RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA DECLARING ITS INTENTION TO REVOKE A CONDITIONAL
USE PERMIT FOR A BOARDING HOUSE AT 456 CASSELMAN AND
A PUBLIC HEARING TO BE HELD ON AUGUST 3, 1976, AND
DIRECTING THE CITY ATTORNEY TO GIVE NOTICE TO SAID
BOARDING HOUSE OPERATOR TO SHOW CAUSE WHY THE
MAINTENANCE OF SAID BOARDING HOUSE IN VIOLATION OF
THE CHULA VISTA ZONING ORDINANCE SHOULD NOT BE
DECLARED A PUBLIC NUISANCE AND ABATED BY APPROPRIATE
LEGAL ACTION
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the Planning Commission on November 24, 1975 granted
a conditional use permit for the operation of a boarding house at 456
Casselman, at which time representations were made that the number of
unrelated persons occupying said premises would exceed the number per-
mitted in the R-3 zone, and
WHEREAS, said grant of a conditional use permit was appealed
to the City Council and the City Council on December 23, 1975 denied
said appeal and added certain conditions, among them, the requirement
that six off-street parking spaces be provided and that no tandem
parking be allowed to satisfy said parking requirements, and
WHEREAS, said premises have been operated as a boarding
house since the original grant of the conditional use permit, and
WHEREAS, the parking requirement conditions have never been
met, and
WHEREAS, the occupants, through their attorney, have been
informed by the City Attorney of the noncompliance with said condi-
tion and the request by the City Council to take affirmative action
by June 1, 1976 or said conditional use permit would be revoked and
the boarding house operation declared to be a public nuisance.
NOW, THEREFORE, BE 2T RESOLVED by the City Council of the
City of Chula Vista that the City Attorney be, and he is hereby
directed, pursuant to the Chula Vista Municipal Code, to issue
notice to said operator of the boarding house at 456 Casselman, in
the appropriate manner, to appear before the City Council of the
City of Chula Vista at the hour of 7:00 p.m, on Tuesday, August 3,
1976, in the Council Chambers, 276 Fourth Avenue, Chula Vista,
California, to show cause why the conditional use permit previously
issued should not be revoked and said boarding house operation
should not be declared a public nuisance and abated by appropriate
legal action.
BE IT FURTHER RESOLVED that the City Clerk of the City of
Chula Vista be, and she is hereby directed to cause the publication
of a legal notification of said owners, operators or occupants in
a form prepared by the City Attorney.
