Signed resolutions must be submitted to SANDAG by September 2, 2011. The City will need to submit a request for amendment in order to provide funding for two projects that were approved as part of the City's Capital Improvement Program (CIP) for Fiscal Year 2011-12. ENVIRONMENTAL REVIEW The Director of Development Services has reviewed the proposed activity, consisting of approval to submit a funding request for various Transnet Projects to SANDAG, for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is 5-1 8/16/11, Item 5 Page 2 of 6 not a "Project" as defined under Section 15378 of the State CEQA Guidelines. Therefore, pursuant to Section 15060 (c)(3) of the State CEQA Guidelines the activity is not subject to CEQA. Thus, no environmental review is necessary at this time. Although environmental review is not necessary at this time, once the scope of the individual projects proposed to be funded have been more specifically defined, environmental review will be required for each project and the appropriate environmental determination will be made. RECOMMENDATION Council conduct the public hearing and adopt the resolution. BOARDS/COMMISSION RECOMMENDATION Not applicable. DISCUSSION State and Federal regulations require the San Diego Association of Governments (SANDAL) to develop and adopt a Regional Transportation Improvement Program (RTIP) every two years in order to continue receiving State and Federal funding. SANDAL also administers and distributes to local cities funding from Transnet, transportation funding obtained from the %-cent sales tax extended to the year 2048 by San Diego County voters in November 2004. All projects that the City of Chula Vista proposes to fund with Transnet funds must be included within the RTIP, as well as projects that are funded with State and Federal funds. Council approved the allocation of the City's portion of the 2010 RTIP on March 23, 2010. The 2010 RTIP allocated the City's anticipated funding from the Transnet Local Street Improvement Program for Fiscal Years 2010-11 through 2014-15 based on projections provided by SANDAL. The City can amend the RTIP on a quarterly basis in order to reflect changing needs and priorities, as long as at least 70 percent of funds are used for construction of new or expanded facilities, major rehabilitation and reconstruction of roadways, traffic signalization, transportation infrastructure to support smart growth, capital improvements for transit facilities, and operational support for local shuttle and circular transit routes (defined as "Congestion Relief'). On March 10, 2011, Council held a public hearing and adopted Resolution No. 2011-047 (Attachment 1), which amended the City's portion of the 2010 RTIP. The amendment reflected revised funding estimates provided by SANDAL, included additional locations for certain projects, revised funding for existing projects, and added projects that staff anticipated would be included in the Fiscal Year 2011-12 Capital Improvement Program (CIP). This amendment (2010 RTIP Amendment No. 7) was approved by the SANDAL Board on April 15, 2011 and by the Federal government (as the FTIP) on May 13, 2011. PROPOSED RTIP AMENDMENT Roadway Improvements at Olympic Parkway and Brandywine Avenue One project added in Amendment No. 7 was the Eastern Chula Vista Transportation System Management (TSM)/Transportation Demand Management (TDM) System (CHV64). East H Street, Telegraph Canyon Road and Olympic Parkway east of Interstate 805 (I-805) are three major east/west corridors in eastern Chula Vista that handle a combined total of over 185,000 5-2 8/16/11, Item Page 3 of 6 vehicles per day. These corridors constantly need signal timing changes due to fluctuating traffic demands. There is a need to improve our Transportation System Management (TSM) on these three corridors with additional detection and improved corridor-level traffic signal timing plans. Due to the amount of vehicular traffic on these corridors, improving mobility and reducing delays will have a tremendous effect on the motoring public. This project will implement permanent software/hardware systems that incorporate additional vehicle/bicycle detection on approaches and gaps. Real-time data collected will then be used to assess, refine and implement optimal traffic signal timing plans on these corridors. This information and these signal plans will augment the arterial data through the Regional Arterial Management System (RAMS) so that real-time travel analysis can also collaboratively be made available to the region, Caltrans, the local agency and the public to allow for Transportation Systems Management (TSM) and Transportation Demand Management (TDM). The cost of this project was estimated to be $300,000 (Attachment 2). During the process of preparing the Fiscal Year 2011-12 CIP, revised cost estimates were obtained from the supplier of the software and hardware systems needed to implement this project. The cost estimate was revised to $450,000. The proposed funding source was changed to the Transportation Development