEM EXPLANATION:
Present State Law provides that in general law cities, the government
is vested in a City Council of five members, a City Clerk, a City
Treasurer, a Chief of Police, a Fire Chief, and such subordinate
officers or employees as are provided by law. The State Laws, adopted
about 1850, still designate the City Clerk as the accounting and
finance officer as well as the ex-officio assessor, but now makes
provision for transfer of these duties to others. In 1908, City Managers
came into being and through the years, the city government became larger
and more complex; functions of the City Clerk were divided into categories.
Today, cities having City Managers and City Treasurers are the norm
rather than the exception. At this point in time, the duties of the City
Clerk and the Fiscal Officers are completely diverse; yet they remain
in one League Department, in one program, and in meetings where no
common interest or need exists.
The League functions to serve the purposes of local government and is an
organization of City Councils. In order for City Clerks and Fiscal
Officers to be aware of the very real concerns of City Councils and
City Managers, League Board representation and a separate program are
extremely important. The division of the department is therefore both
logical and is in no way precedent setting.

This department separation has been endorsed by our three state
associations: the City Clerks Association of California (CCAC),
the California Municipal Treasurers Association (CMTA), and the
California State Municipal Finance Officers (CSMFO).
Several years ago, the Director of Finance stopped going to the
League Conferences because of the lack of a good program for the
Finance Officers. The City Clerk has not budgeted for the League
Conferences for the past two years for the same reason.
We both ask that the Delegate to the League Conference (Mayor Hamilton)
be directed to vote in the general assembly of the Conference in
support of the separation of Fiscal Officers and City Clerks into
two League Departments.

You have rec~tly received background material and a copy of the
resolution which has been submitted to the League of California
Cities by our Finance Officers' Departrent urging separate depart-
ments of. the League for Finance Officers aryl City Clerks. The
effect of the resolution if adopted at the league's annual business
session on Wednesday morning will be to approve the change and to
amend the TParn]P'S bylaws so that it will not be necessary to ret~.irn
to the gernxal assembly for further action.

It is well to note that it is the contention of same that if the
League allows the separation into these tvo departments that trey
must then ackiress the splitting of other departments.
It is respectfully submitted that the position of other departments
are not relevant to that of that of the City Clerks arm Fiscal
Officers because the latter are officers of the city, not departments
or divisions. As city officers fulfilling state code mandated
functions, it is necessary that these officers receive the tools to
fulfill those functi.~s.

The league of California Cities functions to serve the purposes

important. A large, demxsatic society engenders many problans.
It is most difficult for unrecognized city officers to learn about
and develop problae solving methods with which to deal with those
concerns so as to most effectively function as support staff members.
The division of the department is therefore both logical and is in
no way precedent setting.
This department separation has been endorsed by our three state
associations: the City Clerks Association of California (CCAC),
the California Municipal Treasurers Association (Q?PA), and the
California State Municipal Finance Officers (CSMEb).
At last year's League business session we missed approval of the
general asssnbly by just the matter of a whisker. This year it
should carry easily if we approach our City Councils along with
our City Treasurers and Finance Officers with advance information
and request for their backing.
To assist you in your city, you will find enclosed a sample of a
resolution for adoption by your Council. This eras prepared in
accordance with a motion duly adopted by our annual n~nUership
meeting of CCAC in Monterey along with our manbership's reiteration
of support of the division of the present league Department.
It is my understanding that all manbers of the CMTA and the CSMFO
are also being contacted at this time by their respective presidents.
