RESOLUTION NO. 13462
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA AUTHORIZING DESTRUCTION OF CERTAIN
CITY CLERK RECORDS
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, it has been determined that certain City
records under the charge of the following City department are no
longer required for public or private purposes:
City Clerk
and
WHEREAS, it has been determined that destruction of the
above mentioned materials is necessary to conserve storage space,
and reduce staff time, expense and confusion in handling and
informing the public, and
WHEREAS, Section 34090 of the Government Code of the
State of California authorizes the head of a City department to
destroy any City records and documents which are over two years
old under his or her charge, without making a copy thereof, after
the same are no longer required upon the approval of the City
Council by resolution and the written consent of the City
Attorney, and
WHEREAS, it is therefore desirable to destroy said
records as listed in Exhibit "A" attached hereto and made a part
hereof, without making a copy thereof, which are two years old,
and
WHEREAS, said records have been approved for destruction
by the City Attorney.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does resolve as follows:
SECTION 1, That approval and authorization is hereby
given to destroy those records described in Exhibit "A" attached
hereto and made a part hereof.
SECTION 2. That the City Clerk shall certify to the
adoption of this resolution, and thenceforth and thereafter the
same shall be in full force and effect,

SUBJECT: Destruction of Personnel Department Records
This office has reviewed the request for destruction of records
described in Exhibit "Aw. m~ere is no requirements under the law
that we retain these records and Government Code Section 34090
describes the procedure by which we may destroy these no longer
needed records. It requires written consent by the City Attorney
and approval by the City Council. By this writing, the City
Attorney consents to the destruction of these records.

This report transmits a staff recommendation that the City Council by
resolution authorize the City Clerk to destroy certain records in her custody
which are no longer required.
RECOMMENDATION: That Council adopt the resolution approving destruction of
certain records as presented.

DISCUSSION:
Certain records located in the City Clerk's office have been inventoried and
approved for destruction by the City Clerk and the City Attorney. Section
34090 of the Government Code authorizes destruction of such records by
adoption of a resolution by the City Council.
As in the past, all records (tapes and files) authorized for destruction will
be stored in the basement of the Public Library. Volunteers catalog all
documents, set them in a filing order and they will be made available to the
Chula Vista Historical Society and any other archival organizations, as
requested. Also included in the list for authorization are 2 boxes of tapes
from April 13, 1982 to December 18, 1984 (tape numbers 701 through 803).
The City Attorney has researched this matter and advised that destruction of
these records is in conformity with the Government Code and should be
authorized by Council resolution.