Impact Fee (TDIF), as shown on the Project Description Report for the Traffic Monitoring Center -Traffic Management System (TF379 -Attachment 3), which is the same project as CHV64. A sufficient amount was available in the TDIF fund balance to fund this project. The TDIF is intended to provide funding for transportation impacts due to development in eastern Chula Vista. Since the increase in traffic along these comdors in eastern Chula Vista is due to increased development, this is an appropriate use for the TDIF funds. Contracts for the installation of this equipment were awarded by Council resolution on August 2, 201 L An additional project along one of these comdors was projected and adopted as part of the Fiscal Year 2011-12 CIP, Roadway Improvements at Olympic Pazkway and Brandywine (TF377 - Attachment 4). Currently there is a long line of cars on westbound Olympic Parkway in the left turn lane to southbound Brandywine Avenue during morning and afternoon rush hours. These cars extend beyond the current left turn lane, thereby blocking through traffic. The recommended project will increase the length of the westbound left turn pocket on Olympic Parkway, make traffic signal modifications, signal timing and striping changes in order to eliminate traffic congestion at this intersection. The cost was estimated to be $300,000. It was assumed that the $300,000 Transnet allocation for CHV64 could be transferred to this project, since it is eligible to receive Congestion Relief funds. Harborside Elementary Pedestrian Improvements The Hazborside Elementary Pedestrian Improvements project (TF368) was originally submitted for the Fiscal Year 2008-09 CIl' in anticipation of receiving a Federal Transportation Community and System Preservation (TCSP) grant. The original Transnet match was to be $85,000 for a grant amount of $410,000. These funds have been programmed into RTIP project CHV46. Design of this project has been completed and plans have been sent to Caltrans. It has been estimated that an additional $177,000 will be needed in order to complete construction of this project. The additional funding has been approved as part of the Fiscal Year 2011-12 CII' 5-3 8/16/11, Item S Page 4 of 6 (Attachment 5). Funds will be reallocated from TF330, Traffic Signal Modifications at Fourth and Main and Fourth and Beyer (CHV35). These funds have not yet been drawn down and are still on deposit with SANDAL. TRANSNET REALLOCATION Enhanced Traffic Calming Improvements at Montgomery Elementary School On June 22, 2010, Council authorized staff to submit three grant applications for State Safe Routes to School (SR2S) funding. Staff subsequently received a letter from Caltrans on October 20, 2010 stating that the City had been awarded $165,780 for the construction of traffic calming improvements in the vicinity of Montgomery Elementary School. The City was required to provide local matching funds of $18,420. Council adopted Resolution No. 2010-290 on December 14, 2010 (Attachment 6), which accepted the grant funds and stated that the match would be provided from Transnet funds that had already been appropriated under TF345, School Zone Traffic Calming Program (CHV33). This project was subsequently included in the Fiscal Year 2011 -12 CIP Program as STL375 (Attachment 7), with the Transnet contribution rounded to $20,000. The new project is still categorized as School Zone Traffic Calming, so it will not affect the RTIP or Transnet programming, since the funds will stay within CHV33. However, the City's accounting will reflect that the $20,000 in funds will be allocated under STL375. Lauderbach Elementary School Pedestrian Improvements On March 24, 2009, Council authorized staff to submit three grant applications for State Safe Routes to School (SR2S) funding. Staff subsequently received a letter from Caltrans on August 11, 2009 stating that the City had been awarded $204, 300 for the construction of traffic calming and pedestrian improvements at Fourth Avenue and Orsett Street. The City was required to provide local matching funds of $25,480. Council adopted Resolution No. 2009-222 on September 15, 2009 (Attachment 8), which accepted the grant funds and stated that the match would be provided from Transnet funds in the Fiscal Year 2009-10 CIP. Anew CIP project was created as STM368, Lauderbach Elementary School Pedestrian Improvements. This project is currently in construction. In order to meet American with Disabilities Act (ADA) requirements, additional design and construction work is necessary. It has been determined that an additional $50,000 is needed in order to complete the project. According to SANDAL, the City has an unappropriated carry over Transnet balance of $128,000 from previous fiscal year. Staff proposes to appropriate $50,000 of this balance into STM368. Changes proposed by both the RTIP Amendment and the Transnet Reallocation are summarized in the table, "2010 RTIP/ Transnet Reallocation Changes" (Attachment 9). TRANSNET REQUIREMENTS Section 4(E)(3) of the Transnet Ordinance states, "All new projects, or major reconstruction projects, funded by revenues provided under this Ordinance shall accommodate travel by pedestrians and bicyclists, except where pedestrians and bicyclists are prohibited by law from using a given facility or where the cost of including bikeways and walkways would be excessively disproportionate to the need or probable use." This was further elaborated in Rule 20 of SANDAL Board Policy 31, "Accommodation of Bicyclists and Pedestrians", adopted by 5-4 8/16/11, Item S Page 5 of 6 the SANDAL Board of Directors on February 22, 2008. This rule states that evaluating bicycle and pedestrian accommodation is required for all major reconstruction projects included under Congestion Relief under the 70-30 requirement. The decision not to provide for pedestrian and bicycle facilities in a construction or major reconstruction project must be made for good cause, such as severe topographic or biologic constraints, lack of sufficient right-of--way, or missing curb and gutter (for sidewalks). It further states that cities may use a bicycle or pedestrian master plan adopted by the city council and approved by SANDAL within the last five years to determine the appropriate means of accommodating bicyclists and pedestrians in a given project. Since Chula Vista's Bikeway Master Plan Update was recently adopted by the City Council on February 1, 2011 and the Pedestrian Master Plan was adopted on June 22, 2010, they qualify under this provision. Staff has evaluated both of the projects included in the RTIP amendment for compliance with the bicycle and pedestrian regulations. The Harborside Elementary School project is classified as a maintenance project, so it is not subject to this policy. However, the purpose of this project is to provide missing pedestrian and bicycle improvements in the vicinity of Harborside Elementary School. Olympic Parkway and Brandywine Avenue have complete pedestrian facilities and Class II bike lanes. Therefore, this RTIP Amendment is in compliance with the City's 2011 Bikeway Master Plan, the City's 2010 Pedestrian Master Plan and Rule 20 of the SANDAL Board Policy No. 31. No bicycle or pedestrian exclusions are necessary. The Transnet Extension Ordinance also requires that the City exact from the private sector a minimum of $2000 per new residential unit (EDU), effective July 1, 2008, with annual escalation based on the ENR (or similar) Construction Cost Index. Beginning July 1, 2011, the minimum collected requirement is $2123 per EDU. The City's Western Chula Vista Transportation Development Impact Fee (WTDIF), originally effective July 1, 2008, complies with this minimum. The City's Transportation Development Impact Fee has been in place for many years for the area of the City east of I-805. The TDIF also complies, even though it was enacted before the new Transnet legislation for the RTCIP was adopted. These exactions are to pay for the proportional share of funding to improve the Regional Arterial System. Low to moderate income housing units are exempt. DECISION MAKER CONFLICT Staff has reviewed the property holdings of the City Council Members and has found no property holdings within 500 feet of the boundaries of the properties which are the subjects of this action. CURRENT YEAR FISCAL IMPACT This action will have a positive impact on the General Fund because it will allow us to use Transnet to pay for costs that may have otherwise needed to be funded through the General Fund. Approval of this item will allow the City to reallocate funds for Fiscal Year 2011-12 and authorize the appropriation of $50,000 from the available TransNet balance to exsiting CIP STM368. 5-5 8/16/11, Item S Page 6 of 6 ONGOING FISCAL IMPACT None. NOW", THEREFORE, BE 1T RESOLVED that the City Council of the City of Chula Vista hereby: 1. Approves the amendment of the Transnet Local Street Improvement Program for submittal to the San Diego Association of Governments for inclusion in the Regional Transportation Improvement Program For Fiscal Years 2010/2011 through 2014/2015. 2. Approves the addition of $495,842 in unallocated funds (Transnet Cash) from Fiscal Year 2009/2010 to CHV 19 (STM354, North Broadway Reconstruction Project) to be appropriated in the Fiscal Yeaz 2011/2012 CIP budget. 3. Certifies pursuant to Section 2(C)(1) of the Transnet Extension Ordinance, no more than 30 percent of its annual revenues shall be spent on maintenance-related projects. 4. Certifies pursuant to Section 4(E)(3) of the Transnet Extension Ordinance, all new projects, or major reconstruction projects, funded by Transnet revenues shall accommodate travel by pedestrians and bicyclists, and that any exception to this requirement permitted under the Ordinance and proposed shall be clearly noticed as part of the City of Chula Vista's public hearing process. 5-8 Resolution No. 2011-047 Page 3 5. Certifies pursuant to Section 8 of the Transnet Extension Ordinance, the required minimum annual level of local discretionary funds to be expended for street and road purposes will be met throughout the five-yeaz period consistent with the most recent Maintenance of Effort Requirements adopted by SANDAG. 6. Certifies pursuant to Section 9.A of the Extension Ordinance, the City will extract at least $2,000 from the private sector for each newly constructed residential housing unit to comply with the provisions of the Regional Transportation Congestion Improvement Program. 7. Certifies pursuant to Section 13 of the Transnet Extension Ordinance, that a separate Transportation Improvement Account has been established for Transnet revenues, with earned interest expended only for those purposes for which the funds were allocated. 8. Certifies pursuant to Section 18 of the Transnet Extension Ordinance, each project of $250,000 or more will be cleazly designated during construction with Transnet project funding identification signs. 9. Indemnifies, holds harmless and defends SANDAG, the San Diego County Regional Transportation Commission, and all officers and employees thereof against all causes of action or claims related to local Transnet funded projects. 10. And NEW Relief Brandywine Avenue STM368 Lauderbach Elementary CHV33 Maintenance $50,000 Pedestrian Im rovements Transnet Carryover N/A ($50,000) 5-23 RESOLUTION NO. 2011 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE AMENDMENT OF THE TRANSNET LOCAL STREET IMPROVEMENT PROGRAM FOR SUBMITTAL TO THE SAN DIEGO ASSOCIATION OF GOVERNMENTS FOR INCLUSION IN THE REGIONAL TRANSPORTATION IMPROVEMENT PROGRAM ("RTIP") FOR FISCAL YEARS 2010/2011 THROUGH 2014/2015; AND PROVIDING CERTIFICATION AND INDEMNITY STATEMENTS NECESSARY TO OBTAIN TRANSNET FUNDS WHEREAS, on November 3, 1987, the voters of San Diego County approved the San Diego Transportation Improvement Program Ordinance and Expenditure Plan (Ordinance); and WHEREAS, on November 4, 2004, the voters of San Diego County approved the San Diego County Transportation Improvement Program Ordinance and Expenditure Plan (Transnet Extension Ordinance); and WHEREAS, the Transnet Extension Ordinance provides that the San Diego Association of Governments (SANDAG), acting as the Regional Transportation Commission, shall approve a multi-year program of projects submitted by local jurisdictions identifying those transportation projects eligible to use transportation sales tax (Transnet) funds; and WHEREAS, Section 4.E.3 of the Extension Ordinance states that all new projects, or major reconstruction projects, funded by revenues provided under this Ordinance shall accommodate travel by pedestrians and bicyclists, except where pedestrians and bicyclists are prohibited by law from using a given facility or where the costs of including bikeways and walkways would be excessively disproportionate to the need or probable use; and WHEREAS, Rule 21 "Accommodation of Bicyclists and Pedestrians" was adopted by the SANDAG Board on February 22, 2008, to provide a guide to appropriate accommodation measures for various types of streets; and WHEREAS, the Rule 21 Amendment states that a local jurisdiction may use a bicycle or pedestrian master plan adopted by the city council and approved by SANDAG to determine the appropriate means of accommodating bicyclists and pedestrians in a given project and at a minimum provide the facilities called for in the plan; and WHEREAS, on June 22, 2010, pursuant to Resolution No. 2010-170, the City Council adopted the City's Pedestrian Master Plan; and WHEREAS, on February 1, 2011, pursuant to Resolution No. 2011-013, the City Council adopted the City's Bikeway Master Plan Update; and 5-24 Resolution No. 2010- Page 2 WHEREAS, in February 2011, the City of Chula Vista was provided with an estimate of annual Transnet local street improvement revenues for fiscal years 2011 through 2015; and WHEREAS, on March 10, 2011, Council held a public hearing and adopted Resolution No. 2011-047, which amended the City's portion of the Transnet Local Street Improvement Program for Fiscal Years 2010/2011 through 2014/2015 in accordance with the February 2011 revenue projections. This amendment was included in the Regional Transportation Improvement Program (RTIP), which was approved by the SANDAG Board on April 15, 2011 and by the Federal government (as the FTIP) on May 13, 2011; and WHEREAS, the approved Fiscal Year 2011-12 Capital Improvement Program (CIP) included several funding changes that would affect Transnet allocations approved on April 15, 2011 and, therefore, require amendment to the RTIP; and WHEREAS, one such funding change was the removal of $300,000 in Transnet funding from TF379 Traffic Monitoring Center -Traffic Management System. Those fiords were added to TF377 Roadway Improvements at Olympic Parkway and Brandywine; and WHEREAS, the other relevant change was that $177,000 in Transnet funding was deleted from TF330 Traffic Signal Modification (Fourth and Main, Fourth and Beyer) and added to TF368 Harborside Elementary School Pedestrian Improvements; and WHEREAS, in addition to approving and submitting the RTIP amendment, the City is required to provide certain certifications and indemnity statements to SANDAG to ensure that it may obtain the Transnet funding; and WHEREAS, the City Council of the City of Chula Vista held a noticed Public Hearing on August 16, 2011, with an agenda item that clearly identified the proposed list of projects prior to approval of the projects in accordance with Section 5(A) of the Transnet Extension Ordinance and Rule 7 of SANDAG Board Policy 31. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista hereby: 1. Approves the amendment of the Transnet Local Street Improvement Program for submittal to the San Diego Association of Governments for inclusion in the Regional Transportation Improvement Program for Fiscal Years 2010/2011 through 2014/2015. 2. Certifies pursuant to Section 2(C)(1) of the Transnet Extension Ordinance, no more than 30 percent of its annual revenues shall be spent on maintenance-related projects. 3. Certifies pursuant to Section 4(E)(3) of the Transnet Extension Ordinance, all new projects, or major reconstruction projects, funded by Transnet revenues shall 5-25 Resolution No. 2010- Page 3 accommodate travel by pedestrians and bicyclists, and that any exception to this requirement permitted under the Ordinance and proposed shall be clearly noticed as part of the City of Chula Vista's public hearing process. 4. Certifies pursuant to Section 8 of the Transnet Extension Ordinance, the required minimum annual level of local discretionary funds to be expended for street and road purposes will be met throughout the five-year period consistent with the most recent Maintenance of Effort Requirements adopted by SANDAG. 5. Certifies pursuant to Section 9.A of the Extension Ordinance, the City will extract at least $2,000 from the private sector for each newly constructed residential housing unit to comply with the provisions of the Regional Transportation Congestion Improvement Program (RTCIP). 6. Certifies pursuant to Section 13 of the Transnet Extension Ordinance, that a separate Transportation Improvement Account has been established for Transnet revenues, with earned interest expended only for those purposes for which the funds were allocated. 7. Certifies pursuant to Section 18 of the Transnet Extension Ordinance, each project of $250,000 or more will be clearly designated during construction with Transnet project funding identification signs. 8. Indemnifies, holds harmless and defends SANDAG, the San Diego County Regional Transportation Commission, and all officers and employees thereof against all causes of action or claims related to local Transnet funded projects. 9. Hopkins Director of Public Works 5-26 RESOLUTION NO. 2011- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING REALLOCATION OF TRANSNET FUNDS IN CHV33 AND APPROPRIATING $50,000 INTO EXISTING CIP PROJECT STM368 FROM THE AVAILABLE TRANSNET BALANCE WHEREAS, on November 3, 1987, the voters of San Diego County approved the San Diego Transportation Improvement Program Ordinance and Expenditure Plan (Ordinance); and WHEREAS, on November 4, 2004, the voters of San Diego County approved the San Diego County Transportation Improvement Program Ordinance and Expenditure Plan (Transnet Extension Ordinance); and WHEREAS, the Transnet Extension Ordinance provides that the San Diego Association of Governments (SANDAG), acting as the Regional Transportation Commission, shall approve a multi-year program of projects submitted by local jurisdictions identifying those transportation projects eligible to use transportation sales tax (Transnet) funds; and WHEREAS, in February 2011, the City of Chula Vista was provided with an estimate of annual Transnet local street improvement revenues for fiscal years 2011 through 2015; and WHEREAS, SANDAG's estimate indicates that $128,000 in unallocated Transnet funds from previous fiscal years is available for allocation to Transnet-eligible projects; and WHEREAS, as an additional $50,000 in funding is needed for Capital Improvement Program (CIP) project STM368, Lauderbach Elementary School Pedestrian Improvements, in order to cover costs associated with Americans with Disabilities Act (ADA) compliance, staff requests that Council appropriate such amount from the unallocated Transnet funds to STM368 to cover the shortfall; and WHEREAS, the approval of the Fiscal Year 2011-12 CIP budget reallocated $20,000 in Transnet funds from TF345 to TF375, Traffic Calming at Montgomery Elementary School; and WHEREAS, though such reallocation of funds from TF345 to TF375 does not require an amendment of the Regional Transportation Improvement Program (RTIP), since both projects are included under RTP project CHV33, School Zone Traffic Calming, SANDAG staff has requested that this type of reallocation be specifically identified and approved by council resolution for audit purposes. 5-27 Resolution No. 20ll- Page 2 NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve the reallocation of Transnet funds in CHV33 from TF345 to TF375 and the appropriation of $50,000 from unallocated Transnet funds into existing CIP project STM368.
